第一章  总 则

  第一条  为了保证及时有效地组织和实施民用运力国防动员,根据《中华人民共和国国防动员法》和《民用运力国防动员条例》等法律、法规,结合本省实际,制定本办法。

  第二条  本办法适用于本省行政区域内民用运力国防动员及其相关活动。

  本办法所称民用运力国防动员,是指在战时及平时特殊情况下,根据国防动员需要,县级以上人民政府依法对机关、社会团体、企业、事业单位和公民个人(以下简称单位和个人)所拥有或者管理的车辆、船舶、航空器等民用运载工具及相关设备、设施、人员,进行统一组织和调用的活动。

  第三条  县级以上国防动员机构负责组织领导本行政区域的民用运力国防动员工作。国防交通主管机构(包括负责国防交通工作的机构)负责民用运力国防动员工作的具体实施。

  国民经济动员机构、人民武装动员机构和交通运输、公安、财政、民政、邮政、电信、铁路、航空等部门和单位在各自的职责范围内,负责有关的民用运力国防动员工作。

  第四条  民用运力国防动员应当遵循统一领导、分级实施、统筹兼顾、合理调配的原则。

  第五条  一切拥有或者管理民用运力的单位和个人,应当依法履行民用运力国防动员义务。

  因履行民用运力国防动员义务而遭受直接财产损失、人员伤亡的,依法享有获得补偿、抚恤的权利。

  第六条  国家级、地方级应急保障车队应当作为民用运力国防动员的主要保障和骨干力量。

  第七条  组织实施民用运力国防动员的单位和人员以及被征民用运力的单位和个人,应当严格遵守国家安全保密相关规定,禁止非法使用、传播、发布民用运力国防动员资料和信息。

  第八条  县级以上人民政府及国防交通主管机构对在民用运力国防动员工作中作出突出贡献的单位和个人,依照国家和我省的有关规定给予表彰、奖励。

第二章  民用运力国防动员准备

  第九条  省国防交通主管机构应当会同省国民经济动员机构、省人民政府有关部门和同级军事机关,根据国家、沈阳军区的规划和任务,编制本省民用运载工具及相关设备贯彻国防要求的总体规划,报省国防动员机构批准后执行。

  省国民经济动员机构应当根据批准的总体规划,拟订新建造民用运载工具及相关设备贯彻国防要求的具体实施计划并组织实施。

  第十条  县级以上人民政府及有关部门应当为贯彻国防要求承担设计、建造民用运载工具及相关设备任务的单位和个人,提供业务指导和政策、技术支持,保障有关国防要求的落实。

  有关单位和个人,应当按照相关设计标准和技术规范设计、建造运载工具和设备。

  第十一条  县级以上交通运输、公安、邮政、电信等部门和单位,应当按照民用运力国防动员准备登记的要求,于每年1月底前,将上一年度民用运力的有关资料和情况报送同级国防交通主管机构。

  市(州)国防交通主管机构应当于每年2月底前,将上一年度民用运力基本情况报送省国防交通主管机构。

  铁路、民航负责国防交通工作的机构应当于每年2月底前,将上一年度本行业在我省的运力情况,报送省国防交通主管机构。

  有关部门和单位未按时报送相关资料和情况或报送的资料和情况不符合要求的,国防交通主管机构可以要求补充报送或重新报送,相关部门和单位应当予以配合。

  第十二条  省、市(州)国防交通主管机构应当对民用运力有关资料和情况进行分类整理、登记造册,建立民用运力数据库,并根据变化情况及时更新。

  民用运力数据库主要包括:公路运力、水路运力、铁路运力、航空运力以及加油站、场站、维修厂(站)等相关运力情况。

  第十三条  根据民用运力国防动员准备工作的需要,省国防动员机构可以将机场、车站、港口、码头、货运场站、物流中心等基础设施列为民用运力国防动员基地。

  第十四条  省国防交通主管机构应当会同省人民政府有关部门和同级军事机关拟订省民用运力国防动员预案,拟订的预案应当报省国防动员机构批准,并报送沈阳军区国防交通主管机构备案。

  市(州)、县(市)民用运力国防动员预案,由同级国防交通主管机构根据上级民用运力国防动员预案和本地区实际情况拟订,经同级国防动员机构批准后,报上一级国防交通主管机构备案。

  民用运力国防动员预案的修改、调整,按照原拟订程序和批准权限办理。

  第十五条  民用运力国防动员预案应当包括下列内容:

  (一)民用运力国防动员任务;

  (二)国防交通主管机构、国民经济动员机构等部门和单位的分工;

  (三)民用运力国防动员的具体程序和要求;

  (四)预征民用运载工具及相关设备的加装改造方案;

  (五)民用运力国防动员保障措施;

  (六)其他相关内容。

  第十六条  国防交通主管机构应当根据本级民用运力国防动员预案的要求,对预征民用运力进行编组,编组应当尽量保持预征民用运力单位的组织建制完整。

  第十七条  国防交通主管机构应当制定本级预征民用运力训练的五年规划和年度计划,并会同人民武装动员机构和军事机关组织开展预征民用运力军事训练、专业技术训练和综合性动员演练,检验预征民用运力的到点率、准点率、动员集结时间和调整变动情况,并及时报告上一级国防交通主管机构。

  第十八条  军区级以上单位批准的军事训练、演习,可以征用民用运力。

  军事训练、演习确需征用民用运力的,必须按照中央军事委员会规定的程序报军区级以上单位批准,批准后由国防交通主管机构根据民用运力国防动员预案组织实施。

  第十九条  拥有或者管理预征民用运力的单位应当建立民用运力国防动员应急机制,落实预征的民用运载工具及相关设备类型、数量和操作、保障人员,提高民用运力国防动员的保障能力。

  第二十条  预征民用运力发生下列情况时,拥有或者管理预征民用运力的单位和个人应当在30日内告知当地国防交通主管机构:

  (一)民用运载工具更新、改造、出租、转让或者报废的;

  (二)人员重大疾病、伤残或者死亡的;

  (三)运载工具操作人员变更的;

  (四)运载工具离开本行政区域30日以上的;

  (五)人员通信联络方式变更的;

  (六)应当告知的其他重大事项。

第三章  民用运力国防动员实施

   第二十一条  国防交通主管机构应当根据上级下达的民用运力国防动员任务和使用单位提出的申请,迅速启动、实施民用运力国防动员预案。

   国防交通主管机构应当会同本级人民武装动员机构,向被征民用运力的单位和个人下达征用通知,明确其被征民用运载工具及相关设备的类型、数量和操作、保障人员,以及民用运力集结的时间、地点、方式和联络方式等。

   第二十二条  被征民用运力的单位和个人接到征用通知后,应当组织被征民用运载工具和相关人员准时到达集结地点,并保证被征民用运载工具的技术状态良好,相关人员的技能符合军事行动要求。

   被征民用运力的单位和个人无法准时到达集结地点的,应当立即报告,并按人民武装动员机构与使用单位下达的新的集结指令执行。

   第二十三条  被征民用运力集结地的人民武装动员机构应当会同国防交通主管机构及有关部门组成指挥机构,对集结后的民用运力进行登记编组、查验整备,组织应急训练,保证按时交付使用单位。

  第二十四条  被征民用运力交付使用单位时,国防交通主管机构和使用单位应当进行点验,签署交接书。交接书包括运力编组名册、运载工具类型、技术状况资料、被征人员的情况资料等。

  被征民用运力的安全防护、后勤保障和装备维修等,在民用运力集结期间由指挥机构负责,移交使用单位后,由使用单位负责,其执行任务所在地的人民政府应当予以协助。

  民用运力指挥机构、使用单位应当保证人员安全,并避免民用运载工具及相关设备、设施受到损毁。

   第二十五条  被征民用运载工具及相关设备需要加装改造的,由国民经济动员机构会同国防交通主管机构和使用单位,按照民用运力国防动员预案确定的加装改造方案实施。

  承担加装改造任务的单位和个人,应当按照国家安全技术标准和国防要求进行加装改造,并按期交付使用。

  第二十六条  按照本办法第十三条规定使用机场、车站、港口、码头、货运场站、物流中心等基础设施的,国防交通主管机构提出使用要求,有关部门和单位应当支持配合,由拥有或者管理相关设施的单位和个人记载使用情况,并经使用单位签字确认。

  第二十七条  经省人民政府批准,省国防交通主管机构会同省公安、交通运输部门,对执行任务的民用运载工具及相关设备发放专用通行标志。

   持有或者标识专用通行标志的民用运载工具及相关设备,在执行任务期间优先通行,免缴通行费用。任务完成后,国防交通主管机构应当及时收回专用通行标志。

  专用通行标志由省国防交通主管机构统一印制。

第四章  补偿抚恤与经费保障

   第二十八条  参加预征民用运力训练的人员,训练期间的误工补贴或者在原单位的工资、奖金、福利待遇以及伙食补助、往返差旅费等经费,训练人员纳入民兵组织的,依照国家有关民兵参加军事训练的规定执行;未纳入民兵组织的,参照国家有关民兵参加军事训练的规定执行。军事训练、演习征用民用运力的补偿费用,按租用方式计价结算,具体办法按照国家有关规定执行。

   第二十九条  单位和个人因履行民用运力国防动员义务造成下列直接财产损失的,由财政部门按照国家和省有关规定给予合理补偿:

  (一)民用运载工具及相关设备和机场、车站、港口、码头等设施的灭失、损坏、折旧;

   (二)民用运载工具及相关设备和机场、车站、港口、码头等设施的操作、保障人员的工资或者津贴;

   (三)经加装改造的民用运载工具及相关设备不能恢复原有功能的;

   (四)民用运载工具及相关设备加装改造产生的费用;

   (五)应当给予合理补偿的其他直接财产损失。

   第三十条  民用运力国防动员任务完成后15日内,由民用运力使用单位、拥有或者管理民用运力的单位和个人、国防交通主管机构共同查验被征民用运载工具及相关设备、设施的损失、损坏情况,以及操作、保障人员的伤亡情况,并在查验清单上签字确认,由民用运力使用单位如实出具民用运力使用、损毁、伤亡情况证明。

   因特殊原因不能按时完成查验确认和出具证明的,可适当延长期限,但最长不得超过30日,并向拥有或者管理民用运力的单位和个人说明原因。

   第三十一条  拥有或者管理民用运力的单位和个人,凭民用运力使用、毁损情况证明,向当地国防交通主管机构申报经济补偿。

   国防交通主管机构应当在收到申报经济补偿之日起15个工作日内完成审核工作,向同级人民政府提出补偿建议,经批准后组织实施。

   第三十二条  拥有或者管理民用运力的单位和个人,凭民用运力人员伤亡情况证明,向当地民政部门申报抚恤优待。

  抚恤优待的办法和标准,由县级以上人民政府民政部门依照《军人抚恤优待条例》等国家和我省有关规定执行。

  第三十三条  因履行民用运力国防动员义务应当依法获得补偿、抚恤优待的单位和个人,未获得补偿、抚恤优待或者对补偿、抚恤优待有争议的,可以依法申请行政复议或者提起行政诉讼。

  第三十四条  县级以上人民政府应当将本级民用运力国防动员所需费用列入财政预算。

    民用运力国防动员经费应当专款专用,并接受财政、审计部门的监督。

第五章  法律责任

  第三十五条  违反本办法规定的行为,由相关部门、机构依照《中华人民共和国国防动员法》、《民用运力国防动员条例》等法律、法规的规定进行处罚。

  第三十六条  国防交通主管机构、交通运输、公安和其他有关部门工作人员有下列行为之一的,由有关主管机构对直接负责的主管人员和其他直接责任人员依法给予行政处分;构成犯罪的,依法追究刑事责任:

   (一)拒不执行上级下达的民用运力国防动员命令的;

   (二)泄露民用运力国防动员秘密或者非法使用、传播、发布民用运力国防动员资料和信息的;

   (三)贪污、挪用国防动员经费、物资或擅自使用民用运力国防动员经费的;

   (四)对征用的民用资源,拒不登记、出具凭证,或者违反规定使用造成严重损坏,以及不按照规定予以返还或者补偿的;

   (五)拒绝或者无故延迟报送民用运力有关资料和情况的;

   (六)超越权限,擅自动员民用运力的;

   (七)对被征用民用运力管理不善,造成严重损失的;

   (八)不出具民用运力使用、损毁、伤亡情况证明,经有关主管机关指出拒不改正的;

   (九)滥用职权,侵犯和损害预征、被征民用运力的公民或组织合法权益的;

   (十)严重影响民用运力国防动员组织实施的其他行为。

第六章 

     第三十七条  本办法自201581起施行。

 

 

Measures of Jilin Province on the National Defense Mobilization of Civil Transport Resources

(Promulgated by the Decree No.251 of the People’s Government of Jilin Province on June 9, 2015)

 

 

Chapter I General Provisions

    Article 1 These Measures are formulated for the purpose of guaranteeing effective organization and implementation of national defense mobilization of civil transport resources in accordance with the National Defense Law of the People's Republic of China, Regulations on the National Defense Mobilization of Civil Transport Resources, and other relevant laws and regulations, and in the light of specific situations of this Province.

    Article 2 These Measures shall apply to the national defense mobilization of civil transport resources and other relevant activities in the administrative region of this Province.

    “National defense mobilization of civil transport resources” hereinafter means that, in case of war or under special circumstances in peacetime, the people’s government at the county level and upwards shall, in accordance with law, be entitled to organize and expropriate in a unified form civil vehicles and other relevant equipment, facilities and manpower owned or managed by government agencies, social organizations, enterprises, government-sponsored institutions and individual citizens (hereinafter referred to as entities and individuals).

    Article 3 The local national defense mobilization bodies at the county level and upwards shall be responsible for the national defense mobilization of civil transport resources within their own administrative regions. The national defense communications administration (including organs responsible for national defense communications) shall be responsible for the specific implementation of the national defense mobilization of civil transport resources across the country.

    The national economy mobilization bodies, civil armed forces mobilization bodies, the administrations of communications and transportation, public security, finance, civil affairs, postal, telecommunication, railway, airline, and other relevant departments and entities shall be responsible for the relevant national defense mobilization of civil transport resources in accordance with their respective responsibilities.

    Article 4 The national defense mobilization shall follow the principles of unified leadership, implementation by levels, overall consideration, and rational allocation.

    Article 5 Any entity or individual who owns or manages civil transport resources shall perform the obligation of national defense mobilization thereof.

    Those who suffer from direct property losses or personnel casualties because of performing the obligation of national defense mobilization of civil transport resources shall have the right to receive compensations and pensions in accordance with law.

    Article 6 The national and local emergency support fleet shall be the main guarantee and backbone for national defense mobilization of civil transport resources.

    Article 7 Any entity or individual who organizes the national defense mobilization of civil transport resources as well as any entity or individual whose civil transport resources are expropriated, shall strictly observe national provisions of security and confidentiality. Anyone is prohibited to illegally use, spread or issue the materials and information about national defense mobilization of civil transport resources.

    Article 8 The people’s government at the county level and upwards and national defense communications administration will commend and reward entities and individuals that make outstanding contributions to the national defense mobilization work, in accordance with the relevant provisions of the Province.

Chapter II The Preparation for the National Defense Mobilization of Civil Transport Resources

    Article 9 The provincial national defense communications administration shall, jointly with the provincial national economy mobilization body, the relevant departments of the provincial people’s government and military organs at the same level, work out a general plan for the implementation of the national defense demand on civil vehicles and other relevant equipment, in accordance with the planning and tasks of the State and Shenyang Military Area, and report the plan to the provincial national defense mobilization body for approval.

    The provincial national economy mobilization body shall, in accordance with the approved general plan, work out specific plans for the implementation of the national defense mobilization demand on newly-built civil vehicles and other relevant equipment, and shall organize to carry out such plans.

    Article 10 The relevant departments of the people’s governments at the county level and upwards shall give business guidance, the policy and technique support to entities and individuals that undertake the designing or building tasks of national defense demand on civil vehicles and other relevant equipment, and shall guarantee the effective implementation of the relevant national defense demand.

    The relevant entities and individuals shall design and construction the civil vehicles and other equipment in accordance with the relevant standards and technical specifications.

    Article 11 The administrations of communications and transportation, public security, postal, telecommunication and other relevant departments and entities at the county level and upwards shall, in accordance with the  registration requirements about the national defense mobilization preparation for civil transport resources, submit annually to the national defense communications administrations at the same level the relevant materials and condition descriptions about the civil transport resources registered last year before the end of each January.

    The municipal (prefecture) national defense communications administrations shall submit annually to the provincial national defense communications administration the relevant descriptions about the civil transport resources registered last year before the end of each February.

    The sectors in charge of national defense communication in railway and civil aviation departments shall submit annually to the provincial national defense communications administration the descriptions about the civil transport resources of corresponding industry in the Province last year before the end of each February.

    As for the relevant departments or entities fail to submit relevant materials and condition description in a timely manner, or submit relevant materials and condition description non-conforming to requirements, national defense communications administrations may require them to supplement or submit again, and such departments or entities shall comply with the requirements. 

    Article 12 The national defense communications administrations at province and city (prefecture) levels shall assort and coordinate the materials and condition descriptions about civil transport resources, keep them well in archival files, establish a database of civil transport resources, and update them in time.

    The database of civil transportation resources shall include the following contents: highway transportation resources, waterway transportation resources, railway transportation resources, aviation transportation resources, as well as relevant transportation resources of gas station, depot and yard, repair plant (station), and etc.

    Article 13 In accordance with the demands of national defense mobilization preparation for civil transport resources, the provincial national defense mobilization body may list the airport, stations, ports, wharfs, freight stations, logistics centers and other infrastructure as the base for national defense mobilization of civil transport resources. 

    Article 14 The provincial national defense communications administration shall formulate the national defense mobilization plan of civil transportation resources for the Province jointly with relevant provincial authorities and the military organ at the same level, and report to the provincial national defense mobilization body for approval and the national defense communications administration of Shenyang Military Area for record.

    The corresponding plan of the city (prefecture) or county (city) shall be formulated by the national defense communications administration at the same level, in accordance with requirements of the national defense mobilization plan of civil transportation resources at the higher level and in combination with the actual circumstance, approved by the national defense mobilization body at the same level, and then reported to the national defense transportation administration at the next higher level for record.

    The revision and regulation of the national defense mobilization plan of civil transportation resources shall be handled in accordance with the original formulation procedures and approval authority.

    Article 15 The national defense mobilization plan of civil transportation resources includes the following contents:

    (1) The task of national defense mobilization of civil transportation resources;

    (2) The division of responsibility of national defense communications administration, national economy mobilization body, and relevant departments and entities;

    (3) The specific procedures and requirements of national defense mobilization of civil transportation resources;

    (4) The retrofitting and modification plan of civil vehicles and relevant department to be expropriated;

    (5) The protective measures for national defense mobilization of civil transportation resources; and

    (6) Other related contents.

    Article 16 The national defense communications administration shall, in accordance with the requirements of national defense mobilization plan of civil transportation resources at corresponding level, organize the civil transportation resources to be expropriated into groups. The grouping shall maintain the complete organization system of entities whose civil transportation resources are expropriated as possible.

    Article 17 The national defense communications administration shall, formulate the five-year plan and annual plan of training on civil transport resources to be expropriated at corresponding level, and organize the implementation of military training, professional and technical training and comprehensive mobilization drills on civil transport resources to be expropriated, together with the people's armed forces mobilization agencies and military organizations, so as to check the readiness and efficiency, mobilization accumulation time, and changes of the civil transport resources to be expropriated, and promptly report to the national defense transportation administration at a higher level.

    Article 18 The civil transport resources may be expropriated for military training or maneuver, subject to the approval of the entities on the military area level and above.

    The expropriation of civil transport resources for the military trainings and maneuvers shall be reported to entities on the military area level and above in accordance with the procedures specified by the Central Military Committee for approval, and be organized the implementation thereof by the national defense communications administration in accordance with the preparative plan of the national defense mobilization of civil transport resources.

    Article 19 The entities and individuals that own or manage the civil transport resources to be expropriated shall establish the emergency mechanism for national defense mobilization of civil transport resources, ascertain the type and quantity of the civil vehicles and relevant equipment to be expropriated as well as the personnel responsible for the operation and guarantee work, and improve the guarantee capacity for national defense mobilization of civil transport resources. 

    Article 20 The entities and individuals that own or manage the civil transport resources to be expropriated shall report to the local national defense communications administration within 30 days under any of the following circumstances:

    (1) The renewal, modification, leasing, transfer or out-of-service of civil vehicles;

    (2) The critical diseases, disability or death of personnel to be expropriated;

    (3) The changer of vehicle operators;

    (4) The vehicle leaving this administrative region for more than 30 days;

    (5) The change of personnel correspondence; and

    (6) Other significant matters that shall be notified.

Chapter III The Implementation of National Defense Mobilization of Civil Transport Resources

    Article 21 The national defense communications administration shall, in accordance with the national defense mobilization tasks for civil transport resources arranged by administrations on the higher level, and the application of the entities that need to use these resources, start up and implement the preparative plan of national defense mobilization of civil transport resources without delay.

    The national defense communications administration shall, together with the people's armed force mobilization body at the same level, inform the entities and individuals whose civil transport resources are expropriated of the type and quantity of the expropriated civil vehicles and relevant equipment, the person who are responsible for the operation and guarantee work, as well as the time, venue and means of assembly of the civil transport resources.

    Article 22 The entities and individuals whose civil transport resources are expropriated must, as are notified, organize the expropriated civil transport resources and relevant personnel to reach the said venue within the specified time limit, and must guarantee that the technical and operational condition of the expropriated civil vehicles, and skills of the supply personnel meet the requirements for military activities.

    Any entity or individual whose civil transport resources are expropriated, failing to reach the said venue within the specified time limit, shall report immediately and implement the new command of the people's armed force mobilization body and entities that use the resources.

    Article 23 The people's armed forces mobilization body in the assembly venue of the expropriated civil transport resources shall, jointly with the national defense communications administration and other relevant departments, establish an effective and efficient headquarter, register the gathered civil transport resources and organize them into groups, check the preparation condition, arrange for necessary emergency trainings, and guarantee the in-time hand-over to entities that use the resources.

    Article 24 When the expropriated civil transport resources are handed over to entities that use the resources, national defense communication administrations and entities that use the resources shall check and sign the hand-over document, which states the groups of transportation resources, type of vehicles, technical conditions, information of expropriated personnel, and etc.

    The safety protection, logistic service and maintenance of expropriated civil transport resources shall be in the charge of commanding organ during the assembling, and of entities that use the resources after they are handed over. The people’s government where tasks are carried out shall give assistance to these works. 

    The commanding organ and entities that use the resources shall guarantee the safety of personnel, and protect the civil vehicles as well as relevant equipment and facilities against damaging.

    Article 25 If the expropriated civil vehicles and relevant equipment need to be reinforced or innovated, the national economy mobilization body shall, together with the national defense communications administration and the entity that use the resources, organize to deal with it in accordance with the reinforcement and innovation plan specified in the preparative plan of national defense mobilization of civil transport resources.

    As for the entities and individuals who undertake the reinforcement or innovation task of civil vehicles and relevant equipment shall strictly conform to the national safety technical standards and national defense requirements in their reinforcement or innovation work, and shall ensure that they are handed over for use within the specified time limit.

    Article 26 If it is necessary to use any of the ports, docks, airports, stations or other equipment, in accordance with Article 13 of these Measures, the national defense communications administration shall make a proposal, to which the relevant departments and entities shall give full support. The entities or individuals that own or manage the relevant facilities shall record the use conditions, and the entities that use the resources shall sign for confirmation.

    Article 27 Upon the approval of provincial people’s government, the provincial national defense communications administration shall, together with the public security organ and transportation administrative department of the Province, issue special transportation signs to the civil delivery means and their relevant equipment that carry out national defense mobilization tasks. 

    The civil vehicles and relevant equipment holding a special national defense transportation sign have priority to pass through when they are carrying out a task, and tolls for passing shall be exempted. After the tasks are completed, the national defense communications administration shall take back the special transportation sign timely.

    The special transportation sign shall be printed by the provincial national defense communications administration uniformly.

Chapter IV Compensation and Pension

    Article 28 As for the subsidy for loss of working time or original salary, bonuses, welfare and food subsidies in the entity during the training, as well as travel expenses and other expenses for the personnel participating in the training on civil transport resources to be expropriated, the relevant provisions of the State on military training shall be applied for the personnel incorporated into militia, or the relevant provisions of the State on military training shall be applied for the personnel not incorporated into militia. The compensations for expropriation of civil transportation resources by military training and exercises shall be settled by the form of leasing. The relevant provisions of the State shall apply for specific measures.

    Article 29 If any entity or individual who suffers any of the following direct property losses in performing the obligation of national defense mobilization of civil transport resources, the finance department shall give them appropriate compensations in accordance with relevant provisions of the State and Province:

    (1) The loss, damage or depreciation of civil vehicles and relevant equipment, as well as such facilities as ports, docks, airports, stations, etc.;

    (2) The wages or subsidy for persons who are responsible for the operation or supply of civil vehicles and relevant equipment, as well as facilities such as ports, docks, airports, stations, etc.; or

    (3) The irreparability of the original functions of refitted or modified civil vehicles and relevant equipment;

    (4) The fees for retrofitting and modification of civil vehicles and relevant equipment; and

    (5) Other direct property losses which shall be appropriately compensated.

    Article 30 Within 15 days after the national defense mobilization task for civil transport resources is finished, the entities that use the resources shall, together with the entities and individuals that own or manage the civil transport resources and national defense communications administrations, check and verify the losses and damages of the civil vehicles, relevant equipment and facilities, and the casualty of personnel who are responsible for the operation and guarantee work, and sign on the check list as confirmation. The entities that use the resources shall produce credentials for the civil transport resources use or damage and casualty truthfully.

    Where the check, confirmation or credential cannot be completed in due for special reasons, the term may be extended properly, but no longer than 30 days. Reasons shall be explained to the entities and individuals that own or manage the civil transport resources.

    Article 31 Any Entity or individual who owns or manages civil transport resources may apply for compensation to the local national defense communications administration upon strength of the credentials of use or damage produced by the entity that uses the resources.

    The local national defense communications administrations shall verify the application within 15 working days since the receipt, give opinions to the people's government at the same level, and organize the implementation upon approval. 

    Article 32 Any Entity or individual who owns or manages civil transport resources may apply for compensation and special treatment to the local civil administration departments upon strength of the credentials of casualty produced by the entity that uses the resources.

The measures and standards of the compensation and special treatment shall be implemented by the civil administration departments of the people's government at the county level and upwards subject to the Regulations for Serviceman on Compensations and Special Treatments as well as relevant provisions of the State and the Province.

    Article 33 Where the entities or individuals who have the legal right of enjoying compensation and special treatment for fulfilling the obligations of national defense mobilization of civil transportation resources, fail to enjoy or have disputes to these rights, they may apply for administrative reconsideration or file an administrative lawsuit in accordance with law.  

    Article 34 The people’s government at the county level and upwards shall incorporate the expenses for national defense mobilization of civil transportation resources at the corresponding level into local financial budget.

The expenses on national defense mobilization of civil transport resources shall be earmarked for its specified purpose only, which shall be subject to the supervision of financial and auditing departments.

Chapter V Legal Liabilities

    Article 35 Any act in violation of these Measures shall be punished by the relevant departments and organs in accordance with the National Defense Law of the People's Republic of China, Regulations on the National Defense Mobilization of Civil Transport Resources, and other relevant laws and regulations.

    Article 36 If anyone of the national defense communications administration, transportation, public security and other relevant departments is involved in any of the following activities, the relevant authority shall impose corresponding administrative sanction on the persons directly in charge and the other persons directly responsible; where a crime is constituted, the offender shall be investigated for the  criminal liabilities in accordance with law:

    (1) As for those refusing to execute the national defense mobilization orders given by the superior authorities;

    (2) To divulge any national defense mobilization secret or illegal using, spreading or issuing information and materials about national defense mobilization of civil transportation resources;

    (3) To embezzling or misappropriate the funds or materials for national defense mobilization, or use the funds for national defense mobilization of civil transportation resources without approval;

    (4) To Refuse to have the requisitioned civil resources registered, refuse to issue registration certificates, cause serious damage to requisitioned civil resources due to use in violation of the relevant rules, or fail to return requisitioned civil resources or make compensations as required;

    (5) To refuse or delay the submittal of materials and condition descriptions about civil transport resources without reason;

    (6) To overstep its authority and mobilize the civil transport resources without approval;

    (7) To fail to keep the expropriated civil transport resources in good condition and causing serious losses;

    (8) To fail to produce credentials for the civil transport resources use or damage and refusing to take remedial measures under the warn of relevant authority;

    (9) To abuse powers to infringe upon and damage the legitimate rights and interests of any citizen or organization whose civil transportation resources are expropriated; and

    (10) Other activities that seriously influence the organization and implementation of national defense mobilization of civil transportation resources.

Chapter VI Supplementary Provision

Article 37 These Measures shall become into effective as of the date of August 1, 2015.
