吉林省消防产品监督管理规定

第一章 总 则

  第一条 为了加强消防产品监督管理,提高消防产品质量,保护公民人身、财产安全,维护公共安全,根据《中华人民共和国消防法》、《中华人民共和国产品质量法》等法律、法规,结合本省实际,制定本规定。

  第二条 本省行政区域内消防产品的生产、销售、使用以及监督管理活动,适用本规定。

  本规定所称消防产品是指专门用于火灾预防、灭火救援和火灾防护、避难、逃生的产品。

  第三条 县级以上人民政府公安机关消防机构负责使用领域消防产品质量的监督管理。

  县级以上人民政府质量技术监督部门、工商行政管理部门按照各自职责对生产、流通领域的消防产品质量实施监督管理。

  第四条 各级人民政府应当采取措施,保障公安机关消防机构、质量技术监督部门、工商行政管理部门对消防产品实施监督管理。

  第五条 广播电台、电视台、报刊和互联网站等传播媒介应当宣传消防产品知识和有关消防产品监督管理的法律、法规,曝光消防产品在生产、销售、使用领域产生的违法行为。

第二章 质量责任

  第六条 消防产品的生产者应当对其生产的消防产品质量负责,建立有效的质量管理体系,保持消防产品的生产条件,保证产品质量、标志、标识符合相关法律、法规以及标准要求。不得生产应当获得而未获得市场准入资格的消防产品、不合格的消防产品或者国家明令淘汰的消防产品。

  消防产品的生产者应当建立销售流向登记制度,如实记录消防产品的名称、批次、规格、数量、销售去向等内容。

  第七条 消防产品的销售者应当建立并执行进货检查验收制度,验明产品合格证明和其他标识,不得销售应当获得而未获得市场准入资格的消防产品、不合格的消防产品或者国家明令淘汰的消防产品。

  消防产品的销售者应当建立并保存销售台账,保存期限为消防产品售出之日起2年。

  第八条 消防产品的生产者、销售者发现或者有事实证明其生产、销售的产品为不合格产品,应当立即停止生产、销售,已售出的应当主动召回,并如实记录产品召回及其处理情况。

  第九条 消防产品的使用者应当查验产品合格证明、产品标识和有关证书,选用符合市场准入的、合格的消防产品,并保存所使用产品的合格证明、有关证书和购买凭证等资料。

  机关、团体、企业、事业等单位应当按照国家标准、行业标准定期组织对消防设施、器材进行维修保养,确保完好有效。

  第十条 建设工程设计单位在工程设计中选用的消防产品,应当注明产品规格、性能等技术指标,其质量要求应当符合国家标准、行业标准。当需要选用尚未制定国家标准、行业标准的消防产品时,应当选用经技术鉴定合格的消防产品。

  第十一条 建设工程施工单位应当按照工程设计要求、施工技术标准、合同的约定和消防产品有关技术标准,对进入施工现场的消防产品进行现场检查或者检验,如实记录进货来源、名称、批次、规格、数量等内容;现场检查或者检验不合格的,不得安装。现场检查记录或者检验报告应当留存备查。

  第十二条 对《建设工程消防监督管理规定》(公安部令第119号)中确定的人员密集场所和其他特殊建设工程批量选用的消防产品,建设单位在安装、配置消防产品前,应当随机抽取样品并送具有法定资质的产品质量检验机构检验。送检消防产品经检验不合格的,建设单位应当更换为合格消防产品。监理单位应当对抽样过程进行监督。

  随机抽取样品的名称、批次、规格以及数量由省人民政府公安机关消防机构确定,向社会公布后实施。

  第十三条 具有法定资质的产品质量检验机构应当按照检验期限、程序等要求检验消防产品,并对出具的检验报告负责。

  第十四条 建设单位办理建设工程竣工验收消防备案或者申请建设工程消防验收时,应当按照《建设工程消防监督管理规定》的要求向公安机关消防机构提供消防产品质量合格证明文件。

  第十五条 建设工程监理单位应当依照法律、法规及有关技术标准、设计文件和建设工程承包合同对建设工程使用的消防产品质量及安装质量实施监督。

   第十六条 消防产品的维修单位应当具备国家或者行业规定的维修技术条件,遵守国家或者行业规定的维修技术规程。

  维修后的产品应当符合国家标准、行业标准的质量要求;无国家标准、行业标准的,应当符合保障人体健康和人身、财产安全的要求。

维修后的产品应当标示维修单位、日期、编号和有关技术参数等信息。

第三章 监督检查

  第十七条 公安机关消防机构、质量技术监督部门和工商行政管理部门应当依照政府信息公开有关规定,公布消防产品监督管理的条件、程序、期限、需要提交的材料目录、示范文本以及投诉方式等。

  第十八条 公安机关消防机构、质量技术监督部门和工商行政管理部门应当建立信息互通和执法联动机制,发现本部门监督管理职责以外的消防产品质量违法行为的,应当自违法行为发现之日起5日内将有关情况书面通报同级监督管理部门。接到通报的监督管理部门应当按照职责依法对消防产品质量违法行为进行查处,并自查处完毕之日起5日内向原通报部门反馈处理情况。

   第十九条 公安机关消防机构、质量技术监督部门和工商行政管理部门应当及时受理涉及消防产品质量违法行为的投诉,并自收到投诉之日起7日内予以处理并告知投诉人。

  第二十条 质量技术监督部门、工商行政管理部门发现并认定生产者、销售者提供的消防产品为不合格产品的,应当责令生产者、销售者立即停止生产、销售,并召回已售出的同批次消防产品。

  第二十一条 公安机关消防机构可以采用下列方式对使用领域的消防产品质量实施监督检查或者抽查:

  (一)进入单位、施工场所实施现场检查;

  (二)对待安装、使用的消防产品进行抽查;

  (三)对可能灭失或者以后难以取得的证据依法先行登记保存;

  (四)向消防产品生产者、销售者进行质量问询;

  (五)向有关人员调查、了解有关情况,查阅、复制有关材料;

  (六)核实消防产品的检验报告。

  公安机关消防机构实施消防产品监督检查、抽查,不得收取或者变相收取检查、抽查费用。

  第二十二条 公安机关消防机构实施消防产品质量监督抽查时,应当按照规定抽取样品,抽取的样品应当经生产者确认,生产者在5日内未确认的,公安机关消防机构可以通过查询消防产品信息管理系统、购买凭证等方式确认,经确认样品为该生产者产品的,在抽样单上注明确认情况后,送具有法定资质的产品质量检验机构检验。

   公安机关消防机构应当自收到检验结果之日起3日内,将检验结果告知被抽样人和生产者。

  第二十三条 公安机关消防机构应当建立消防产品质量信用档案,记录日常监督检查结果、违法行为查处等情况,对有不良信用记录的单位和产品进行重点检查,增加监督检查频次。

   第二十四条 公安机关消防机构、质量技术监督部门和工商行政管理部门应当及时向社会公布消防产品质量监督检查情况以及违法行为查处情况等信息。

第四章 法律责任

  第二十五条 人员密集场所使用不符合市场准入消防产品的,由公安机关消防机构责令限期改正;逾期不改正的,依照《中华人民共和国消防法》第六十五条第二款规定处罚。

   非人员密集场所使用不符合市场准入的消防产品、不合格的消防产品或者国家明令淘汰的消防产品的,由公安机关消防机构责令限期改正;逾期不改正的,对非经营性场所处500元以上1000元以下罚款,对经营性场所处5000元以上1万元以下罚款,并对直接负责的主管人员和其他直接责任人员处500元以下罚款。

   第二十六条 违反本规定,有下列行为之一的,由质量技术监督部门、工商行政管理部门按照各自职责依法处罚:

   (一)生产、销售不合格或者国家明令淘汰的消防产品的;

   (二)擅自生产、销售应当获得而未获得市场准入资格消防产品的;

   (三)在消防产品中掺杂、掺假,以假充真,以次充好,或以不合格消防产品冒充合格消防产品的;

   (四)伪造消防产品产地,冒用他人厂名、厂址,伪造或者冒用认证标志、质量标志的;

   (五)销售失效消防产品的。

  第二十七条 建设单位违反本规定第十二条,在安装、配置批量选用的消防产品前,未按照规定抽样送具有法定资质的产品质量检验机构检验,或者送检消防产品经检验不合格后未更换为合格消防产品的,由公安机关消防机构责令限期改正;逾期不改正的,处1万元以上3万元以下罚款。

   建设单位违反本规定第十四条,向公安机关消防机构提供虚假证明文件的,公安机关消防机构不予受理建设工程竣工验收消防备案或者建设工程消防验收,并予以警告。

   第二十八条 消防产品质量检验机构出具虚假文件的,按照《中华人民共和国消防法》的规定处罚。

   第二十九条 公安机关消防机构、质量技术监督部门和工商行政管理部门的工作人员,在消防产品监督管理工作中滥用职权、玩忽职守、徇私舞弊的,依法给予处分,构成犯罪的,依法追究刑事责任。

第五章 附 则

  第三十条 本规定自201581日起施行。

 

 

Provisions of Jilin Province on the Regulatory of

Fire Products


(Promulgated by Decree No. 250 of Jilin Provincial People’s Government

 on June 8, 2015)

 

Chapter General Provisions

 

Article 1 These Provisions are formulated for the purposes of strengthening the regulatory of fire products, improving the quality of fire products, protecting the citizens' personal and property safety, maintaining the public safety, in accordance with the Law of the People's Republic of China on Fire Services, the Law of the People's Republic of China on Product Quality and that laws and regulations, and in the light of the actual circumstances in this province.

Article 2 These Provisions shall apply to the production, sale, use, and supervisory activities of fire products within this administrative area.

The term “fire products” in these Provisions means the product specifically for fire prevention, fire fighting and rescue and fire protection, evacuation, escape.

    Article 3 The Public Security Fire agencies of the People's governments at the county level and upwards shall be responsible for the supervision and management on the quality of using fire product.

As for the quality and technology supervision department, the administrative department for industry and commerce of the people’s government at the county level and upwards, shall carry out the supervision and administration upon the quality of fire product of production and circulation in accordance with their duties.

Article 4 The people’s governments at all levels shall adopt the measures to ensure the implementation of the supervision and management from the public security fire control institutions, quality and technology supervision department, industry and commerce administrative departments.

Article 5 As for the media radio, television, newspapers and internet sites, etc., which they should propaganda the laws and regulations upon the fire product knowledge and related supervision and management of fire protection products, and to exposure the violations of the fire products in the field of production, sale and use.

 

Chapter Quality Responsibilities

 

Article 6 Fire protection products producer shall be responsible for the production of fire-fighting product quality, set up effective quality management system, maintain the production conditions of fire products, ensure the product quality, marks, logos to comply with the relevant laws, regulations and standards. Not to produce the fire protection products without the market access that should be obtained, and substandard fire protection products or obsolete products of fire.

The fire protection products producer shall establish the registration system for the sales flow, accurately record the fire product names, batch, size, quantity, destination marketing, etc.

Article 7 The fire products sellers shall establish and implement the incoming inspection and acceptance system, verify the product quality certificates and other marks, and may not sell the fire products without the market access qualifications which should be obtained, the substandard fire protection products or the obsolete fire products.

The fire products sellers shall establish and maintain sales ledger, the retention period shall be 2 years as of the date of sold.

Article 8 As for the producers, sellers found the substandard products, they should immediately stop the production and sales, the sold products should be voluntary recalled, and truthfully record the product recalls and handling circumstances.

Article 9 Fire products users should check the product quality certificates, product identification and related certificates, and choose the products in line with market access, qualified fire protection, and save the proof of qualified products, the relevant certificates and proof of purchase, etc.

Organs, organizations, enterprises, institutions shall, in accordance with the national standards, industry standards, regularly implement the maintenance for the fire-fighting equipment, to ensure the equipment good and effective.

Article 10 As for the fire products selected in the engineering design by the engineering units, which shall indicate the product specifications, performance and other technical indicators, their quality shall tally with the national standards, industry standards. Where needs to choose the fire products without any national standards, industry-standard, which shall choose the technology accredited fire products.

Article 11 The building construction unit shall, in accordance with the engineering design requirements, technical standards relating to technical standards, fire protection products and contract agreement, conduct the on-site inspection or test to the fire protection products, faithfully record the purchase source, name, batch, size, quantity, etc. As for those failing to pass the site inspection or unqualified, shall not be installed. The site inspection or inspection report shall be retained for future reference.

    Article 12 As for the fire products chose for the crowded places and other special construction batch selection, which are determined by the Administrative Regulations on Construction Fire Protection (Decree No. 119 of Ministry of Public Security), before the installation, product configuration, the random samples should be charged and sent to product quality inspection institutions legally qualified inspection. As for those which fail to pass the inspection, the construction unit should be replaced by qualified fire protection products. The supervision units shall supervise the sampling process.

As for the selected sample name, batch size and the number, shall be determined by the public security fire control institutions of the provincial people's government, and shall be implemented after the promulgation.

Article 13 As for the product quality inspection institutions with legal qualifications, shall test the fire products in accordance with test duration, procedures and other requirements, and be responsible for the issued inspection report.

Article 14 When the construction unit apply for the construction project completion acceptance record or construction fire inspection, they shall provide fire product quality certification documents to the fire control institutions of the public security in accordance with the Administrative Regulations on Construction Fire Protection.

Article 15 The construction supervision units shall supervise the quality of the fire products and the installation quality using by the construction projects in accordance with the laws, regulations and the relevant technical standards, design documents and construction contracts.

Article 16 The maintenance units of the fire products shall have the national service industry regulations or technical conditions, and comply with maintenance technical regulations of the country or industry regulations.

The repaired products shall meet the national quality standards, industry standards. As for those without any national standards, industry standards, shall comply with the requirements to protect human health and personal and property safety.

The repaired product shall be marked maintenance organization, date, number, and other information related to the technical parameters.

 

Chapter Supervision and Administration

 

Article 17 The fire control institutions of the public security, quality and technical supervision departments and industrial and commercial administrative departments should open the conditions, procedures and duration, list of materials to be submitted, normal text and complaints methods upon the supervision and management of the fire products in accordance with the relevant provisions of the government information disclosure.

Article 18 The fire control institutions of the public security, quality and technical supervision departments and industrial and commercial administrative departments shall establish the information exchange and law enforcement linkage mechanism, where there is the quality violations outside the supervision and administration of their departments, they shall bulletin the supervision and management departments at the same level in a written form, within 5 days as of the date of discovery of the offense. As for the supervisory and administrative departments receiving the notification shall investigate the fire product quality violations in accordance with the duties, and feedback the handling circumstances to the original communications departments within 5 days from the date of the completion of the investigation.

Article 19 The fire control institutions of the public security, quality and technical supervision departments and industrial and commercial administrative departments shall timely handle the complaints involving the violations of the quality of fire protection products, and dealt with and inform the complainant within 7days from the date of receipt of the complaint.

Article 20 As for those Producers, sellers provide fire protection products for substandard products, which are found and determined by the quality and technical supervision departments and industrial and commercial administrative departments, they shall be instructed to stop producing and selling, and recall the same batch of fire product sold.

Article 21 The fire department of public security organ may supervise and inspect or randomly check the quality of the fire protection products used in the field of application by the following means:

 (1) To enter the facility or construction site for on-site inspection;

 (2) Randomly to check the fire protection products to be installed or used;

 (3) To register and keep the evidence first in accordance with the law that may be lost or difficult to obtain later;

 (4) To conduct the quality inquiry to the fire product manufacturers and sellers;

 (5) To investigate and acquire the information from relevant personnel, accessing and copying relevant data; and

 (6) To verify the inspection report of fire protection products.

As for the firefighting department of public security organ shall not charge or collect fee in a disguised form for the supervision, inspection and random check of fire protection products.

Article 22 In the quality supervision and random checks of fire protection products, the firefighting department of public security organ shall take samples in accordance with the provisions. The samples shall be confirmed by the manufacturer, and if they are not confirmed within 5 days, the firefighting department of public security organ can confirm them by inquiring the fire protection products information management system, purchase vouchers, or other means. After the samples are confirmed the products of such manufacturer, they will be sent to a product quality inspection agency with legal qualifications for inspection, with all information indicated on the sampling sheet. 

The firefighting department of public security organ shall, within 3 days since the receipt of the inspection result, inform the sampled person and the manufacturer.

Article 23 The firefighting department of public security organ shall build a quality credit archives of fire protection products to record the daily supervision and inspection results, violations investigations and punishments, so as to highlight and increase the frequency of supervision and inspection on entities and products with bad credit records. 

Article 24 The firefighting department of public security organ, the quality and technology supervision department, and the administrative department for industry and commerce shall timely report to the public on the quality supervision and inspection of fire protection products, as well as information such as violations investigation and punishments.

 

Chapter IV Legal Liabilities

 

Article 25 Where any crowded place uses fire protection products non-conforming to the market access, the firefighting department of public security organ shall instruct to correct within the specified time limit; anyone who fails to correct within specified time limit shall be punished in accordance with Article 65(2) of Fire Prevention Law of The People's Republic of China.

Where any non-crowded place uses fire protection products non-conforming to the market access, unqualified or eliminated in accordance with State laws, the firefighting department of public security organ shall order to rectify within specified time limit; if no rectification is made within specified time limit, a fine of RMB 500 to 1,000 shall be imposed for non-operating place or RMB 5,000 to 10,000 for operating place, and the director directly in charge and other directly responsible person shall be imposed a fine of RMB500.

Article 26 If anyone in violation of these Regulations by conducting one of the following acts, the quality and technology supervision department, and the administrative department for industry and commerce shall give legal punishment in accordance with their respective duties: 

 (1) Manufacturing or selling fire protection products unqualified or eliminated according to State laws;

 (2) Manufacturing or selling fire protection products without market access where it is required;

(3) Mingling, adulterating, pass fake imitations for genuine, or imitating qualified fire protection products by unqualified products;

 (4) Counterfeiting the origin of fire protection products, using name and address of others, counterfeiting or using other’s certificate logo and quality logo; and

 (5) Selling expired fire protection products.

Article 27 Where any development entity, in violation of Article 12 herein, fails to send the samples as stipulated to legally qualified quality inspection institution before the installation and allocation of fire protection products in batches, or does not replace the unqualified products as inspected with qualified products, the firefighting department of public security organ shall instruct to correct within specified time limit; if no rectification is made within specified time limit, a fine of RMB 10,000 to 30,000 shall be imposed.

Where any development entity, in violation of Article 12 herein, provides false certificates to the firefighting department of public security organ, the firefighting department of public security organ shall not accept the fire protection recording for completion acceptance of construction projects or the fire control acceptance of construction projects, and give warnings to the violator.

Article 28 Any quality inspection institution of fire protection products who issues false document shall be punished in accordance with the provisions of Fire Prevention Law of The People's Republic of China.

Article 29 Where any functionary in the firefighting department of public security organ, the quality and technology supervision department, and the administrative department for industry and commerce neglects his duties, abuses his powers, or seeks private benefits in the supervision and administration of fire protection products, he shall be given an administrative sanction; if any crime is constituted, he shall be subject to criminal liabilities.

 

Chapter V Supplementary Provision

 

Article 30 These Regulations shall become into effective as of the date of August 1, 2015.
