吉林省矿产资源开发利用保护条例

    第一条 为了合理开发利用和有效保护矿产资源,保护矿山生态环境,促进经济和社会的可持续发展,根据《中华人民共和国矿产资源法》等有关法律、法规,结合本省实际,制定本条例。

    第二条 在本省行政区域内从事矿产资源开发利用与保护和监督管理活动,必须遵守本条例。

    第三条 矿产资源实行统一规划、合理开发、综合利用,坚持在保护中开发,在开发中保护的原则。

    第四条 县级以上人民政府应当加强矿产资源的开发利用与保护,并将矿产资源规划纳入本行政区域的国民经济和社会发展规划。

    第五条 各级人民政府应当鼓励矿产资源开发利用与保护的科学技术研究,推广应用新技术、新工艺进行采矿、选矿、冶炼以及尾矿和资源二次利用,提高矿产资源综合利用率。

    第六条 县级以上人民政府地质矿产主管部门负责本行政区域内矿产资源开发利用与保护的监督管理工作。其他有关部门应当按照各自职责,协助同级地质矿产主管部门做好矿产资源开发利用与保护的监督管理工作。

    第七条 矿产资源的开发利用实行规划管理。

    矿产资源规划包括总体规划和专项规划。法律规定应当编制行业规划的,按照法律规定编制,并纳入省矿产资源总体规划。

    编制矿产资源规划应当综合考虑经济效益、社会效益、生态效益,正确处理矿产资源开发利用与其他自然资源利用和生态环境保护的关系。

    第八条 省、市(州)人民政府地质矿产主管部门应当根据上一级矿产资源规划组织编制本行政区域内的矿产资源总体规划,经本级人民政府同意,报上一级人民政府地质矿产主管部门批准后实施。

    省、市(州)人民政府地质矿产主管部门应当根据本行政区域矿产资源总体规划,组织编制矿产资源开发利用与保护和矿山生态环境保护等专项规划,报上一级人民政府地质矿产主管部门批准后实施。

    县(市、区)人民政府地质矿产主管部门根据需要,可以编制本行政区域的矿产资源总体规划和专项规划,经本级人民政府同意,逐级上报省人民政府地质矿产主管部门批准后实施。

    对国民经济具有重要价值的矿种和优势矿产,省专项规划应当作出保护性或者限制性开采的规定。

    重要的矿泉水产地,经省人民政府批准设立保护区,并做好专项规划。

    第九条 矿产资源规划经批准后,必须严格执行,不得擅自变更;确需变更的,应当依照原批准程序办理。

    第十条 除经国务院授权的有关主管部门同意的地区以外,非经省人民政府同意,不得在居民生活聚集区、校园、生活饮用水源保护区、高压供电网线一定距离以内开采矿产资源。

    第十一条 采矿权申请人必须向地质矿产主管部门提交矿产资源开发利用方案。

矿产资源开发利用方案应当包括资源储量情况、开采布局、开采方案、选矿方案和矿山生态环境保护措施及其费用等内容。

    采矿权人必须按照矿产资源开发利用方案进行开采,不得擅自改变矿产资源开发利用方案;确需改变的,须经原审查机关同意。

    第十二条 矿山开采规模应当与矿床储量规模相适应。禁止大矿小开、同一矿床多家开采。

    第十三条 采矿权人应当建立健全地质测量规章制度,配备地质、测量、采矿安全等专业技术人员,加强矿产资源开采的技术管理。

开采普通建筑材料的砂、石、粘土的,不适用前款规定。

    第十四条 采矿权人应当遵守下列规定:

   (一)不得擅自改变矿床开拓方式和开采方法;

   (二)地下开采和中型以上露天开采的矿山,应当及时测绘采掘工程进度图以及井上、井下采掘工程对照图、采剥工程平面图等;

   (三)选择合理的开采顺序、方法和选矿工艺;

   (四)实际生产中的开采回采率、采矿贫化率和选矿回收率,达到开发利用方案中设定的技术指标和设计要求;

   (五)建立健全月、季、年度开采量、损失量、增减储量及保有储量台账制度;

   (六)在开采主矿种的同时,综合回收具有工业价值的共生或者伴生矿产;暂时不能综合回收的矿产、滞销矿石、粉矿、尾矿、废石、煤矸石必须采取有效保护或者处理措施。

    第十五条 矿山需要闭坑的,大型矿山应当提前十二个月,中型矿山应当提前六个月,小型矿山应当提前三个月,由采矿权人向原登记机关提出闭坑申请,并履行下列义务:

   (一)开采范围内的矿产资源确已查明,并保证届时按照矿产资源开发利用方案开采完毕;

   (二)地质、测量、采矿等相关资料整理完备,并报有关部门备案;

   (三)按照规定完成矿山生态环境恢复治理工作;

   (四)编制闭坑报告,闭坑报告包括矿产资源开发利用总结报告以及矿山生态环境恢复治理情况报告;

   (五)其他法定义务。

    第十六条 县级以上人民政府地质矿产主管部门在接到采矿权人提交的闭坑报告后,按照大型矿山在六个月内、中型矿山在三个月内、小型矿山在一个月内的时限,组织有关部门对闭坑报告进行审查和现场检查验收。检查验收合格的,依法办理采矿许可证注销手续。

    第十七条 开采矿产资源实行矿山生态环境恢复治理备用金制度,具体办法由省人民政府另行制定。

    第十八条 采矿权人自取得采矿许可证之日起,储量规模为中型的在二年内,小型以下的在一年内,应当进行生产或者按照设计工期进行开工建设;逾期未进行生产或者开工建设的,其采矿许可证失效。因自然灾害等特殊原因需要延期的,应当经原登记机关同意。

    第十九条 矿产资源开发利用与保护实行矿产督察员制度。   

    省人民政府地质矿产主管部门根据工作需要,可以向矿山企业派遣矿产督察员,也可以聘任兼职矿产督察员,监督检查采矿权人开发利用与保护矿产资源和矿山生态环境保护及恢复治理情况。

    第二十条 对未取得采矿许可证开采矿产资源的,由县级以上人民政府地质矿产主管部门责令停止开采,没收违法所得,并处以违法所得10%以上50%以下的罚款;造成矿产资源破坏,构成犯罪的,依法追究刑事责任。

    第二十一条 违反本条例第十四条(一)、(三)、(四)、(六)项规定,采取破坏性开采方法开采矿产资源的,由县级以上人民政府地质矿产主管部门责令改正,并处以相当于矿产资源损失价值10%以上50%以下的罚款;违反(一)、(三)项规定,情节严重的,可以吊销其采矿许可证。

    第二十二条 县级以上人民政府地质矿产主管部门工作人员玩忽职守、滥用职权、徇私舞弊的,依法给予行政处分;构成犯罪的,依法追究刑事责任。

    第二十三条 本条例自200411施行。

 

 

 

Regulations of Jilin Province on the Development and Utilization, Protection of Mineral Resources

 

(Adopted at the 5th Session of the Standing Committee

of the 10th Jilin Provincial People's Congress on September 27, 2003; and revised according to the Decisions of the Standing Committee of Jilin Provincial People’s Congress upon the Abolishment and Revision of Some Local Regulations at the 32th Session of the Standing Committee of the 11th People’s Congress of Jilin Province on May 30, 2012; and revised according to the Decisions of the Standing Committee of Jilin Provincial People’s Congress upon the Revision of the Regulation of Jilin Province on Land Administration and 7 Local Regulations at the 21th Session of the Standing Committee of the 12th People’s Congress of Jilin Province on November 20, 2015 )

 

  Article 1. These Regulations are formulated for the purposes of reasonably developing, utilizing and effectively protecting the mineral resources, protecting the ecological environment of mines, promoting the sustainable development of economy and society, in accordance with the Mineral Resources Law of the People's Republic of China and the related laws and regulations and in the light of the actual circumstances of this province.

  Article 2. These Regulations must be obeyed when the activities of development, utilization, protection, supervision and administration of mineral resources are participated within the administrative division of this province.

  Article 3. Unified planning, reasonable development and comprehensive utilization shall be practiced in mineral resources and the principle of developing in protection and protecting in development shall be insisted on.

  Article 4. The people's governments at the county level and upwards shall strengthen the development, utilization and protection of mineral resources and the plans for mineral resources shall be brought into the planning for the national economy and social development within their own administrative divisions.

  Article 5. The people's governments at all levels should encourage the scientific and technological studies on the development, utilization and protection of mineral resources, promote to apply new techniques, new crafts on mining, mineral separation, smelting, the second utilization of gangue and resources, so as to improve the comprehensive utilization rate of mineral resources.

  Article 6. The competent departments of geology and mines of the people's governments at the county level and upwards shall be responsible for the supervisory and administrative work of development, utilization and protection of the mineral resources within their own administrative divisions. Other related departments should assist the competent department of geology and mine at the same level to make a good job of supervision and administration on the development, utilization and protection of mineral resources according to their respective duties.

  Article 7. A plan for administration shall be practiced in the development and utilization of mineral resources. The plan for mineral resources shall include an overall plan and a special plan. As for those of which the plans for different trades should be draw up stipulated by law, they should be drawn up in accordance with the provisions of laws and should be brought into the overall planning for the provincial mineral resources.

  In drawing up the mineral resources plans, a comprehensive consideration on economic benefits, society benefits and ecological benefit should be made, the relations between the development and utilization of mineral resources, the utilization of other natural resources and the ecological environmental protection should be dealt with properly.

  Article 8. The competent departments of geology and mines of the provincial, municipal (prefectural) people's governments should organize to draw up the overall plans for the mineral resources within their own administrative divisions in accordance with the mineral resources planning at their higher leveland shall report it, with the approval of the people's government at the same level to the competent department of geology and mines of the people's government at their higher level for ratification and implementation.

  The competent departments of geology and mines of the provincial, municipal (prefectural) people's governments should organize to draw up the special planning for the development, utilization and protection of mineral resources and for the protection of mine ecological environment's protection according to the overall plans for the mineral resources within their own administrative divisions, and should report them to the competent departments of geology and mines of the people's governments at their higher level for ratification and implementation.

  The competent departments of geology and mines of the county (city, district) people's governments may draw up the overall planning and special planning for the mineral resources within their own administrative divisions according to necessity, and then report them to the competent department of geology and mines of the provincial people's government level by level for ratification and implementation with the approval of the people's governments at the same levels.

  As for the mineral kinds and superior mines of important value for national economy, the provisions of protection or restricted mining shall be stipulated in the provincial special planning.

  As for important mineral water areas, the protective areas shall be established with the ratification of the provincial people's government and a special planning shall be well made.

  Article 9. After being ratified, the mineral resource planning must be strictly performed, and shall not be allowed to change without authorization; when a change is really needed, it should be handled according to the original ratification procedures.

  Article 10. Except for the areas approved by the related competent departments authorized by the State Council, it shall not be allowed, without the approval of the provincial people's government, to mine mineral resources fences and in the settlements of inhabitants, campus, the protective areas of the sources of domestic and drinking water and within a fixed distance of high voltage charging wires.

  Article 11. The applicants of the right of mining must turn in a program of development and utilization of mineral resources to the competent department of geology and mining.

  The program for the development and utilization of mineral resources should include such contents as the situation of resource reserves, mining arrangement, mining scheme, mineral separation scheme, the mine ecological environment protective measures and the costs.

  The persons with the right of mining must mine in accordance with the development-utilization program for mineral resources, they shall not be allowed to change the development-utilization program for the mineral resources without authorization; when a change is really needed, it shall be approved by the original examination organ.    

  Article 12. The mining scale shall be corresponding with the mineral deposit reserving scale. It shall be forbidden to less mining in big mines and to be mined by several proprietors in the same mineral deposit.

  Article 13. The persons with the right of mining should establish and perfect the rules and systems of geology survey, fit out the special technological personnel of geology, survey, mining and security, and strengthen the technological administration on the exploitation of mineral resources.

  Those exploiting common construction materials such as sand, stone and clay shall not apply to the provision of former item.

  Article 14. The person with the right of mining should obey the following regulations:

      (1) It shall not be allowed to change the explore and mining methods of mineral deposit without authorization; 

      (2)As for the mines explored underground and the medium-sized opencast working mines, the maps of the rate of progress of excavating projects, the comparative maps of surface and underground excavating projects and the ichnographies of mining projects should be timely drawn up; 

      (3)To choose reasonable mining orders, methods and mineral separation technology;

      (4)The rate of mining recovery, the rate of mining dilution and the rate of recovery of mineral separation in practical production shall reach to the technological indexes and designing requirements supposed in their development and utilization schemes;

      (5)To establish and perfect the system of taking accounts on monthly, quarterly and yearly mined yields, the loss sum, the deposition sum of increase and decrease and the ensured deposition; and

      (6)While the major mineral kinds are explored, the symbiotic or associated mineral products of industrial value shall be comprehensively recovered; as for the mineral products, unsalable ores, fine ores, gangue, mullock and breeze which can't be comprehensively recovered for the time being, effective protection or disposal measures must be taken. 

  Article 15. As for the mines needed to be closed, the persons with the right of mining should make an application of closing pits to their original registration organs, the large-sized mines should be 12 months beforehand, the medium-sized ones should be 6 months beforehand and the small-sized ones should be 3 months beforehand, and should perform the following obligations:

      (1)The mineral resources within the exploitation scope have been found out, and ensure to finish the mining according to the development and utilization programs for mineral resources within at the appointed time;

      (2)The related materials such as geology, survey and mining have been reorganized and packed up and shall be reported to the related department for record;

      (3)The mineral ecological environment has been finished restoration and under control according to regulations;

      (4)To work out a pit-closing report, it shall include the summarized report on the development and utilization of mineral resources and the report on the restoration and control of the mineral environment; and

      (5)Other legal obligations;

  Article 16. After receiving the pit-closing report submitted by the persons with the right of mining, according to the time limit that for large-size mines within six months, for medium-sized mines within three months, for small-sized mines within one month, the competent departments of geology and minerals of the people's governments at the county level and upwards shall organize the related departments to make an examination on the pit-closing report, check and accept at the spot. Whichever have been checked and accepted to be eligible, they shall be transacted the nullification procedure of their mining permits in accordance with law.  

  Article 17. A reserve fund system of restoration and control of mineral ecological environment shall be practiced in exploiting mineral resource, the concrete measures shall be formulated separately by the provincial people's government.  

  Article 18. The persons with the right of mining should begin to mine or start to construct according to the designed time limit for a project, within 2 years for medium-sized deposition and within 1 year for small-sized deposition and downwards since they receive the mining permit; those fail to begin to mine or start to construct, their mining permits shall be invalid. Whichever need to postpone because of special reasons such as natural disasters etc, they should be approved by their original registration organs.  

  Article 19. The system of mineral supervisors shall be carried out in the development, utilization and protection of mineral resources.

  The competent department of geology and minerals of the provincial people's government may send mineral supervisors to mining enterprises in accordance with the requirement of performance, and also may employ part-time mineral supervisors, to supervise and examine the persons who have the right of mining on the situations of the development, utilization and protection of mineral resources and the mine ecological environmental protection, the restoration and control. 

  Article 20. As for those failing to get the mining permit but mining mineral resources, they shall be ordered to stop mining by the competent department of geology and minerals of the people's governments at the county level and upwards, their illegal incomes shall be confiscated and a fine of 10% to 50% of the illegal incomes maybe imposed; as for those refusing to stop mining, their pitheads should be closed by force by the competent departments of geology and minerals of the people's governments at the county level and upwards together with the related departments, the equipments and tools shall be also sealed up; as for those destroying mineral resources and a crime is constituted, the criminal liability shall be investigated in accordance with law.    

Article 21. As for those in violation of the provisions of Items (1),(3),(4),(6) of Article 14 of these Regulations, and making use of destructive mining methods to mine mineral resources, they shall be instructed to correct by the competent developments of geology and minerals of the people's governments at the county level and upwards, and a fine of 10%  to  50% of the losses of mineral resources shall be imposed at the same time; as for those in violation of the provisions of Items 1,3, where the circumstance is serious, their mining permits may be withdrawn.

Article 22. Where the working staff of the competent departments of geology and minerals of the people's governments at the county level and upwards neglect their duties, abuse their powers, engage in malpractice for selfish ends, an administrative sanction shall be given; where a crime is constituted, the criminal liability shall be investigated for in accordance with law.   

  Article 23. These Regulations shall become into effective as of the date of January 1, 2004.
