吉林省饮用天然矿泉水资源开发保护条例

 

 

  (2007年1月12吉林省第十届人民代表大会常务委员会第三十二次会议通过 根据2012530吉林省第十一届人民代表大会常务委员会第三十二次会议通过的《吉林省人民代表大会常务委员会关于修改部分地方性法规的决定》修改根据20151120吉林省第十二届人民代表大会常务委员会第二十一次会议《吉林省人民代表大会常务委员会关于修改〈吉林省土地管理条例〉等7件地方性法规的决定》修正)

   

  第一条 为了加强饮用天然矿泉水(以下简称矿泉水)资源的开发、保护和管理,根据《中华人民共和国矿产资源法》及其他有关法律、法规的规定,结合本省实际,制定本条例。

  第二条 凡在本省行政区域内从事矿泉水勘查评价、鉴定、开采、保护的单位和个人,均须遵守本条例。

  第三条 本条例所称矿泉水是指从地下深处自然涌出或者经人工揭露的、未受污染,含有一定量的矿物盐、微量元素或者二氧化碳的地下矿水。

  第四条 矿泉水资源属于国家所有,任何单位和个人不得以任何形式侵占、破坏或者污染。

  第五条 对矿泉水资源实行统一规划、合理开发、有效保护的原则。

  第六条 矿泉水水源所在地的各级人民政府应当加强对矿泉水资源开发和保护的监督管理。

  第七条 县级以上人民政府地质矿产行政主管部门负责本行政区域内矿泉水资源开发和保护的监督管理工作。

  县级以上人民政府水利、环境保护、林业、卫生、质量技术监督等行政管理部门按照各自的职责,做好矿泉水资源开发和保护的监督管理工作。

  第八条 省人民政府地质矿产行政主管部门会同有关部门编制全省矿泉水资源勘查开发保护规划,在征得省水利和环境保护行政管理部门同意后,报省人民政府批准实施。

  第九条 勘查评价矿泉水资源的单位必须依法取得勘查许可证。

  第十条 矿泉水勘查单位对矿泉水资源的勘查评价,应当按照《饮用天然矿泉水国家标准》和有关勘查规范进行。

  第十一条 矿泉水水源水质检验单位应当具有计量认证合格证。矿泉水水源微生物指标检验按照《中华人民共和国食品卫生法》相关规定执行。

  第十二条 矿泉水水源样品采集、保存、送检以及测试,应当执行国家饮用天然矿泉水检验方法的规定。

  第十三条 鉴定矿泉水,应当由省人民政府地质矿产行政主管部门自受理之日起30日内组织专家鉴定委员会鉴定,并由专家鉴定委员会出具鉴定意见。

  专家鉴定委员会由地质矿产、水利、卫生计生、质量技术监督、环境保护等方面的专家组成。

  第十四条 申请矿泉水鉴定应当提交以下资料:

  (一)矿泉水勘查许可证;

  (二)矿泉水勘查评价报告;

  (三)水质检验原始报告;

  (四)抽水试验原始资料;

  (五)动态监测原始资料。

  第十五条 矿泉水鉴定证书是开发矿泉水资源的主要依据。未取得矿泉水鉴定证书的,不得以矿泉水的名称进行开发。

  第十六条 开采经鉴定的矿泉水资源,必须依法向省人民政府地质矿产行政主管部门申请采矿登记,取得采矿许可证后,方可投入生产。

  第十七条 经鉴定的矿泉水水源不得生产纯净水等非矿泉水饮品。

  第十八条 矿泉水产品标识标注的化学成分及含量等内容,应当与鉴定证书内容一致。

  第十九条 开发矿泉水资源的采矿权人,应当按照采矿许可证确定的开采量和范围开采。禁止超量开采或者超范围开采。

  第二十条 开采矿泉水应当在水源地就近引流灌装,不得以任何方式运输至异地灌装。

  第二十一条 开采矿泉水的采矿权人,应当对其开采的矿泉水井(泉)进行动态监测并建立监测档案。每隔15日进行一次水量、水温、水位监测,每隔6个月将监测数据报当地地质矿产行政主管部门备案。

  第二十二条 对已开发的矿泉水水源,由县级以上人民政府地质矿产行政主管部门负责对其水质水量、资源保护和地质环境状况等进行监督管理。开发矿泉水水源的采矿权人,应当如实报告有关情况并提交年度报告。

  第二十三条 因污染致使矿泉水水源水质发生改变并不符合《饮用天然矿泉水国家标准》,治理后经鉴定仍未达到标准的,省人民政府地质矿产行政主管部门应当注销鉴定证书和采矿许可证。

  第二十四条 矿泉水水源集中分布区域或者重要的矿泉水水源地,应当设立矿泉水水源保护区,矿泉水水源保护区管理机构负责保护区的各项管理工作。  矿泉水水源保护区管理办法由省人民政府另行制定。

  第二十五条 矿泉水水源保护区的建设,应当纳入矿泉水资源勘查开发保护规划,保证保护区的建设和资金等保障措施的落实。

  第二十六条 在矿泉水水源保护区内,应采取有效措施,防止水土流失,保护植被,涵养水源。

  第二十七条 禁止在矿泉水水源保护区内从事旅游及其他可能导致矿泉水水源污染的活动。

  第二十八条 在已开发的矿泉水水源地,采矿权人应当设立卫生防护区。卫生防护区的设置、范围和要求应当符合《饮用天然矿泉水国家标准》。

  第二十九条 违反本本条例四条规定,采用破坏性开采方法开采矿泉水资源的,由县级以上人民政府地质矿产行政主管部门责令其改正;逾期未改正的,没收违法所得,并处以5万元以上8万元以下罚款;造成矿泉水资源严重破坏的,由原发证机关吊销采矿许可证,并处以相当于矿泉水资源损失价值10%以上50%以下罚款。

  第三十条 违反本条例第九条规定,未取得勘查许可证擅自从事矿泉水勘查的,由县级以上人民政府地质矿产行政主管部门责令其停止违法行为,予以警告,可以并处以5万元以上10万元以下罚款。

  第三十一条 违反本条例第十六条规定,未取得采矿许可证进行矿泉水开发的,由县级以上人民政府地质矿产行政主管部门责令其停止违法行为,没收违法所得,并处以5万元以上8万元以下罚款;给国家、集体和他人造成损失的应当依法赔偿。

  第三十二条 违反本条例第十七条规定,用经鉴定的矿泉水水源生产纯净水等非矿泉水饮品的,由县级以上人民政府地质矿产行政主管部门责令其限期改正;逾期未改正的,会同有关部门查封生产设备和工具。

  第三十三条 违反本条例第十九条规定,超量开采或者超范围开采的,由县级以上人民政府地质矿产行政主管部门责令其停止违法行为,没收违法所得,并处以3万元以上5万元以下罚款;情节严重的,由原发证机关吊销采矿许可证。

  第三十四条 违反本条例第二十二条规定,开发矿泉水资源的采矿权人不按规定提交年度报告、拒绝接受监督检查、弄虚作假的,由县级以上地质矿产行政主管部门责令其停止违法行为,予以警告,并处以3万元以上5万元以下罚款;情节严重的,由原发证机关吊销采矿许可证。

  第三十五条 违反本条例第二十八条规定,未按要求设立卫生防护区的,由县级以上人民政府地质矿产行政主管部门责令其限期改正;逾期未改正的,责令停止生产。

  第三十六条 负责矿泉水资源开发和保护监督管理工作的地质矿产行政主管部门工作人员和其他有关工作人员徇私舞弊、滥用职权、玩忽职守的,由其所在单位、上级机关或者有关主管部门给予行政处分;构成犯罪的,由司法机关依法追究其刑事责任。

  第三十七条 本条例自200731日起施行。

 

 

 

Regulations of Jilin Province on Development and Protection of Drinking Natural Mineral Water Resources

 

(Adopted at the 32nd Meeting of Standing Committee of the 10th People’s Congress of Jilin Province on January 12, 2007; revised in accordance with the “Decisions of Committee of the People’s Congress of Jilin Province on Revising Some Local Regulations” adopted at the 32nd Meeting of the Eleventh Standing Committee of the People’s Congress of Jilin Province on May 30, 2012; revised in accordance with the “Decisions of Standing Committee of People’s Congress of Jilin Province for Revising Seven Local Regulations including Land Administration Regulations of Jilin Province” at the 21st Meeting of the Standing Committee of the 12th People’s Congress of Jilin Province on November 20, 2015)

 

Article 1 These Regulations are formulated for the purpose of strengthening the development, protecting and administration on drinking natural mineral water (hereinafter referred to as the mineral water) resources, in accordance with Mineral Resources Law of the People's Republic of China, relevant laws and regulations, and in the light of specific situations of this Province,.

Article 2 All the entities and individuals engaged in investigation, evaluation, appraisal, exploration and protection of mineral water in administrative region of this Province shall observe these Regulations.

Article 3 Mineral water as mentioned herein refers to the unpolluted underground mine water containing  a certain amount of mineral salts, trace elements or carbon dioxide, which gushes from the depths of the earth or by artificial disclosure.

Article 4 The mineral water resources belong to the State. Any entity or individual shall not occupy, damage or pollute such resources by any means.

Article 5 The principles of unified planning, rational development and effective protection shall applied to mineral water resources.

Article 6 The people’s government at all levels where mineral water sources are located shall strengthen the administration and supervision on development and protection of mineral water resources.

Article 7 The administrative departments of geology and mineral resources of the people’s government at the county level and upwards shall be responsible for the supervision and administration on development and protection of mineral water resources in their respective administrative regions.

The administrative departments of water conservancy, environmental protection, forestry, sanitary, quality and technology supervision and other departments of the people’s government at the county level and upwards shall do a good job of supervision and administration on development and protection of mineral water resources in accordance with their respective duties.

Article 8 The administrative department of geology and mineral resources under the provincial people’s government shall, together with relevant departments, prepare the exploration, development and protection plan of mineral water resources in the whole Province, which shall be approved by the provincial people’s government for implementation, upon the approval of the provincial administrative departments of water conservancy and environmental protection.

Article 9 The entity engaged in exploring and evaluating mineral water resources must obtain the exploration license in accordance with law.

Article 10 The entity of exploring mineral water shall carry out exploration and evaluation of mineral water resources in accordance with the National Standard for Drinking Natural Mineral Water and relevant exploration codes.

Article 11 The water quality inspection entity for mineral water source shall have the certificate of measurement certification. The relevant provisions in Food Hygiene Law of the People's Republic of China shall apply for the inspection of microbiological composition in mineral water source.

Article 12 The sampling, saving, delivery and testing of mineral water source sample shall observe the provisions of the State for inspection methods of drinking natural mineral water.

Article 13 The appraisal of mineral water shall be conducted by experts appraisal committee of the organization of administrative department of geology and mineral resources under the provincial people’s government within 30 days since the acceptance, and the experts appraisal committee shall issue appraisal opinions.

The experts appraisal committee is composed by the experts from geology and mineral resources, water conservancy, health and family planning, quality and technology supervision, environmental protection and other relevant aspects.

Article 14 The following materials shall be submitted in case of applying for appraisal of mineral water: 

(1) The exploration license of mineral water:

(2) The evaluation report on exploration of mineral water;

(3) The primary report of water quality inspection;

(4) The primary data of water pumping test; and

(5) The primary data of dynamic monitoring.

Article 15 The appraisal certificate of mineral water is the basis for development of mineral water resources. The development in name of mineral water shall be prohibited without the appraisal certificate of mineral water.

Article 16 Any entity or individual engaged in the exploration of appraised mineral water resources must apply for mining registration to the administrative department of geology and mineral resources of the provincial people’s government in accordance with law, and put into the production after obtaining the mining license.

Article 17 The appraised mineral water source shall not be used for production of purified water or other non-mineral water drinks.

Article 18 The chemical ingredients, contents and others indicated on the mineral water products must be consistent with the appraisal certificate.

Article 19 The mining-right owner for development of mineral water resources shall conduct mining in accordance with the quantity and scope as determined in the mining license. Excess or over-scope mining shall be prohibited.

Article 20 In exploitation, the mineral water shall be diverted for filling nearby the water source, instead of being transported to other places for filling by any means.

Article 21 The mining-right owner for exploitation of the mineral water shall carry out dynamic monitoring and establish monitoring files for the exploited mineral water well (spring). Monitoring on water quantity, temperature and level shall be done every 15 days. The monitoring data shall be reported to the local administrative department of geology and mineral resources for record every 6 months.

Article 22 As for the mineral water source that has been exploited, the administrative department of geology and mineral resources of the people’s government at the county level and upwards shall be responsible for the supervision and administration on its water quality, quantity, resources protection and geological environment and conditions. The mining-right owner for exploitation of the mineral water shall truthfully report the situation and submit annual report.

Article 23 Where the water quality changes due to pollution and fails to comply with the National Standard for Drinking Natural Mineral Water in the mineral water source, and it still fails to reach the standard after treatment, the administrative department of geology and mineral resources of the provincial people’s government shall cancel the appraisal certificate and mining license.

Article 24 Mineral water source protected areas shall be set up in the areas where mineral water sources are concentrated or important mineral water source. The mineral water source protected area administration shall be responsible for the administration of protected areas.

The measures for the administration of mineral water source protected areas shall be formulated separately by the provincial people's government.

Article 25 The construction of mineral water source protected areas shall be incorporated into the exploration, development and protection planning of mineral water resources, so as to guarantee the construction of protected areas and implementation of funds and other security measures.

Article 26  The effective measures shall be carried out in the mineral water source protected areas to prevent soil erosion, protect vegetation, and conserve water.

Article 27 The tourism or other activities that may cause pollution to the mineral water source shall be prohibited in mineral water source protected areas.

Article 28 The mining-right owner for mineral water source that has been exploited shall set up sanitary protected area. The arrangement, scope and requirements of sanitary protected area shall comply with the National Standard for Drinking Natural Mineral Water.

Article 29 In violation of Article 4 of these Regulations, exploiting mineral water resources with destructive methods shall be ordered by the administrative department of geology and mineral resources of the people’s government at the county level and upwards to make corrections; if no correction is made within the specified time limit, all illegal earnings shall be confiscated, and a fine of RMB50,000 to 80,000 shall be imposed; where the mineral water resource are seriously damaged, original issuing organ shall revoke the mining license, and impose a fine of 10% up to 50% value of mineral water resources loss.   

Article 30 In violation of Article 9 of these Regulations, as pertain to mineral water exploration without exploration license, the administrative department of geology and mineral resources of the people’s government at the county level and upwards shall instruct to stop the illegal activity, give warning, and impose a fine of RMB50,000 to 100,000.

Article 31 In violation of Article 16 of these Regulations, as pertains to mineral water exploitation without mining license, the administrative department of geology and mineral resources of the people’s government at the county level and upwards shall instruct to stop the illegal activity, confiscate all illegal earnings, and impose a fine of RMB 50,000 to 80,000; where losses are caused to the State, collective or others, the offender shall make compensation in accordance with law.

Article 32 In violation of Article 17 of these Regulations, as pertains to production of purified water or other non-mineral water drinks using the appraised mineral water source, the administrative department of geology and mineral resources of the people’s government at the county level and upwards shall instruct to make corrections within the specified time limit; if no correction is made within the specified time limit, the department as above said shall, together with relevant departments, to seal up the production equipment and tools.

Article 33 In violation of Article 19 of these Regulations, as pertains to excess or over-scope exploitation, the administrative department of geology and mineral resources of the people’s government at the county level and upwards shall instruct to stop the illegal activity, confiscate all illegal earnings, and impose a fine of RMB 30,000 to 50,000; where the circumstances are serious, the original issuing organ shall revoke the mining license.

Article 34 In violation of Article 22 of these Regulationsif the mining-right owner for development of mineral water resources fails to submit annual report as required, refuses to accept the supervision and inspection, or makes deception, the administrative department of geology and mineral resources at the county level and upwards shall instruct to stop the illegal activity, give warnings, and impose a fine of RMB30,000 to 50,000; where the circumstances are serious, the original issuing organ shall revoke the mining license.

Article 35 In violation of Article 28 of these Regulations, as pertains to failure of setting up sanitary protected area as required, the administrative department of geology and mineral resources of the people’s government at the county level and upwards shall instruct to make corrections within the specified time limit; if no correction is done within specified time limit, the offender shall be instructed to stop production.

Article 36 The functionaries of administrative department of geology and mineral resources in charge of supervision and administration on development and protection of mineral water resources or other relevant functionaries who commit malpractices for personal gain, abuse their power or neglect their duties, shall be imposed with administrative penalties by their entity, superior organ or relevant administrative departments; where a crime is constituted, shall be investigated for the criminal liability by judicial authority.

Article 37 These Regulations shall become into effective as of the date of March 1, 2007.
