吉林省畜禽屠宰管理条例

 

200684吉林省第十届人民代表大会常务委员会第二十八次会议通过  根据20151120吉林省第十二届人民代表大会常务委员会第二十一次会议《吉林省人民代表大会常务委员会关于修改〈吉林省土地管理条例〉等7件地方性法规的决定》修正) 

  第一条 为了加强畜禽屠宰管理,保证畜禽产品质量,根据国家有关法律、法规,结合本省实际,制定本条例。 
  第二条 本条例适用于本省行政区域内的畜禽屠宰及其监督管理活动。 
  第三条 本条例所称畜禽是指人工饲养的猪、牛、羊、驴、食用犬、鸡、鸭、鹅。 
  本条例所称畜禽产品是指畜禽屠宰后未经加工的胴体、肉、脂、脏器、血液、骨、头、蹄、皮。 
  第四条 县级以上人民政府畜禽屠宰行政主管部门负责本行政区域内畜禽屠宰活动的监督管理,畜禽屠宰行政主管部门可以委托其所属的畜禽屠宰管理机构负责畜禽屠宰活动的日常监督检查。 
  县级以上人民政府卫生计生、环境保护、工商行政管理、食品药品监督、质量技术监督、公安、住房和城乡建设、交通运输、民族事务等有关部门,按照各自的职责,负责本行政区域内与畜禽屠宰有关的监督管理工作。 
  第五条 任何单位和个人屠宰畜禽必须在依法取得许可的畜禽屠宰厂(场)内进行。但是,下列情形除外: 
  (一)农村居民屠宰自己食用的畜禽; 
  (二)城镇居民屠宰自己食用的家禽。 
  第六条 设立畜禽屠宰厂(场),应当向所在地市(州)、县(市)人民政府畜禽屠宰行政主管部门提出书面申请,并提交能够证明其符合设立条件的材料。 
  市(州)、县(市)人民政府畜禽屠宰行政主管部门,应当在接到申请之日起二十日内,对于符合条件的,发放畜禽屠宰许可证;对于不符合条件的,告知不予许可,并书面说明理由。 
  第七条 屠宰厂(场)的选址,应当符合城市(县、乡)总体规划,远离生活饮用水源保护区,并不得妨碍或者影响所在地居民生活和公共场所的活动。 
  第八条 设立畜禽屠宰厂(场),应当具备下列条件: 
  (一)有符合规定的待宰间、屠宰间、急宰间、屠宰设备和运载工具; 
  (二)有符合规定的检验设备、冷藏设施、消毒设施和消毒药品及与其规模相适应的污染物、污水处理设施; 
  (三)有畜禽及其产品无害化处理设施; 
  (四)有依法取得健康证明的屠宰技术人员; 
  (五)有经省畜禽屠宰行政主管部门考核合格,并与屠宰规模相适应的肉品品质检验人员; 
  (六)有符合《中华人民共和国动物防疫法》规定的防疫条件。 
  第九条 畜禽屠宰厂(场)屠宰的畜禽,必须经过动物防疫监督机构检疫合格,并取得合格证明和相应的标志。 
  第十条 畜禽屠宰厂(场)不得屠宰注水或者注入其他物质的畜禽,屠宰加工畜禽产品不得注水或者注入其他物质。 
  第十一条 畜禽屠宰厂(场)屠宰畜禽,应当遵守操作规程和技术要求,提倡文明屠宰。 
  第十二条 畜禽屠宰厂(场)必须按照国家或者省规定的检验规程和标准进行肉品品质检验。肉品品质检验必须与畜禽屠宰同步进行。 
  肉品品质检验的内容包括: 
  (一)传染性疾病和寄生虫病以外的疾病; 
  (二)有害腺体; 
  (三)注水或者注入其他物质; 
  (四)种公母猪或者晚阉猪。 
  第十三条 肉品品质检验结果必须真实,并作登记。登记的资料保管一年。 
  第十四条 畜禽产品未经肉品品质检验或者检验不合格的,不得出厂(场)。 
  第十五条 在肉品品质检验的过程中,发现按照规定应当处理的畜禽产品,必须在肉品品质检验人员的监督下处理。 
  第十六条 经过检验合格的畜禽产品,畜禽屠宰厂(场)应当加盖当日肉品品质检验合格的验讫印章或者出具畜禽肉品品质检验合格证明。 
  第十七条 畜禽屠宰厂(场)当日未能出厂(场)的畜禽产品,必须采取冷冻、冷藏或者其他保证质量的措施予以储存。 
  第十八条 运输畜禽产品必须使用专用运载工具。猪、牛、羊、驴胴体应当实行密闭、吊挂运输;其他畜禽产品应当实行密闭运输,并使用专用容器盛装。专用运载工具应当有明显标志,不得用于其他用途。运输超过四小时的,采用冷链运输。 
  第十九条 种公母猪和晚阉猪肉品,出厂时必须加盖专用检验标志;销售时必须在销售场所明示告知消费者。 
  第二十条 从事畜禽产品销售、加工的单位和个人以及饭店、宾馆、集体伙食单位,销售或者使用的畜禽产品,应当是依法取得许可的畜禽屠宰厂(场)屠宰的畜禽产品。 
  第二十一条 畜禽屠宰执法监督检查人员进行执法监督检查时,必须出示行政执法证件,被检查的单位和个人不得阻碍、拒绝检查。 
  检查可以采取现场检查、取样化验、查阅资料、询问、查验证件等方式进行。 
  检查不得收取任何费用。 
  第二十二条 违反本条例规定,未取得畜禽屠宰许可证擅自屠宰畜禽的,予以取缔,没收非法屠宰的畜禽产品和违法所得,可以并处违法经营额三倍以下的罚款。 
  第二十三条 畜禽屠宰厂(场)在生产经营过程中因设备设施陈旧、老化等原因达不到原有设立条件要求,不能保证肉品质量的,责令停止屠宰活动,限期改正;逾期未改正的,吊销畜禽屠宰许可证。 
  第二十四条 违反本条例第十条规定,屠宰注水或者注入其他物质的畜禽以及屠宰加工畜禽产品注水或者注入其他物质的,责令立即停止屠宰活动,没收违反规定屠宰的畜禽、畜禽产品和违法所得,可以并处违法经营额一倍以上五倍以下的罚款;情节严重的,吊销畜禽屠宰许可证。 
  在市场上销售注水或者注入其他物质的畜禽产品的,由工商行政管理、卫生行政等有关部门按照各自的职责,对负有责任的生产者、销售者依照前款规定给予处罚。 
  第二十五条 违反本条例第十一条、第十二条、第十三条规定,有下列行为之一的,责令限期改正,逾期不改正的,可以处以五百元以上二千元以下的罚款: 
  (一)未按照操作规程和技术要求屠宰畜禽的; 
  (二)未按照检验规程和标准进行肉品品质检验的; 
  (三)肉品品质检验未与畜禽屠宰同步进行的; 
  (四)肉品品质检验结果未按规定登记保管的。 
  第二十六条 违反本条例第十四条规定,畜禽屠宰厂(场)出厂(场)的畜禽产品,未经肉品品质检验或者经肉品品质检验不合格的,没收畜禽产品和违法所得,可以并处违法经营额一倍以下的罚款。 
  第二十七条 违反本条例第十五条规定,畜禽屠宰厂(场)未按规定处理检验不合格的畜禽产品的,责令限期处理,可以处以三千元以上三万元以下的罚款;情节严重的,可以处以三万元以上五万元以下的罚款。 
  第二十八条 违反本条例第十八条规定,运输畜禽产品未使用专用运载工具或者运载方式不符合规定的,责令限期改正,逾期不改正的,可以处以五百元以上二千元以下的罚款。 
  第二十九条 违反本条例第十九条规定,出厂(场)的种公母猪和晚阉猪肉品未加盖专用检验标志的,责令立即改正,可以处以五百元以上一千元以下的罚款;拒不改正的,没收违法肉品。 
  违反本条例第十九条规定,销售种公母猪和晚阉猪肉品,未在销售场所明示告知消费者的,由工商行政管理部门责令立即改正,可以处以三百元以上五百元以下的罚款;拒不改正的,没收违法肉品。 
  第三十条 本条例规定的行政处罚,除法律、法规另有规定的以外,由县级以上人民政府畜禽屠宰行政主管部门实施。 
  第三十一条 阻碍执法监督检查人员依法执行职务,违反治安管理处罚法的,由公安机关依法处罚;构成犯罪的,由司法机关依法追究刑事责任。 
  第三十二条 畜禽屠宰行政主管部门或者其下属的畜禽屠宰管理机构以及其他有关部门的工作人员滥用职权、玩忽职守、徇私舞弊、索贿受贿的,依法给予行政处分;构成犯罪的,由司法机关依法追究刑事责任。 
  第三十三条 对违反本条例规定的行为,任何单位和个人均有举报的权利。对举报有功者以及在畜禽屠宰管理工作中做出显著成绩的其他单位和个人,由有关机关给予表彰或者奖励。 
  第三十四条 清真用畜禽的屠宰,依照《吉林省清真食品管理条例》的规定执行。 
  第三十五条 本条例自2006101起施行。 
    

Regulations of Jilin Province on the Administration of Livestock and Poultry Slaughter
 
 
(Adopted at the 28th Meeting of the Standing Committee of the 10th People's Congress of Jilin Province on August 4, 2006; revised in accordance with the “Decisions of the Standing Committee of the People’s Congress of Jilin Province on Amending Seven Local Regulations including the Land Administration Regulations of Jilin Province” at the 21st Meeting of the Standing Committee of the 12th People’s Congress of Jilin Province on November 20, 2015) 

    Article 1 These Regulations are formulated for the purposes of strengthening the administration of livestock and poultry slaughter and ensure the safety of the quality of livestock and poultry products in accordance with the relevant laws and regulations of the State and in the light of the actual circumstances of this Province. 
    Article 2 These Regulations shall apply to the management of livestock and poultry slaughter and the activities for its supervision and administration within the administrative regions of this Province.
    Article 3 “Livestock and poultry” mentioned in these Regulations shall refer to pigs, cattle, sheep, donkeys, food dogs, chicken, ducks, and geese raised by humans .
    The “livestock and poultry products”
mentioned in these Regulations shall refer to the slaughtered but not processed parts of livestock and poultry, such as the ketone body, flesh, fat, viscera, blood, bone, head, hoof, skin and so on. 
    Article 4 The administrative departments of livestock and poultry slaughter of the people's government at the county level and upwards shall be responsible for the work of the supervision and administration of livestock and poultry slaughter in corresponding administrative regions. The administrative departments of livestock and poultry slaughter may entrust their affiliated management organs of livestock and poultry slaughter to be responsible for routine supervision and inspection on livestock and poultry slaughter activities.
    The departments such as health and family planning, environmental protection, industrial and commercial administration, food and drug supervision, quality and technology supervision, public security, housing and urban and rural construction, transportation, ethnic affairs and so on of the people's governments at county level and upwards shall be responsible for the supervision and administration in relation to livestock and poultry slaughter within their respective scope of responsibilities in their respective administrative regions. 
    Article 5 Livestock and poultry slaughter of entities and individuals must be conducted in livestock and poultry slaughter plant (site) that has obtained legal permit, except for the following:
    (1) The villagers slaughter livestock and poultry that will be eaten by themselves; and
    (2) The residents of township slaughter livestock and poultry that will be eaten by themselves.
    Article 6 To apply for the establishment of livestock and poultry slaughter plant (site), the applicant shall submit a written application to the administrative departments of livestock and poultry slaughter of local people's government of the city (prefecture) or county (city), and provide the relevant technical data and instruction paper that tally with the provisions for establishment.
    Upon the receipt of the application, the administrative departments of livestock and poultry slaughter of the local people's government of the city (prefecture) or county (city) shall issue the license for livestock and poultry slaughter to those applications meeting conditions within 20 days upon the receipt of application; or inform the applicant about disapproval and give written explanations.
Article 7 The location of slaughter plant (site) shall be selected conforming to the overall planning of city (county, township), which shall be far away from the drinking water source protection area, and shall not hinder or affect living and public activities of local residents.  
    Article 8 The establishment of livestock and poultry slaughter plant (site) shall meet with the following conditions:
    (1)
Having stand-by slaughter rooms, slaughter rooms, emergency slaughter rooms, slaughter equipment and means of transport which conform to the requirements prescribed by the State; 
    (2)
Having inspection equipment, cold storage facilities, sterilization facilities and sterilization drugs that conform to the requirements prescribed by the State, and the facilities for pollution  and pollutants prevention and control suitable for the scale;
    (3)
Having the facilities for innocuous disposal of livestock and poultry and their products;
    (4) Having healthy employees engaged in slaughter with legal health certificates;  
    (5) Having inspectors of meat product quality who have been qualified through assessment by the administrative departments of livestock and poultry slaughter , and commensurate with the scale of slaughter; and
    (6) Having epidemic prevention conditions as prescribed by Animal Epidemic Prevention Law of the People's Republic of China.
    Article 9 Livestock and poultry slaughtered in the livestock and poultry slaughter plant (site) must pass the quarantine conducted by the animal health supervision institution and have quarantine certificates and marks attached to them.
    Article 10 A livestock and poultry slaughter plant (site) shall not slaughter livestock and poultry which are injected with water or other substances, and shall not inject water or other substances into the livestock and poultry products in slaughtering and processing.
    Article 11The livestock and poultry slaughter plant (site) shall slaughter livestock and poultry in compliance with the operational procedures and technological requirements, Civilized slaughter is advocated.
    Article 12 A livestock and poultry slaughter plant (site) shall establish inspect the meat product quality in accordance with the inspection procedures and standards prescribed by the State or Province. Inspection of meat product quality shall be carried out simultaneously with livestock and poultry slaughter.
    The contents of meat quality inspection include:  
    (1) The diseases other than infectious diseases and parasitic diseases;
    (2) The harmful glands;
    (3) The injected water or other substances; and
    (4) The breeding boar and sow, or late hog.
    Article 13 The inspection results of meat quality shall be truthfully recorded and registered. The registered information shall be kept for one year. 
    Article 14 Livestock and poultry products shall not leave the plant (site) if they have not undergone the inspection of meat product quality or they fail such inspection. 
    Article 15 During the inspection of meat products quality, the livestock and poultry products that are found to be disposed as stipulated, must be disposed under the supervision of meat products quality inspector.
    Article 16 The livestock and poultry products that pass the inspection of meat products quality shall be stamped by the livestock and poultry slaughter plant (site) with the stamp of "Inspected" or attach to them the certificate of "Inspected".
    Article 17 The poultry products of livestock and poultry slaughter plant (site) that do not leave the plant (site) in the same day, shall be stored by freezing, refrigerated or other measures guaranteeing the quality.
    Article 18 The livestock and poultry products must be transported by special vehicles. The body parts of pigs, cows, sheep and donkeys shall be transported by air-tight and hanging means; other livestock and poultry products shall be transported by air-tight means and special containers. The special vehicles must have eye-catching signs and shall not be used for other purpose. Cold-chain shall be applied if the transportation will exceed 4 hours.  
    Article 19 Breeding boar and sow must be stamped with a special inspection mark leaving the plant; the consumers must be informed about that at the selling place.  

Article 20 Entities and individuals, restaurants, hotels, and canteens engaged in sales and processing of livestock and poultry products, shall sell or use livestock and poultry products coming from livestock and poultry slaughter plant (site) that has obtained legal license. 
Article 21 When conducting the supervision and inspection, the law enforcement officers of livestock and poultry slaughter shall show their law enforcement credentials, and the entities and individuals concerned shall not refuse or obstruct such supervision and inspection.
    The inspection may be conducted by the form of field investigation, sampling for assay, consulting data, inquiry, checking certificates, and etc.
    The inspection shall be free of charge.
    Article 22 In violation of these Regulations, any entity or individual who slaughters livestock and poultry without livestock and poultry slaughter license, shall be banned, with all illegally slaughtered livestock and poultry products and illegal earnings confiscated, and imposed with a fine up to three times of illegal turnover.  
    Article 23 Any livestock and poultry slaughter plant (site) that fails to meet original conditions for establishment due to old and ageing equipment and facilities during the production and operation, of which the meat products quality cannot be guaranteed, shall be instructed to stop slaughter activities and rectified within the time limit; if no rectification is done within the time limit, the livestock and poultry slaughter license shall be revoked.
    Article 24 Any slaughter plant (house) slaughtering livestock and poultry that are injected with water or other substances, or processing livestock and poultry products that are injected with water or other substances, shall be instructed to stop slaughter activities, with all livestock and poultry, livestock and poultry products and illegal earnings confiscated, and imposed with a fine of not less than one time but not more than five times the illegal turnover; where the circumstances are serious, the livestock and poultry slaughter shall be revoked.
    If anyone sells livestock and poultry product that are injected with water or other substances in the market, administration of industry and commerce, health administration and other relevant departments shall, in accordance with their respective duties, impose punishment on the responsible producer and seller as aforementioned.  
    Article 25 In violation of Article 11, Article 12 and Article 13 of these Regulations, any act of the following shall be instructed to correct within the time limit; if no rectification is done within the time limit, a fine of RMB
500 to 2,000 shall be imposed:  
    (1) Failing to slaughter livestock and poultry in accordance with the operation procedures and technical requirements;  
    (2) Failing to inspect the meat products quality in accordance with inspection procedures and standards;  
    (3) Failing to inspect the meat products quality at the same time with live and stock slaughter; and
    (4) Failing to register and keep the inspection results of meat products quality as stipulated.
    Article 26 In violation of Article 14 of these Regulations, if the livestock and poultry products leave livestock and poultry slaughter plant (site) without meat products quality inspection or failing the inspection, livestock and poultry products and illegal earnings shall be confiscated, and the offender shall be imposed a fine of one time illegal turnover.
    Article 27 In violation of Article 15 of these Regulations, the livestock and poultry slaughter plant (site) that fails to dispose the livestock and poultry products not passing the inspection as stipulated, shall be instructed to dispose them within the time limit, and imposed a fine of RMB
3,000 to 30,000; where the circumstances are serious, the offender shall be imposed a fine of RMB30,000 to 50,000.
  Article 28 In violation of Article 18 of these Regulations, anyone who transports livestock and poultry products without special vehicles or by non-conforming means, shall be instructed to correct within the time limit; if no rectification is done within the time limit, the offender may be imposed a fine of RMB500 to 2,000. 
    Article 29 In violation of Article 19 of these Regulations, if the meet products of breeding boar and sow and late hog leave the plant (site) without stamping with special inspection mark, the offender shall be instructed to correct immediately, and may be imposed a fine of RMB
500 to 1,000; for those refusing to correct, their illegal meat products shall be confiscated.
    In violation of Article 19 of these Regulations, anyone who sells meet products of breeding boar and sow and late hog without informing consumers at the selling place, shall be instructed by the department of administration for industry and commerce to rectify immediately, and may be imposed a fine of RMB
300 to 500; for those refusing to correct, their illegal meat products shall be confiscated.  
    Article 30 Except otherwise specified by laws and regulations, administrative penalties in the Regulations shall be implemented by the administrative department of livestock and poultry slaughter of the people’s government at the county level and upwards.   
    Article 31 In case of obstructing the law enforcement officers in execution of duties, in violation of Public Security Administration Punishment Law, the departments of public security shall punish in accordance with law; where a crime is constituted, the criminal responsibility shall be investigated in accordance with law by judicial authority. 
    Article 32 If a functionary of administrative departments of livestock and poultry slaughter, their affiliated management organs of livestock and poultry slaughter and other relevant departments abusing his power, neglects his duties, commits illegalities for personal interests, or solicits (accepts) bribes, they shall be given the administrative sanctions in accordance with law; where a crime is constituted, the criminal responsibility shall be investigated in accordance with law by judicial authority.  
    Article 33 Any entity or individual has the right to report the activities that violate against these Regulations. The entities and individuals, who report successfully or make outstanding achievements in the management of livestock and poultry slaughter, shall be commended or awarded by relevant organs.  
    Article 34 As for the livestock and poultry slaughter for Moslem shall observe the provisions of Regulations of Jilin Province on Moslem Meal Administration
    Article 35 These Regulations shall become into effective as of the date of October 1, 2006.
