吉林省组织实施宪法宣誓制度办法

  第一条 为彰显宪法权威,激励和教育全省地方各级国家工作人员忠于宪法、遵守宪法、维护宪法,加强宪法实施,根据《全国人民代表大会常务委员会关于实行宪法宣誓制度的决定》和《中华人民共和国地方各级人民代表大会和地方各级人民政府组织法》的有关规定,结合本省实际,制定本办法。

第二条 地方各级人民代表大会及县级以上地方各级人民代表大会常务委员会选举或者任命的国家工作人员,以及地方各级人民政府、人民法院、人民检察院任命的国家工作人员,在就职时应当公开进行宪法宣誓。

第三条 宣誓誓词如下:

我宣誓:忠于中华人民共和国宪法,维护宪法权威,履行法定职责,忠于祖国、忠于人民,恪尽职守、廉洁奉公,接受人民监督,为建设富强、民主、文明、和谐的社会主义国家努力奋斗!

第四条 县级以上地方各级人民代表大会选举或者任命的本级人民代表大会常务委员会组成人员,省长、副省长,市长、副市长,州长、副州长,县长、副县长,区长、副区长,人民法院院长,人民代表大会专门委员会主任委员、副主任委员、委员等,在依照法定程序产生后,进行宪法宣誓。宣誓仪式由各级人民代表大会会议主席团组织,在人民代表大会全体会议上进行。选出的人民检察院检察长,经上一级人民检察院检察长提请该级人民代表大会常务委员会批准后,由本级人民代表大会常务委员会主任会议组织,在常务委员会全体会议上进行。

乡、民族乡、镇人民代表大会选举的本级人民代表大会主席、副主席,乡长、副乡长,镇长、副镇长在依照法定程序产生后,进行宪法宣誓。宣誓仪式由乡、民族乡、镇人民代表大会会议主席团组织,在人民代表大会全体会议上进行。

第五条 县级以上地方各级人民代表大会常务委员会在本级人民代表大会闭会期间任命的人民代表大会专门委员会个别副主任委员、委员,决定任命的本级人民政府个别副省长、副市长、副州长、副县长、副区长,决定任命的本级人民政府秘书长、厅长、局长、委员会主任,在依照法定程序产生后,进行宪法宣誓。宣誓仪式由县级以上地方各级人民代表大会常务委员会主任会议组织,在常务委员会全体会议上进行。

第六条 县级以上地方各级人民代表大会常务委员会任命的人民代表大会常务委员会代表资格审查委员会主任委员、副主任委员、委员,在依照法定程序产生后,进行宪法宣誓。宣誓仪式由县级以上地方各级人民代表大会常务委员会主任会议组织,在常务委员会全体会议上进行。

乡、民族乡、镇人民代表大会代表资格审查委员会的主任委员、副主任委员、委员在依照法定程序产生后,进行宪法宣誓。宣誓仪式由乡、民族乡、镇人民代表大会会议主席团组织,在人民代表大会全体会议上进行。

第七条 县级以上地方各级人民代表大会常务委员会任命的本级人民法院副院长、审判委员会委员、庭长、副庭长、审判员,人民检察院副检察长、检察委员会委员、检察员,专门人民法院院长、副院长、审判委员会委员、庭长、副庭长、审判员,派出的人民检察院检察长、副检察长、检察委员会委员、检察员,在依照法定程序产生后,进行宪法宣誓。宣誓仪式由地方各级人民法院、人民检察院分别组织。

第八条 地方各级人民政府、人民法院、人民检察院任命的国家工作人员,在就职时进行宪法宣誓。宣誓仪式由任命机关组织。

第九条 宣誓仪式根据情况,可以采取单独宣誓或者集体宣誓的形式。单独宣誓时,宣誓人应当左手抚按《中华人民共和国宪法》,右手举拳,诵读誓词。集体宣誓时,由一人领誓,领誓人左手抚按《中华人民共和国宪法》,右手举拳,领诵誓词;其他宣誓人整齐排列,右手举拳,跟诵誓词。

宣誓场所应当庄重、严肃,悬挂中华人民共和国国旗或者国徽。

负责组织宣誓仪式的机关,可以根据本办法并结合实际情况,对宣誓的具体事项作出规定。

第十条 本办法自201611日起施行。

 

 

 

Measures of Jilin Province on Organization of Implementing the Constitutional Oath System

 

 

(Adopted at the 21st Meeting of Standing Committee of the Standing Committee of the 12th People’s Congress of Jilin Province on November 20, 2015)

 

 

Article 1 These Measures are formulated for the purposes of demonstrating the Constitution's authority, inspiring and educating state functionaries in being loyal to, abiding by and upholding the Constitution, and strengthening the implementation of the Constitution, in accordance with the Decision of the Standing Committee of the National People's Congress on Implementing the Constitutional Oath System and the Organization Law of the People's Republic of China for Local People's Congresses at All Levels and Local People's Governments at All Levels, and in the light of specific situations of the Province.

Article 2 As for the state functionaries elected by or appointed upon decision of the people's congresses at all levels and the standing committees of the people's congresses at the county level and upwards, as well as the state functionaries appointed by the people's governments, people's courts and people's procuratorates at all levels, shall take a public oath to the Constitution when taking office.

Article 3 The oath is as follows:

I swear that I will be allegiant to the Constitution of the People's Republic of China, safeguard the Constitution's authority, perform statutory duties, be loyal to the country and people, be committed and honest when performing my duties, accept people's supervision, and work hard to develop China into a socialist country that is prosperous, strong, democratic, civilized and harmonious.

Article 4 As for the Governor and Vice Governor of Province, Mayor and Deputy Mayor of City, Governor and Vice Governor of Prefecture, County Head and Vice County Head, District Head and Vice District Head, the President of the Supreme People's Court, as well as chairmen, vice-chairmen and members of the special committees of the National People's Congress, among others, elected by or appointed upon decision of the National People's Congress at the county level and upwards, shall take an oath to the Constitution after they are elected under the statutory procedure. An oath-taking ceremony shall be organized by the Presidium of the Sessions of the National People's Congress at all levels and conducted on the plenary session of the people's Congress. The Procurator-General of the Supreme People's Procuratorate elected shall take an oath to the Constitution after they are reported by the Procurator-General of the Supreme People's Procuratorate at the next higher level and approved by the Standing Committee of People’s Congress at corresponding level. An oath-taking ceremony shall be organized by the Chairmen's Meeting of the Standing Committee of the National People's Congress at the corresponding level, and conducted on the plenary session of the Standing Committee.

As for the Chairman and Vice-Chairmen of the National People's Congress at corresponding level, head and deputy head of township, head and deputy head of town, elected by the National People's Congress of township, nationality township and town, shall take an oath to the Constitution after they are elected under the statutory procedure. An oath-taking ceremony shall be organized by the Presidium of the Sessions of the National People's Congress of township, nationality township and town, and conducted on the plenary session of the People's Congress.

Article 5 When the National People's Congress is not in session, individual deputy director members and members of the special committees of the National People's Congress; special Vice Governor of Province, Vice Mayor of City, Vice Governor of Prefecture, Vice County Head, and Vice District Head, appointed upon the decision; and the Secretary General, the Director - General, the director of bureau, the director of the Committee of the people’s government at corresponding level appointed upon the decision, shall take an oath to the Constitution after they are elected under the statutory procedure. An oath-taking ceremony shall be organized by the Chairmen's Meeting of the Standing Committee of the National People's Congress at the county level and upwards, and conducted on the plenary session of the Standing Committee.

Article 6 The director, deputy directors and members of the Credentials Committee of the Standing Committee of the National People's Congress, among others, appointed by the Standing Committee of the National People's Congress at the county level and upwards, shall take an oath to the Constitution after they are elected of the statutory procedure. An oath-taking ceremony shall be organized by the Chairmen's Meeting of the Standing Committee of local National People's Congress, and conducted on the plenary session of the Standing Committee. 

The director, deputy directors and members of the Credentials Committee of the National People's Congress of township, nationality township and town, shall take an oath to the Constitution after they are elected of the statutory procedure. An oath-taking ceremony shall be organized by the Presidium of the Sessions of the National People's Congress of township, nationality township and town, and conducted on the plenary session of the People's Congress.

Article 7 The Vice Presidents of the People's Court at corresponding level, members of the Judicial Committee, division chief judges, associate chief judges, and judges of the Supreme People's Court; the Deputy Procurators-General of the Supreme People's Procuratorate, members of its Procuratorial Committee, Procurators; Presidents, Vice Presidents, members of the Judicial Committee, division chief judges, associate chief judges, and judges of Special People's Court; and the dispatched Deputy Procurators-General of the People's Procuratorate, members of its Procuratorial Committee, Procurators, shall take an oath to the Constitution after they are elected of the statutory procedure. An oath-taking ceremony shall be organized respectively by the local People's Court and People's Procuratorate.

Article 8 The state functionaries appointed by the State Council and its departments, the Supreme People's Court and the Supreme People's Procuratorate shall take an oath to the Constitution when taking office. An oath-taking ceremony shall be organized by the appointing authority.

Article 9 An oath-taking ceremony may be conducted in the form of individual oath or collective oath in accordance with the actual circumstances. In the case of an individual oath, the oath taker shall put his or her left hand on the Constitution of the People's Republic of China, raise his or her right hand formed into a fist, and read aloud the oath. In the case of a collective oath, one person shall lead the oath, who shall put his or her left hand on the Constitution of the People's Republic of China, raise his or her right hand formed into a fist, and lead the reading of the oath; and other oath takers shall stand in order, raise their right hands formed into fists, and repeat the oath.

The place where an oath is taken shall be solemn and serious, and be hung with the national flag or national emblem of the People's Republic of China.

The authority in charge of organizing an oath-taking ceremony may, in accordance with these Measures and in consideration of the actual circumstances, provide for the specific matters on the oath.

Article 10 These Measures shall become into effective as of the date of on January 1, 2016.
