吉林省水文条例

 

2015730吉林省第十二届人民代表大会常务委员会第十八次会议通过

 

 

  第一条 为了加强水文管理,规范水文工作,为开发、利用、节约、保护水资源和防灾减灾服务,促进经济社会可持续发展,根据《中华人民共和国水法》、《中华人民共和国防洪法》、《中华人民共和国水文条例》、《中华人民共和国抗旱条例》等法律、法规,结合本省实际,制定本条例。

  第二条 在本省行政区域内从事水文站网规划与建设,水文监测与预报,水资源调查评价,水文监测资料汇交、保管、使用,水文设施与水文监测环境的保护等活动,应当遵守本条例。

  第三条 水文事业是国民经济和社会发展的基础性公益事业。省人民政府应当将水文事业纳入本级国民经济和社会发展规划,所需经费纳入本级财政预算,保障水文监测工作的正常开展,充分发挥水文工作在政府决策、经济社会发展和社会公众服务中的作用。

  市、州、县(市)人民政府应当根据经济社会发展需要,在政策措施、资金投入等方面支持和促进本行政区域水文事业的发展。

  第四条 省人民政府水行政主管部门主管本省水文工作,其直属水文机构(以下简称省水文机构)负责组织实施具体管理工作。

  省水文机构对全省水文工作实施行业管理,其派出到市、州的水文机构(以下简称派出水文机构)具体负责其管辖范围内的水文管理工作。

  市、州人民政府防汛抗旱指挥机构应当将派出水文机构列为成员单位。

  第五条 县级以上人民政府对在水文工作中做出突出贡献的单位和个人,按照国家和省有关规定给予表彰和奖励。

  第六条 省人民政府水行政主管部门根据全国水文事业发展规划和流域水文事业发展规划,编制全省水文事业发展规划,在征求省人民政府交通、航运、环保等有关部门意见后,报省人民政府批准实施,并报国务院水行政主管部门备案。

  第七条 水文事业发展规划主要包括水文事业发展目标、水文站网建设、水文监测和情报预报设施建设、水文信息网络和业务系统建设以及保障措施等内容。

  第八条 水文站网建设应当实行统一规划,坚持流域与区域相结合、区域服从流域,功能齐全、布局合理、防止重复,兼顾当前和长远需要的原则。

  第九条 水文站网建设应当依据水文事业发展规划,按照国家固定资产投资项目建设程序组织实施。

  经省人民政府规划建设的水文工程及设施,其建设、运行、维护经费应当列入同级财政预算。

  第十条水利枢纽、大中型水库、具有防洪任务的重要小型水库、水电站、重要水源工程等,应当按照国家有关规定配套设立专用水文测站或者配备水文监测设施。逐步加强城镇水文监测、预报基础设施建设。

  第十一条 新建、改建、扩建水利工程需要建设或者改造水文测站和水文监测设施的,应当与主体工程同时设计、同时施工、同时投入使用,建设或者改造的费用应当纳入工程建设投资计划。

  第十二条 国家重要水文测站的设立和调整,由省人民政府水行政主管部门报国务院水行政主管部门直属水文机构批准。

  省重要水文测站和一般水文测站的设立和调整,由省人民政府水行政主管部门批准,报国务院水行政主管部门直属水文机构备案。

  第十三条 设立专用水文测站,不得与国家基本水文测站重复。在国家基本水文测站覆盖的区域,确需设立专用水文测站的,应当按照管理权限报流域管理机构或者省水文机 构批准。其中,因交通、航运、环境保护等需要设立专用水文测站的,有关主管部门在批准前,应当征求流域管理机构或者省水文机构的意见。

  申请设立专用水文测站应当具备下列条件:

  (一)有满足开展水文监测所需的场地和设施;

  (二)有具备水文专业知识的技术人员;

  (三)有必要的水文监测技术装备和计量器具;

  (四)法律、法规规定的其他条件。

  撤销专用水文测站应当报原批准机关批准。

  第十四条 水文情报预报由县级以上人民政府防汛抗旱指挥机构、水行政主管部门或者水文机构按照规定权限向社会统一发布。禁止任何其他单位和个人向社会发布水文情报预报。

  水文机构应当依照省人民政府水行政主管部门的规定,及时向县级以上人民政府防汛抗旱指挥机构报告水文情报预报。

  广播、电视、报刊和网络等新闻媒体,应当按照国家有关规定和防汛抗旱要求,及时准确播发、刊登水文情报预报,并标明发布机构和发布时间。

  第十五条 水文机构为编制水文情报预报方案需要使用其他部门和单位设立的水文信息采集测站的资料时,有关部门和单位应当及时准确、无偿提供。

  水利、电力等行业管理单位自建的水文自动测报系统,其采集到的实时雨情、水情信息,应当及时报送省水文机构。

  第十六条 通信、无线电管理部门应当根据水文工作的需要,按照国家和省有关规定提供应急通讯保障、无线电安全保障。

  任何单位和个人不得挤占、干扰或者破坏水文机构使用的无线频道、信道和专用有线通信线路与设施。

  第十七条 县级以上人民政府水行政主管部门根据经济社会发展需要,会同有关部门组织开展水资源调查评价工作。水资源调查评价成果的审查,由县级以上人民政府水行政主管部门组织实施。

  从事水文、水资源调查评价的单位应当具有法定资质。

  第十八条 省水文机构应当建立与水资源管理需要相适应的水资源监测评价体系。

  水文机构应当对取用水、用水效率、水功能区、饮用水水源地、行政区界断面水文要素实时监测,形成监测数据和分析评价成果,并报同级水行政主管部门。

  水文机构的监测数据和分析评价结果应当作为县级以上人民政府进行水资源管理责任考核的依据。

  第十九条 水文监测资料实行统一汇交管理制度。省水文机构负责全省水文监测资料的收集、整理、汇总和审定工作。

  基本水文测站、专用水文测站应当按照水文技术标准整编水文监测资料,并向省水文机构汇交。

   从事水文监测的相关部门和单位应当对重要地下水源地(城镇供水日取水量五千立方米以上)、万亩以上灌区、地下水超采区域、重要引(退)水口、在江河和湖 泊设置的排污口、重要断面和重要供水水源地等进行监测,并及时将监测资料向水文机构汇交。水库、水电站、拦河闸坝等取用水工程的取(退)水、蓄(泄)水水 文资料,由取用水工程管理单位向工程所在地水文机构汇交。

  从事水文监测的相关部门和单位应当对本年度水文监测资料进行整编,并于下一年度二月底前向所在地水文机构汇交,或者直接向省水文机构汇交。

  第二十条 水文监测资料实行共享制度。县级以上人民政府水利、国土资源、环境保护、交通运输、农业、气象等部门应当互相通报水文监测数据,实行信息共享。

  省水文机构负责全省水文监测资料的整编、存储和保管工作,建立水文数据库和水文监测资料共享平台。

  第二十一条 有下列情形之一的,使用水文监测资料应当采用最近三十年以上系列:

  (一)编制重要规划的;

  (二)进行重点建设项目规划、立项、可行性研究、设计等前期工作的;

  (三)进行水资源调查评价、建设项目水资源论证、入河排污口设置论证、环境影响评价,水量分配方案、水量调度预案编制,水功能区纳污总量限制指标制订的;

  (四)编制防汛、抗旱预案,进行防洪影响评价的;

  (五)编制水土保持方案,设计水土保持工程的;

  (六)其他使用水文监测资料的。

  第二十二条 国家机关决策和防灾减灾、国防建设、公共安全、环境保护等公益事业需要使用水文监测资料和成果的,应当无偿提供。

  除前款规定的情形外,需要使用水文监测资料和成果的,按照国家有关规定收取费用,并实行收支两条线管理。

  因经营性活动需要提供水文专项咨询服务的,当事人双方应当签订有偿服务合同,明确双方的权利和义务。

  第二十三条 任何单位和个人不得侵占、毁坏、擅自移动或者使用水文监测设施,不得干扰水文监测。

  国家基本水文测站因不可抗力遭受破坏的,所在地人民政府和有关水行政主管部门应当采取紧急措施,组织力量修复,确保其正常运行。

  第二十四条 在水文测站上下游各二十公里的河道管理范围内,新建、改建、扩建下列工程影响水文监测的,建设单位应当采取相应措施,在征得对该水文测站有管理权限的水行政主管部门同意后方可建设:

  (一)水工程;

  (二)桥梁、码头和其他拦河、跨河、临河建筑物、构筑物,或者铺设跨河管道、电缆;

  (三)取水、排污等其他可能影响水文监测的工程。

  因工程建设致使水文测站改建的,所需费用由建设单位承担,水文测站改建后应不低于原标准。

  第二十五条 县级以上人民政府应当按照规定标准划定本行政区域内水文监测环境保护范围,并在保护范围边界设立地面标志。

  任何单位和个人都有保护水文监测环境的义务。

  禁止在水文监测环境保护范围内从事下列活动:

  (一)种植高秆作物、堆放物料、修建建筑物、停靠船只;

  (二)取土、挖砂、采石、淘金、爆破和倾倒废弃物;

  (三)在监测断面取水、排污或者在过河设备、气象观测场、监测断面的上空架设线路;

  (四)其他对水文监测有影响的活动。

  第二十六条 水文监测环境保护范围依照下列标准划定:

  (一)水文监测河段周围环境保护范围:沿河纵向以水文基本监测断面上下游各一定距离为边界,不小于五百米,不大于一千米;沿河横向以水文监测过河索道两岸固定建筑物外二十米为边界,或者根据河道管理范围确定;

  (二)水文监测设施周围环境保护范围:以监测场地周围三十米、其他监测设施周围二十米为边界。

  第二十七条 水文监测人员在河道、水库、桥梁进行水文监测时,应当按照有关规定设置警示标志,公安、交通运输等部门应当予以协助。

  第二十八条 违反本条例规定,有下列行为之一的,对直接负责的主管人员和其他直接责任人员依法给予行政处分;构成犯罪的,依法追究刑事责任:

  (一)错报水文监测信息造成严重经济损失的;

  (二)汛期漏报、迟报水文监测信息的;

  (三)擅自发布水文情报预报的;

  (四)丢失、毁坏、伪造水文监测资料的;

  (五)擅自转让、转借水文监测资料的;

  (六)不依法履行职责的其他行为。

  第二十九条 违反本条例规定,未取得水文、水资源调查评价资质证书从事水文活动的,责令停止违法行为,没收违法所得,并处五万元以上八万元以下罚款;情节严重的,并处八万元以上十万元以下罚款。

  第三十条 违反本条例规定,超出水文、水资源调查评价资质证书确定的范围从事水文活动的,责令停止违法行为,没收违法所得,并处三万元以上五万元以下罚款;情节严重的,按管理权限由发证机关撤销资质证书。

  第三十一条 违反本条例规定,侵占、毁坏水文监测设施或者未经批准擅自移动、擅自使用水文监测设施的,责令停止违法行为,限期恢复原状或者采取其他补救措施,可以处五万元以下罚款;构成违反治安管理行为的,依法给予治安管理处罚;构成犯罪的,依法追究刑事责任。

  第三十二条 违反本条例第二十五条第三款规定,在水文监测环境保护范围内从事违法活动的,责令停止违法行为,限期恢复原状或者采取其他补救措施,可以处一万元以下罚款;构成违反治安管理行为的,依法给予治安管理处罚;构成犯罪的,依法追究刑事责任。

  第三十三条 本条例规定的行政处罚,由县级以上人民政府水行政主管部门依据职权决定。

  第三十四条 本条例自 2015 10 1日起施行。

 

 

Regulations of Jilin Province on Hydrology

 

(Adopted at the 18th Meeting of the Standing Committee of the 12th People’s Congress of Jilin Province on July 30, 2015)

 

Article 1 These Regulations are formulated for the purposes of strengthening the administration on hydrological issues, regulating the hydrological work, developing the hydrological undertaking, serving the cause of development, utilization, conservation and protection of water sources and prevention and control of disasters, and promoting the sustainable development of the economy and the society in accordance with the Water Law of the People’s Republic of China, the Flood Control Law of the People’s Republic of China, the Regulations of the People’s Republic of China on Hydrology, the Drought Control Regulation of the People’s Republic of China and other relevant laws and administrative regulations, and in the light of the actual circumstances of this Province.

Article 2 As for the acts such as planning and construction of the hydrological observation stations and networks, conducting observations and forecast on hydrological issues, carrying out water resource survey and appraisal, gathering, turning over, keeping and using of hydrological monitoring materials, and protection of hydrological facilities and hydrological monitoring  environment within the administrative region of this Province, shall comply with these Regulations.

Article 3 The hydrological undertaking is a fundamental public welfare undertaking beneficial to the development of the national economy and the society. The provincial people’s government shall incorporate the hydrological undertaking into the national economy and society development planning and guarantee the fund needed in the hydrological undertaking through incorporating it into the local fiscal budget of the government at the corresponding level, playing the full role of hydrology in government decision-making, economic and social development, and the social and public services.

The people’s government of cities divided into districts and counties (cities, districts) shall, in accordance with the need of the local social and economic development, support and promote the development of the hydrological undertaking in their respective regions through means such as providing financial aid.

Article 4 The competent water conservancy administrative department of the Provincial People’s Government shall be in charge of the hydrological work of the whole province, and the organ for hydrological work directly under it (hereinafter referred to as the provincial hydrological organ) shall be responsible for organizing and carrying out the specific management work.

The provincial hydrological organ implements industrial management on the hydrology of the whole province, by whom the dispatched hydrological organs to city and states (hereinafter referred to as the dispatched hydrological organ) shall be responsible for organizing the implementation of the specific management work in the place where it is located.

The flood control and drought relief commanding organs of the people’s government at the level of city and state shall consider the dispatched hydrological organs as their members.

Article 5 The local people’s government at the county level and upwards shall give promotion and awards to the organizations and individuals making outstanding contributions to the hydrological undertaking.

Article 6 The provincial competent water conservancy administrative department shall, in accordance with the development planning of the State hydrological undertaking, the river basins hydrological undertaking development planning and the need for economic and social development of this Province, formulate the planning for the development of the hydrology undertaking of this Province, and, after soliciting opinions from the traffic, shipping, environmental protection and other relevant departments, report it to the Provincial People’s Government for approval and implementation, and report it to the competent water conservancy administrative department under the State Council for record.

Article 7 Hydrological undertaking development planning mainly covers the development objective of hydrological undertaking, construction of hydrological stations and networks, construction of hydrological monitoring and information forecasting facilities, construction of hydrological information website and business system, security measures, and etc.

Article 8 The construction of hydrological stations and networks shall be planned in a unified way, insisting on the principles of combination of river basin and region, region following the river basin, complete functions, reasonable layout, repetition prevention, taking into account the current and long-term needs.

Article 9 Construction of hydrological stations and networks shall be, in accordance with the hydrological undertaking development planning, organized and implemented in the procedures for construction of projects invested by state-owned fixed assets.

For hydrological projects and facilities constructed as planned by the provincial people’s government, the funds for their construction, operation and maintenance shall be incorporated into the financial budget at the same level.

Article 10 As for the water conservancy hub, large and medium-sized reservoirs, important small reservoirs with flood control tasks, hydropower stations, important water-source projects, and etc., hydrometric stations or hydrological monitoring facilities for special purpose shall be established in accordance with relevant provisions of the State. The construction of infrastructures shall be intensified gradually for urban and township hydrological monitoring and forecasting.  

Article 11 Where a hydrological observation station is to be renovated or built as an auxiliary part of a water conservancy project when it is built, rebuilt or expanded, it should be designed, constructed, and put into service at the same time with main project, with the fund needed for the construction or renovation incorporated into the construction budget of the whole project. 

Article 12 The establishment and adjustment of important hydrological observation stations of the State shall be reported to the hydrological organ directly of the competent water conservancy administrative department under the State Council for approval by the provincial competent water conservancy administrative department.

The establishment and adjustment of significant basic hydrological observation stations of the Province shall be approved by the provincial competent water conservancy administrative department and reported to the hydrological organ directly under the competent water conservancy administrative department of the State Council for record.

Article 13 A hydrological observation station designed for special use may not be close to the basic hydrological observation station of the State to avoid redundancy; where it is really necessary to establish a hydrological observation station for special use in the area covered by a basic hydrological observation station of the State, a report shall made to the provincial hydrological organ for approval; where it is necessary to establish a hydrological observation station for the needs of traffic, shipping and environmental protection, the competent authority shall consult the river basin administration organ or provincial hydrological organ for the approval.

The following requirement shall be fulfilled for the establishment of a hydrological observation station for special use:   

(1) There shall be the places and facilities necessary for carrying out hydrological monitoring;

(2) There shall be technical personnel with professional hydrological knowledge;

(3) There shall be special technical equipment and measuring instrument necessary for carrying out hydrological monitoring;

(4) Other requirements of laws and legal regulations.

Where a hydrological observation station for special use is to be demolished, a report shall be made to the original approval organ for approval.

Article 14 The hydrological information and forecast shall be released by the flood control and draught relieve office of a local people’s government at the county level and upwards, the competent water conservancy administrative department or the hydrological organ in accordance with their specified authorities. No other unit or individual may release the hydrological information or forecast to the public.

The hydrological organ shall timely report the hydrological information and forecast to the flood control and draught relieve office of the local people’s government at the county level and upwards, in accordance with the stipulations of the competent water conservancy administrative department.

News media such as radio, television broadcasting stations, newspapers and websites shall broadcast or publish hydrological information and forecast in a timely manner in accordance with the relevant provisions and requirement and shall make clear the name of the organ that has released the information and the time the information is released.

Article 15 In case the hydrological organ needs to use the hydrological information obtained by the hydrological observation stations set up by other departments or units for formulation of the hydrological information forecast, the relevant departments or units shall provide such information in a timely and free manner.

The real-time information about rain, flood, etc., collected by automatic hydrological monitoring and forecasting system established by administrative organs of water conservancy, power and relevant industries, shall be reported to the hydrological organ of the Province. 

Article 16 The radio and telecommunication administration department shall provide communication guarantee for the hydrological observation work in accordance with the relevant provisions of the State. 


No unit or individual may occupy, interrupt or damage the wireless channels or wire communication lines used by the hydrological organ.

Article 17 The water conservancy administrative department of the people’s government at the county level and upwards shall, in the light of the need of social and economic development, organize the survey and appraisal on water resources. The examination and verification of the water resources survey and appraisal results shall be implemented by the water conservancy administrative department of the people’s government at the county level and upwards.

The units carrying out hydrological and water resources survey and appraisal shall be legally qualified in this aspect.

Article 18 The hydrological organ of the Province shall establish the water resources monitoring and evaluation system suitable for the water resources management.

The hydrological organs shall carry out real-time monitoring on taking and using water, water consumption efficiency, water function areas, drinking water sources, the hydrological elements in sections of administrative regions boundary, to generate monitoring data and analytical evaluation results, and report to the water administrative department at the same level.

As for the monitoring data and analytical evaluation results of hydrological organs, shall be the basis for the people’s governments at the county level and upwards to review the responsibilities for water resources administration.

Article 19 The system of gathering and turning over hydrological monitoring materials in a unified way shall be implemented. Hydrological organ of the Province shall be responsible for collecting, sorting up, summarizing and reviewing hydrological monitoring materials of the whole province. 

As for the hydrometrical stations for general and special purposes, shall compile hydrological monitoring materials in accordance with the technical standards of hydrology, and report to hydrological organ of the Province.

The relevant departments and units engaged in hydrological monitoring shall monitor the important underground water sources (urban water withdrawal 5000 cubic meters and above), irrigated area of more than ten thousands mu, groundwater overdraft area, important lead (back) nozzle, outfalls set in the river and lake, important section and important water supply sources, and report monitoring data to a hydrologic institution timely. As for the water withdrawal (break), water accumulation (discharge) information of reservoir, hydropower station, blocking river gate dam and other water withdrawal projects, shall be reported by the administrative organ of water withdrawal project to local hydrologic organ.

As for the relevant departments and units engaged in hydrological monitoring shall sort up hydrological materials of the year, and turn over to local hydrological organ or to hydrological organ of the Province directly before the end of February of the next year.  

Article 20 The system of sharing hydrological monitoring materials shall be implemented. As for the water conservancy, land resources, environmental protection, transportation, agriculture, climate and relevant departments, shall exchange hydrological monitoring data to share the real-time information.

The provincial hydrological organ shall be responsible for sorting up, storing and keeping the hydrological monitoring material, and establishing a hydrological data and information co-share platform.

Article 21 Hydrological monitoring data of recent 30 years and above shall be used in the following cases:

(1) To formulate the important planning;

(2) To make the planning, project approval, feasibility study, design and other preliminary works for important construction projects;

(3) The water resources survey evaluation, water resources argument for construction project, argument for pollution discharge outlets arrangement of rivers, water allocation plan, water dispatching schedule, total amount of pollution limit target for water function area;  

(4) The preparation of flood and drought prevention plans, for the purpose of flood prevention effects evaluation;

(5) To formulate the conservation plan of water and soil, designing conservation engineering of water and soil;

(6) Other cases using hydrological monitoring materials.

Article 22 The hydrological monitoring materials and results shall be provided free of charge when they are needed by the state organs for their decision-making and for public welfare undertakings such as disaster prevention and relief, national defense construction, public security and environment protection.

Fees will be charged in accordance with the relevant provisions of the State when the hydrological monitoring materials and results are needed in some other conditions and the expenditures and incomes concerned shall be managed separately.

Where special consultation services on hydrological matters are needed for operational activities, a contract on the payable service shall be concluded to define the responsibilities of the both parties.

Article 23 No unit or individual may occupy or damage the hydrological monitoring facilities, or use or move the hydrological facilities without authorization, nor disturb the hydrological monitoring. 

Where the basic hydrological observation station of the State are damaged by Force Majeure, the local people’s government and the competent water conservancy administrative department shall carry out emergency measures, and organize the repair in a timely manner to ensure its normal operation.

Article 24 For construction, modification or expansion of following project which is located at the upper or lower reaches of a national basic hydrometric station and which may have an impact on the hydrologic monitoring, the construction project owner shall take corresponding measures. It shall not commence the construction until it has been consented by the water administrative department which has jurisdiction over the said station:

(1) The water projects;

(2) The bridge, piers and other buildings and structures crossing, spanning over or neighboring the river, or pavement of pipelines and cables across the river;

(3) The taking water, draining sewage or other projects which may affect the hydrologic monitoring.

If the project construction leads to modification of hydrometric station, the essential expenses shall be borne by the aforesaid construction project owner, and the modified hydrometric station shall be no lower than original standard.

Article 25 The people’s government at the county level and upwards shall bring forth the specific plans for the hydrological monitoring environment protection zoning, and set up landmarks on the peripheries of the protection zones.

Every unit and individual shall bear the responsibility to protect the hydrological monitoring environment.

The following activities are forbidden in the hydrological monitoring environment protection zones:

(1) To grow crops of long stalk variety, pile objects or materials, build constructions or structures, or berth vessels;

(2) To collect earth, quarry sand or rocks, blast or dump waste;

(3) To take water or discharge waste water at the monitoring section or erecting power lines over the bridging equipment, meteorological observation grounds or monitoring sections; and

(4) Other activities which may affect the hydrological monitoring.

Article 26 The hydrological monitoring environment protection zone shall be demarcated in the following principles:

(1) The protection zone for ambient environment of hydrological monitoring segment: no less than 500 meters, and no larger than 1000 meters longitudinally along upstream and downstream respectively from the hydrological inspection section of the rivers;  20 meters horizontally from fixed buildings at the both banks along the river, or as determined by the river course administration scope ;

(2)The Environmental protection scope around hydrological monitoring facilities: 30m around the monitoring site, and 20m around other monitoring facilities.

Article 27 When the hydrological monitoring technician conducts hydrological monitoring on a river, reservoir or bridge, he shall set up a warning sign in accordance with the relevant provisions; the public security organ, the communications department and relevant organs shall render their assistance.

Article 28 As for any of the following acts in violation of these Regulations, the directly liable person-in-charge and other directly liable persons shall be given a sanction in accordance with law. Where a crime is constituted, they shall be investigated the criminal liabilities:

(1)Reporting any false hydrologic monitoring information and resulting in gross economic losses;

(2)Failing to report or delaying the report of hydrologic monitoring information;

(3)Illegally releasing any hydrologic information forecast;

(4)Losing, destroying or counterfeiting any hydrologic monitoring materials;

(5)Illegally transfer or lending hydrologic monitoring materials to anyone else; or

(6)Any other act of failure to perform the duties in accordance with law.

Anyone who, in violation of the provisions of these Regulations, engages in hydrological activity without qualification certificate for hydrological and water resources survey and appraisal shall be instructed by the competent water conservancy department to stop the illegal act with its/his illegal gains confiscated, and imposed a fine of RMB50,000 but not more than RMB80,000; where the case is serious, they shall be imposed a fine of RMB 80,000 to 100,000.

Article 30 Anyone who engages in hydrologic activities beyond the scope as indicated in the hydrologic or water resource investigation and evaluation qualification certificate by in violation of these Regulations shall be instructed to stop the violation, with illegal gains confiscated, and be imposed a fine of RMB30,000 to 50,000 Yuan. Where the circumstance is serious, his qualification certificate shall be revoked by the issuing organ.

Article 31 Anyone who usurps or destroys hydrologic monitoring facilities or illegally moves away or uses hydrologic monitoring facilities by in violation of this Regulation shall be instructed to stop the violation and restore the original state or make other remedies within a time limit, and may be imposed a fine of RMB50,000 or less. If his act constitutes a violation of the public security administration, they shall be given a punishment for public security administration. Where any crime is constituted, they shall be investigated the criminal liabilities.

Article 32 Anyone who engages in any of illegal activities in the environmental protection scope of hydrological scope, by violating Article 25(3) of these Regulations, shall be instructed to stop the violation, restore the original state or make other remedies within a time limit, and may be imposed a fine of RMB10,000 or less. If the act constitutes a violation of the public security administration, they shall be given a punishment for public security administration. Where a crime is constituted, they shall be investigated the criminal liabilities.

Article 33 The administrative punishments as prescribed in these Regulations shall be decided by the water administrative departments of the people's governments at the county level and upwards in the light of their powers.

These Regulations shall become into effective as of the date of October 1, 2015.
