吉林省人参产业条例

 

(2015327吉林省第十二届人民代表大会常务委员会第十五次会议通过)

 

第一章 总 则

第一条 为了保护和合理利用人参资源,促进人参产业健康、可持续发展,根据国家有关法律、法规,结合本省实际,制定本条例。

第二条 本省行政区域内从事人参种植、加工、经营、检验、鉴定及其监督管理等活动,应当遵守本条例。

人参用于食品、保健食品、药品和日化产品加工的,应当同时符合相关法律、法规的规定。

第三条 本条例所称人参,是指五加科人参属中的人参和西洋参,包括根、茎、叶、花、果实和种子、种苗。

第四条 省人民政府农业主管部门负责全省人参产业管理工作。省人民政府农业主管部门所属的人参管理机构负责全省人参产业管理的具体工作。

()、县级人民政府农业主管部门负责本行政区域内的人参产业管理工作。

县级以上人民政府林业、卫生、水利、食品药品监督管理工商行政管理、质量技术监督等其他有关部门,按照各自职责,共同做好人参产业发展和管理工作。

第五条 省人民政府通过财政支持和金融、科技、人才扶持以及产业政策引导,促进人参产业发展。

第六条 县级以上人民政府对在人参产业发展和管理中做出突出贡献的单位和个人给予奖励。

第二章 产业规划

第七条 省人民政府应当坚持生态环境保护、资源合理配置和产业结构优化的原则,制定全省人参产业发展规划,并将其纳入国民经济和社会发展规划。

()、县级人民政府根据全省人参产业发展规划,制定本地区人参产业发展规划,并组织实施。

第八条 省人民政府农业主管部门根据全省人参产业发展规划,制定全省人参种植区域与规模、产业结构与布局、市场规划与建设等方案,经省人民政府同意后组织实施。

第九条 省人民政府应当制定措施,科学调整优化人参种植业结构,控制使用采伐迹地种植人参,鼓励和支持发展林下参和非林地种植人参,并逐步向非林地种植人参发展。

第十条 省人民政府根据全省人参自然资源状况划定人参种植重点发展区域,依托人参种植重点发展区域,扶持培育大型人参企业和人参产业集群,规划建设人参产品研发和精深加工产业园区。

第十一条 省人民政府应当遵循市场规律,根据人参产业发展需要,规划建设人参专业市场和人参贸易集散中心。

县级以上人民政府鼓励和支持与食品餐饮、医疗保健、美容养生、观光旅游和长白山文化等相结合的人参产品销售市场的建设和发展。

第三章 种植管理

第十二条 省人民政府农业主管部门会同质量技术监督等相关部门制定人参标准化种植规程。人参种植应当遵守人参标准化种植规程。

人参种植用地的土壤、水源和大气等环境,应当符合人参标准化种植规程规定的人参种植标准和要求。

第十三条 省人民政府和人参种植重点发展区域县级人民政府,应当鼓励和支持建设人参标准化种植示范园区,推进林下参和非林地种植人参试验示范。

第十四条 人参种植者应当建立人参种植档案。人参种植档案自人参收获后保留期限不少于二年。

人参种植档案应当包括下列内容:

()种植者姓名或者企业名称以及住址等基本信息;

()种植地块位置和土壤检测报告;

()使用的种子、种苗、肥料、农药等农业投入品的名称、来源、用法、用量和使用日期;

()病、虫、鼠、草害和其它灾害发生和防治情况;

()种植日期和收获日期;

()质量安全检验情况;

()销售去向。

第十五条 禁止在人参种植过程中实施下列行为:

()违反规定使用禁用、限用的农药、肥料、农膜等农业投入品;

()利用和使用农药残留或者重金属超标的土壤和种苗;

()使用不符合规定标准的灌溉用水;

()使用城市生活垃圾、工业垃圾和医院垃圾作为肥料;

()其他危害人参质量安全的种植行为。

第十六条 对使用采伐迹地种植人参实行许可管理。县级以上人民政府林业主管部门负责实施许可。

申请采伐迹地种植人参用地许可,应当符合下列条件:

()具有林权证明;

()无林参间作和人参种植不良记录;

()现有林地符合林木采伐和使用采伐迹地种植人参的相关规定。

第十七条 采伐迹地种植人参用地许可,应当采取公开、公平、公正的方式实施。

县级以上人民政府林业主管部门应当自受理采伐迹地种植人参用地许可申请之日起二十个工作日内,作出是否准予许可的书面决定。不予许可的,应当说明理由和依据。

第十八条 许可期限由被许可人申请,按照人参种植年限由林业主管部门确定。许可有效期限届满后,应当停止在该林地种植人参。

禁止出租、出售、转让采伐迹地种植人参用地许可。

禁止未经许可使用采伐迹地种植人参。

第十九条 使用采伐迹地种植人参应当实行林参间作,遵守林参间作造林技术规程,并制定水土保持方案。

办理采伐迹地种植人参用地许可时,被许可人应当与林业主管部门签订林参间作更新造林协议,明确使用采伐迹地种植人参的期限。

第二十条 县级以上人民政府林业主管部门应当自作出书面许可决定之日起十个工作日内,将采伐迹地种植人参用地许可结果书面告知当地同级农业主管部门。农业主管部门应当对被许可人进行种植技术指导和质量监管。林业主管部门及森林资源监督机构应当对使用采伐迹地种植人参用地情况进行监督检查。

第二十一条 禁止在下列林地的采伐迹地种植人参:

()自然保护区、森林公园、景区及其附近林地;

()江河源头和两岸林地;

()水库、湖泊周围等生态重要区位林地;

()国道、省道、县道两侧第一层山脊内林地;

()坡度25度以上的林地;

()山脊、沟壑等林地;

()不符合人参种植标准和要求的其他林地。

第四章 加工和经营

第二十二条 省人民政府卫生主管部门应当组织制定人参及其产品质量安全地方标准。

第二十三条 加工和经营人参及其产品,必须符合相关质量安全标准。

人参及其产品的加工者和经营者,应当建立健全人参及其产品质量安全管理和检验制度,并对人参及其产品的质量安全负责。

第二十四条 用于产品加工的人参,应当符合下列人参生长年限的要求:

()加工生晒参大力参保鲜参的人参生长年限为四年以上;

()加工红参的人参生长年限为五年以上;

()用于其他产品加工的人参生长年限,应当符合其产品标准及相关规定。

第二十五条 禁止在人参加工和经营过程中实施下列行为:

()加工和经营含有国家禁止使用的农药或者其他化学物质的人参及其产品;

()加工和经营农药残留、重金属、污染物以及其他危害人体健康物质的含量超过相关质量安全标准限量的人参及其产品;

()使用有毒有害物质加工;

()使用的保鲜剂、防腐剂、添加剂或者其他制剂不符合国家有关标准和技术规范;

()经营被有毒有害包装材料、容器、运输工具等污染的人参及其产品;

()经营变质或者超过保质期的人参及其产品;

()加工和经营其他不符合相关质量安全标准的人参及其产品。

第二十六条 人参加工者应当建立人参产品质量档案。人参产品质量档案的保留期限应当自产品售出后不少于三年。

人参产品质量档案应当包括下列内容:

()原料人参的来源、生长年限、数量和检验报告;

()产品名称、工艺流程和生产数量;

()使用的辅料、添加剂以及其他生物或者化学材料的名称、来源、数量、日期和使用方法等;

()产品标准;

()产品加工和售出日期、批次、检验报告,销售去向和数量。

第二十七条 人参及其产品经营者应当建立人参及其产品经营台账。人参及其产品经营台账的保留期限应当自产品售出后不少于二年。

人参及其产品经营台账应当包括下列内容:

()进货票据,产品名称、种类、来源、数量、价格和日期等;

()产品检验报告或者产品合格证;

()存放的场所和状况;

()销售票据,产品名称、种类、去向、数量、价格和日期等。

第二十八条 人参及其产品集中交易市场的开办者或者主办者应当履行下列管理义务:

()查验经营者资质;

()建立经营者档案,记载经营者的基本情况、主要进货渠道、经营品种、品牌和供货商状况等信息;

()查验人参及其产品检验报告或者产品合格证;

()与经营者签订质量安全管理责任协议,明确经营者对所经营的人参及其产品质量安全的管理责任;

()定期对经营者的经营行为和经营档案进行检查;

()其他应当履行的人参及其产品质量安全管理义务。

人参及其产品集中交易市场的开办者或者主办者发现经营者有违法行为的,应当及时制止,并立即将有关情况报告辖区工商行政管理部门、食品药品监督管理部门处理。

第二十九条 加工和经营散装人参及其产品,应当在散装人参及其产品的容器或者外包装上标明产品名称、生产日期、保质期、加工者和经营者名称以及联系方式等内容。

加工和经营预包装人参及其产品,应当有产品标签、产品合格证。产品标签应当标注下列内容:

()产品名称、规格、净含量、食用方法、生产日期、保质期;

()加工者和经营者的名称、地址、联系方式;

()产品执行标准;

()贮存条件;

()使用的添加剂在国家标准中的通用名称;

()法律法规或者产品标准中规定应当注明的其他事项。

第三十条 禁止加工和经营假冒、劣质人参及其产品。

有下列情形之一的,为假冒人参及其产品:

()以非人参冒充人参的;

()人参的种类、品种、产地与标签或者标识不符的;

()粘接、使用其他人参拼接的。

有下列情形之一的,为劣质人参及其产品:

()低于国家或者地方质量标准的;

()低于产品标注的质量标准的;

()掺杂掺假、以次充好的。

第五章 检验鉴定

第三十一条 人参种植、加工企业和农民专业合作经济组织以及人参及其产品集中交易市场,应当自行或者委托人参检验鉴定机构,对人参及其产品质量安全进行检验。

销售人参及其产品,应当经过质量安全检验,农户个人零散出售的除外。不符合相关质量安全标准的,不得销售。

第三十二条 县级以上人民政府有关部门应当按照职责分工,对加工和经营的人参及其产品进行监督抽查。被抽查的单位和个人,应当予以配合。监督抽查检验应当委托具有合法资质的检验鉴定机构进行。

进行抽样检验,应当购买抽取的样品,不收取检验费用和其他任何费用。

县级以上人民政府有关部门应当定期对在监督抽查中发现的假冒伪劣人参及其产品的品牌、加工经营者以及其他相关信息予以公布。

第三十三条 销售的人参及其产品标注理化指标、卫生指标等产品质量特性状况的,应当具有人参检验鉴定机构出具的检验鉴定证明。

第三十四条 销售标注野山参和移山参的产品,应当符合GB/T18765《野山参鉴定及分等质量》和GB/T22352《移山参鉴定及分等质量》的标准要求。

第三十五条 人参种植者在人参采收前,可以委托人参检验鉴定机构对拟采收的人参进行质量安全检验鉴定。

第三十六条 从事人参检验鉴定的机构和人员应当具有国家规定的从业资质资格。

第三十七条 人参检验鉴定实行检验鉴定机构与检验鉴定人负责制。

第三十八条 省人民政府质量技术监督部门应当将依法取得人参检验鉴定资质资格的机构和人员目录定期向社会公告。

第六章 产业扶持

第三十九条 省人民政府和人参种植重点发展区域县级人民政府应当对人参产业发展给予资金扶持,鼓励和支持建立人参产业发展融资平台,发展人参专业信贷担保,引导人参生产加工企业以物权、知识产权和股权抵押、出资等方式融资。

第四十条 县级以上人民政府应当鼓励和支持发展人参精深加工产业,对龙头企业在资金、信贷和保险等方面给予支持。

县级以上人民政府应当鼓励和支持农民专业合作经济组织和人参行业协会的发展,发挥农民专业合作经济组织和人参行业协会的自律作用,促进人参产业健康发展。

第四十一条 县级以上人民政府应当鼓励和支持推广、应用人参及其产品的标准化生产,开展人参及其产品质量安全科学技术研究,推广先进的质量安全生产技术,推行科学的质量安全管理方法。

第四十二条 县级以上人民政府应当建立完善人参产业创新研发体系,对人参科研项目给予重点扶持,鼓励和支持科研机构、院校、企业和个人研发推广新产品、新技术和新工艺,鼓励研制使用优质种苗、用土、用肥、用药、用膜、非林地种植和精深加工等新技术。

省人民政府对科研成果的推广应用给予资金支持。

第四十三条 县级以上人民政府应当结合本地实际,加强人参市场建设,完善仓储、运输和信息管理等配套服务。

第四十四条 省人民政府扶持人参品牌建设,通过高品质定位、高质量生产、高标准管理和广泛宣传,培育发展具有地域优势和特色的“长白山人参”品牌。

第四十五条 各级人民政府应当鼓励和支持新闻媒体、人参加工经营企业和社会各界宣传“长白山人参”文化,推介“长白山人参”品牌,提升“长白山人参”品牌知名度。

第七章 法律责任

第四十六条 违反本条例第十四条规定,有下列情形之一的,由县级以上人民政府农业主管部门责令限期改正;逾期不改的,处五百元以上二千元以下罚款:

()未建立人参种植档案的;

()未按照规定内容填写人参种植档案的;

()未按照规定期限保留人参种植档案的;

()伪造人参种植档案的。

第四十七条 违反本条例第十八条第二款规定,出租、出售、转让采伐迹地种植人参用地许可的,由县级以上人民政府林业主管部门责令限期改正,并处一千元以上五千元以下罚款;逾期不改的,吊销采伐迹地种植人参用地许可。

第四十八条 违反本条例第十八条第三款规定,未经许可使用采伐迹地种植人参的,由县级以上人民政府林业行政主管部门责令限期恢复原状,并处未经许可用地每平方米十元至三十元的罚款。

第四十九条 违反本条例第十九条第一款规定,使用采伐迹地种植人参未实行林参间作的,由县级以上人民政府林业主管部门责令限期改正,可以处应完成造林任务所需费用二倍以下的罚款;逾期不改的,吊销采伐迹地种植人参用地许可。

第五十条 违反本条例第二十五条规定,在人参加工和经营过程中有下列行为之一的,由县级以上人民政府食品药品监督管理部门、工商行政管理部门按照各自职责分工,没收违法所得、违法加工经营的人参及其产品和用于违法加工经营的工具、设备、原料等物品,违法加工经营的人参及其产品货值金额不足五千元的,并处二千元以上二万元以下罚款;货值金额五千元以上不足一万元的,并处二万元以上五万元以下罚款;货值金额一万元以上的,并处货值金额五倍以上十倍以下罚款;情节严重的,责令停产停业,直至吊销许可证:

()加工和经营含有国家禁止使用的农药或者其他化学物质的人参及其产品;

()加工和经营农药残留、重金属、污染物以及其他危害人体健康物质含量超过相关质量安全标准限量的人参及其产品;

()使用有毒有害物质加工;

()使用的保鲜剂、防腐剂、添加剂或者其他制剂不符合国家有关标准和技术规范;

()经营被有毒有害包装材料、容器、运输工具等污染的人参及其产品;

()经营变质或者超过保质期的人参及其产品;

()加工和经营其他不符合相关质量安全标准的人参及其产品。

第五十一条 违反本条例第二十六条、第二十七条规定,有下列情形之一的,由县级以上人民政府食品药品监督管理部门、工商行政管理部门按照各自职责分工,责令限期改正;逾期不改的,处一千元以上三千元以下罚款:

()未建立人参产品质量档案或者人参及其产品经营台账的;

()未按照人参产品质量档案或者人参及其产品经营台账内容要求填写的;

()未按照规定期限保管人参产品质量档案或者人参及其产品经营台账的;

()伪造人参产品质量档案或者人参及其产品经营台账记录的。

第五十二条 违反本条例第二十八条规定,人参及其产品集中交易市场的开办者或者主办者未履行查验、检查或者报告等义务的,由县级以上人民政府食品药品监督管理部门、工商行政管理部门按照各自职责分工,处二千元以上五万元以下罚款;造成严重后果的,责令停业,由原发证部门吊销许可证。

第五十三条 违反本条例第二十九条规定,加工和经营散装人参及其产品未按照规定标识的;加工和经营预包装人参及其产品无标签、产品合格证或者标签不符合规定的,由县级以上人民政府食品药品监督管理部门、工商行政管理部门按照各自职责分工,责令停止销售和召回;拒不改正的,可以查封,并处一千元以上三千元以下罚款。

第五十四条 违反本条例第三十条第二款规定,加工和经营下列假冒人参及其产品的,由县级以上人民政府食品药品监督管理部门、工商行政管理部门按照各自职责分工,责令停止加工经营,没收违法所得、违法加工经营的人参及其产品和用于违法加工经营的工具、设备、原料等物品,违法加工经营的人参及其产品货值金额不足五千元的,并处二千元以上二万元以下罚款;货值金额五千元以上不足一万元的,并处二万元以上五万元以下罚款;货值金额一万元以上的,并处货值金额五倍以上十倍以下罚款;情节严重的,责令停产停业,直至吊销许可证:

()以非人参冒充人参的;

()人参的种类、品种、产地与标签或者标识不符的;

()粘接、使用其他人参拼接的。

第五十五条 违反本条例第三十条第三款规定,加工和经营下列劣质人参及其产品的,由县级以上人民政府食品药品监督管理部门、工商行政管理部门按照各自职责分工,没收违法所得、违法加工经营的人参及其产品和用于违法加工经营的工具、设备、原料等物品,违法加工经营的人参及其产品货值金额不足五千元的,并处二千元以上一万元以下罚款;货值金额五千元以上不足一万元的,并处一万元以上二万元以下罚款;货值金额一万元以上的,并处货值金额二倍以上五倍以下罚款;情节严重的,责令停产停业,直至吊销许可证:

()低于国家或者地方质量标准的;

()低于产品标注的质量标准的;

()掺杂掺假、以次充好的。

第五十六条 违反本条例第三十一条第二款规定,销售人参及其产品未经质量安全检验的,由县级以上人民政府食品药品监督管理部门、工商行政管理部门按照各自职责分工,责令改正,给予警告;拒不改正的,处二千元以上二万元以下罚款;情节严重的,责令停产停业,直至吊销许可证。

第五十七条 违反本条例第三十三条规定,销售的人参及其产品标注理化指标、卫生指标等产品质量特性状况,没有或者伪造人参检验鉴定机构出具的检验鉴定证明的,由县级以上人民政府食品药品监督管理部门、工商行政管理部门按照各自职责分工,责令停止销售并召回;拒不改正的,可以查封,并处一千元以上三千元以下罚款。

第五十八条 违反本条例第三十四条规定,销售标注野山参和移山参的产品不符合GB/T18765《野山参鉴定及分等质量》和GB/T22352《移山参鉴定及分等质量》标准要求的,由县级以上人民政府食品药品监督管理部门、工商行政管理部门按照各自职责分工,责令停止销售并召回;拒不改正的,可以查封,并处一千元以上三千元以下罚款。

第五十九条 违反本条例第三十六条规定,不具有国家规定资质的机构从事人参检验鉴定的,由县级以上人民政府质量技术监督部门、食品药品监督管理部门依法处理。

第六十条 人参检验鉴定机构伪造检验鉴定结果的,由县级以上人民政府质量技术监督部门责令改正,没收违法所得,并处五万元以上十万元以下罚款,对直接负责的主管人员和其他直接责任人员处一万元以上五万元以下罚款;情节严重的,依法撤销其检验鉴定资质资格;造成损失的,依法承担赔偿责任。

第六十一条 国家机关工作人员在人参监督管理工作中玩忽职守、滥用职权、徇私舞弊的,由有关部门依法给予行政处分;构成犯罪的,依法追究刑事责任。

第八章 附 则

第六十二条 本条例中下列用语的含义:

()林下参,是指播种或者移栽在山林中自然生长的人参,产品包括野山参和移山参;

()野山参,是指播种在山林中自然生长的人参;

()移山参,是指移栽在山林中具有部分野山参特征的人参;

()鲜人参,是指采收后未经加工的新鲜人参;

()红参,是指以鲜人参为原料,经过刷洗后,蒸制、干燥的人参产品;

()生晒参,是指以鲜人参为原料,经过刷洗后,晒干或者烘干而成的人参产品;

()大力参,是指以鲜人参为原料,经过刷洗后,除须、烫制、凉水漂凉、干制的人参产品;

()保鲜参,是指以鲜人参为原料,经过刷洗后,用符合食品安全标准的制剂保存的人参产品。

第六十三条 人参种植档案、人参产品质量档案、人参及其产品经营台账的样式,由省人民政府农业主管部门、食品药品监督管理部门、工商行政管理部门分别制定。

县级以上人民政府农业主管部门、食品药品监督管理部门、工商行政管理部门分别负责各自建立档案的检查指导。

第六十四条 本条例自201541日起施行。

 

Regulations of Jilin Province on Ginseng Industry

 

(Adopted at the 15th Meeting of the Standing Committee of the 12th People’s Congress of Jilin Province on March 27, 2015)

 

Chapter I General Provisions

 

Article 1 These Regulations are formulated for the purposes of protecting and reasonably utilizing ginseng resources, and promoting the healthy and sustainable development of ginseng industry in accordance with the relevant laws and regulations of the State, and in the light of specific situations of this Province.

Article 2 These Regulations shall apply to all the activities involved in ginseng planting, processing, business, inspection and identification, supervision and administration within the administrative area of this Province.

As for the ginseng used for processing of food, health food, medicines and chemical products for daily use, shall also observe the relevant laws and regulations.

Article 3 The ginseng as mentioned hereinafter refers to the ginseng and American ginseng of Panax ginseng C.A.Mey, including root, stem, leaf, flower, fruit, seed and seedling.

Article 4 The administrative department of agriculture of the provincial people’s government shall be in charge of the administration of ginseng in the Province. The administrative organ of ginseng affiliated to the administrative department of agriculture of the provincial people’s governments shall be responsible for the specific work in the administration of ginseng industry their respective administrative regions.

The administrative agriculture departments of the people’s governments at the city (prefecture) and county levels shall be responsible for the administration of ginseng industry in their respective administrative regions.


The administrative departments of forestry, health, water conservancy, food and drug supervision and administration, industry and commerce, quality and technology supervision, etc. of the people’s governments at the county level and upwards shall cooperate to carry out the ginseng administration and industry development works in accordance with their respective functions and duties.

Article 5 The provincial people’s government shall promote the development of ginseng industry by funds support, financial, scientific and technologic and talents assistance, as well as guidance of industrial policies.

Article 6 The people’s governments at the county level and upwards shall give the commends and rewards to the groups and individuals that have made the outstanding contributions in the development and administration of ginseng industry.

 

Chapter II Industry Planning

 

Article 7 The provincial people’s government shall, insist on the principles of ecological environment protection, reasonable resources allocation and optimized industrial structure, formulate the ginseng industry development plan of this Province, and incorporate it into the overall plan for national economic and social development.

Based on ginseng industry development plan of this province, the people’s governments at the city (prefecture) and county levels shall formulate their own ginseng industry development plans considering local circumstance, and organize the implementation.

Article 8 The administrative departments of agriculture of the provincial people’s government shall, in accordance with the development planning for ginseng industry of the whole Province, formulate the plans of ginseng planting areas and scale, industrial structure and distribution, market planning and construction, etc. for the whole Province, which shall be organized for the implementation upon the approval of the provincial people’s government.

Article 9 The provincial people’s government shall formulate the measures to scientifically adjust the structure of ginseng planting industry, control the use of cut-over areas for planting ginseng, encourage and support the development of ginseng in forest and planting ginseng in non-forestry land, and gradually develop towards planting ginseng in non-forestry land.

Article 10 The provincial people’s government shall, in accordance with the situation of ginseng natural resources in the Province, delineate key development areas for ginseng planting. Relying on these key development areas, large-scale ginseng enterprises and ginseng industrial clusters shall be supported and cultivated, and research and deep-processing industry parks of ginseng products shall be planned into construction. 

Article 11 The provincial people’s government shall make planning for constructing special ginseng market and ginseng trade distribution center as needed by the development of ginseng industry, following the market rules.

The people’s governments at the county level and upwards shall encourage and support the construction and development of ginseng products sales market in combination with food and catering, medical and health care, beauty regimen, tourism and Changbai Mountain culture, etc. 

 

Chapter Administration on Planting

 

Article 12 The administrative departments of agriculture of the provincial people’s government shall formulate the procedures of standardized ginseng planting jointly with quality and technology supervision department and other relevant organs. All shall follow the procedures of standardized ginseng planting to plant ginseng.

 

Soil, water source and atmosphere for ginseng planting shall comply with the standards and requirements of ginseng planting in the procedures of standardized ginseng planting.

Article 13 The provincial people’s government and the people’s governments at the county level and upwards in the main ginseng planting areas shall encourage and support to establish the demonstration zones for standardized ginseng planting, and promote the demonstration of ginseng in forest and planting ginseng in non-forestry land.

Article 14 Ginseng planters shall establish archives for ginseng planting, which shall be kept for at least 2 years after the harvest of ginseng.

The archives of ginseng planting shall include the following contents:

(1) The name or company name, address, and other basic information of planter;

(2) The location of planting plot and soil test report;

(3) The name, source, use, dosage, use and disuse date of seed, seedling, fertilizer, pesticide and other agricultural inputs;

(4) The occurrence, prevention, and control situations of diseases, insects, rodent and other natural disasters;

(5) The planting and harvest date; and

(6) The quality safety inspection; and

(7) The whereabouts of selling.

Article 15 During the ginseng planting, it is forbidden to implement the following behaviors:

(1) To use the pesticide, fertilizers, agricultural film and other inputs prohibited by the provisions;

(2) To use the soil and seedling with pesticide residue or excessive heavy metal;

(3) To use the irrigation water non-conforming to the standard;

(4) To use the municipal solid waste, industrial waste and hospital waste as fertilizer; and  

(5) To conduct any other planting activity endangering the quality safety of ginseng.

Article 16 The license management shall be implemented on using cut-over areas for planting ginseng. The administrative department of forestry of people’s government at the county level and upwards shall be responsible for the implementation of license.

Applying for the license of planting ginseng in cut-over areas shall comply with the following conditions:


(1) To have the certificate of forest right;

(2) Without any bad records of intercropping trees and ginseng or ginseng planting;

(3) The existing forest land complies with the relevant provisions for forest cutting and using cut-over areas for planting ginseng.

Article 17 As for the license for planting ginseng in cut-over areas, which shall be implemented in a public, fair and just manner.

The administrative department of the forestry people’s government at the county level and upwards shall make a written decision on approving or disapproving the license within 20 working days since receiving the application of planter for using cut-over areas. In case of disapproving, reasons and basis shall be explained to the applicant.

Article 18 The term of license shall be applied by the licensee, and determined by the administrative department of forestry based upon ginseng planting years. When the term expires, the planting ginseng shall be prohibited in such area. 

It’s forbidden to lease, sell or transfer the license of plangent ginseng in cut-over areas.

It is prohibited to use the cut-over areas for planting ginseng without license.

Article 19 Intercropping trees and ginseng shall be implemented, and the technical specifications for forestation by intercropping trees and ginseng shall be followed for using cut-over areas for planting ginseng. Scheme of soil and water conservation shall also be formulated.

In transacting the license for planting ginseng in cut-over areas, the licensee shall sign an agreement of reforestation by intercropping trees and ginseng with the administrative department of forestry, which shall clearly define the term of planting in cut-over areas.

Article 20 The administrative department of forestry of the people’s government at the county level and upwards shall inform the written result of license for planting ginseng in cut-over areas to the administrative department of agriculture at the same level, within 10 working days since making the written decision on license. The license for planting ginseng in cut-over areas shall provide technical guidance and quality supervision on the licensee. The administrative department of forestry and forest resources supervision organs shall carry out supervision and inspection on the situations of land use for planting ginseng in cut-over areas.   

Article 21 Planting ginseng shall be prohibited in the cut-over areas of the following forest land:

(1) The nature reserve, forest park, scenic spot and nearby forest land;

(2) The source of rivers and the forest land on both banks;

(3)The forest land surrounding reservoir, lake and in other critical ecological locations;

(4) The first layer of forest in the ridge at both sides of national highway, provincial highway, and county road;

(5) The forest land in a slope of 25 degree and above;

(6) The ridge, gully and other forest land;

(7) Other forest lands non-conforming to the standards and requirements of ginseng planting.

Chapter IV Processing and Operation

Article 22 The administrative department of health of the provincial people’s government shall organize the formulation of local standards for quality safety of ginseng and ginseng products.

Article 23 As for processing and operating ginseng and ginseng products must comply with relevant quality safety standard.

As for the processing and business dealers of the ginseng and ginseng products shall establish and improve management and inspection system for quality safety of ginseng and ginseng products, and shall be responsible for the quality safety of ginseng and ginseng products.

Article 24 As for the ginseng used for product processing, shall meet the requirements for growing years as following:

(1) Over 4 years for the processing of sun-cured ginseng, dali ginseng and preserved ginseng;  

(2) Over 5 years for the red ginseng;

(3)As for the growing years of ginseng for other products processing shall comply with the product quality and relevant provisions.

Article 25 During the ginseng processing and operation, it is forbidden to:

(1) To process and operate the ginseng and ginseng products containing pesticide or other chemical substances forbidden by the State; 

(2) To process and operate the ginseng and ginseng products containing pesticide residues, heavy metals, pollutant and other health-dangerous substances beyond relevant quality safety limit;

(3) To use toxic or harmful substances and means to process ginseng;

(4)To use antistaling agent, anticorrosive, ditives and other preparations non-conforming to the relevant standards and technical specifications of the State;

(5)To operate the ginseng and ginseng products polluted by toxic or hazardous package, container or transportation;

(6) To operate the ginseng and ginseng products deteriorated or expired;

(7) To process and operate other ginseng and ginseng products non-conforming to relevant quality safety standards.

Article 26 The ginseng processors shall establish the ginseng processed products quality archives, which shall be kept at least 3 years after the products are sold.

The ginseng processed products quality archives shall include the following contents:

(1) The source, growth years, quantity and test report of raw ginseng;

(2) The name, processing procedures and production quantity of ginseng products;

(3) The name, source, quantity, use method and date, etc. of auxiliary agent, additive and other biological or chemical materials;

(4) The product production standard; and

(5) The date of processing and ex-factory, batch number, test report, whereabouts and quantity of products sold.

Article 27 The ginseng and ginseng products business dealers shall establish the ledgers of ginseng and ginseng products, which shall be kept at least 2 years since the products are sold.

The ledgers of ginseng and ginseng products shall include the following items:

(1) The incoming bills, name, type, source, quantity, price and date of products, etc.;

(2) The inspection report or certificate of product;

(3) The keeping and storage places and situations; and

(4) The sales bills, name, type, whereabouts, quantity, price and date of products, etc.

Article 28 The initiator or sponsor of ginseng and ginseng products centralized trade market shall fulfill the following obligations of management:

(1) To check the qualification of dealers;

(2) To establish archives of dealers to record the basic information of dealer, channels for stock of goods, operate varieties, brands and supplier information, etc.;

(3) To check the inspection report or certificate of ginseng and ginseng products;

(4) To enter the agreement of quality safety management responsibility with dealers to define the dealers’ management responsibility on quality safety of their ginseng and ginseng products;

(5) To inspect the operating acts and operating archives of dealers periodically;

(6) Other duly obligations of management on quality safety of their ginseng and ginseng products

Initiator or sponsor of ginseng and ginseng products centralized trade market shall stop illegal acts of dealers, as they are aware of, and report the situation to the department of administration for industry and commerce and the department of administration and supervision of food and drug in the jurisdiction.

Article 29 For processing and operating ginseng and ginseng products in bulk, the container or outer package of ginseng and ginseng products in bulk shall be labeled with the product name, manufacture date, expiration date, processing factory and dealer’s name and contact.

Product label and product certificate shall be available for processing and operating pre-packed ginseng and ginseng products. The product label shall describe the following:

(1) The name, specification, net content, use, manufacture date and expiration date;

(2) The name, address and contact of processing factory and dealer;

(3) The product standard;

(4) The conditions of storage;

(5) The common name of additives in national standards;

(6)Other matters that shall be noted as stipulated by laws, regulations or product standards.

Article 30 It is forbidden to deal in and sell counterfeit and shoddy ginseng and their products.

Counterfeit ginseng and products refer to:

(1) The ginseng imitated by other plants;

(2) The ginseng with type, species, and place of origin conflicting with the tag or identification;

(3) The attached or spliced by other ginseng;

Shoddy ginseng and ginseng products refer to those:

(1) With the product quality lower than national and provincial quality standard;

(2) With the quality lower than the quality standard tagged on the product;

(3) The mixing impurities and counterfeited products, or passing off as good quality.

Chapter V Inspection and Appraisal

 

Article 31 As for the ginseng planting and processing enterprises, farmers' specialized cooperative economic organization as well as ginseng and ginseng products wholesale markets, shall set up or entrust quality safety inspection institutions to inspect the quality safety of ginseng and ginseng products.


All ginseng and ginseng products shall pass the quality safety inspection before being sold, except for personal selling of farmers. Those non-conforming to product quality safety standards shall not be sold.

Article 32 The relevant departments of the people’s governments at the county level and upwards shall supervise and randomly inspect ginseng and ginseng products in the production or sold on the market in accordance with division of duties. As for the entities and individuals, which are selected randomly shall cooperate with the inspection. The supervision and random inspection shall be carried out by entrusted qualified quality safety inspection institutions.

The samples shall be purchased for random inspection, without any inspection fee or other charges.

The relevant organs of people’s government at the county level and upwards shall publicize the brand, processing factory, dealer and other information about the counterfeited and shoddy ginseng and ginseng products found in the supervision and random inspection.

Article 33 As for the ginseng and ginseng products sold by the business dealers, of which the specification, physical and chemical indexes, health index and other production quality characteristics are identified, shall be provided with the inspection certificate issued by product quality inspection institution.

Article 34 As for selling products labelled as wild ginseng and transplanted ginseng shall comply with the requirements of national standards “Identification and Grade Quality Standards of Wild Ginseng” (GB/T18765) and “Identification and Grade Quality Standards of Transplanted Ginseng” (GB/T22352).

Article 35 Before the ginseng harvest, ginseng planters may entrust ginseng inspection and appraisal institutions to inspect the quality safety of ginseng to be harvest. 

Article 36 As for the institution and staff engaged in ginseng inspection and appraisal shall be qualified for occupation as stipulated by the State.

Article 37 The inspection and identification of ginseng and ginseng products shall be carried out following the inspection and identification institution as well as inspection and identification staff responsible system.

Article 38 The quality and technology supervision department of the provincial people’s government shall announce the list of institution and staff who have obtained qualification of ginseng inspection and appraisal legally to the society.


 

Chapter VI Industry Support

 

Article 39 The provincial people’s government and people’s government at the county level in key development areas for ginseng planting shall give the funds support to the development of ginseng industry. The construction of financing platform for development of ginseng industry shall be encouraged and supported to develop special credit guarantee for ginseng, and guide ginseng manufacture and processing enterprises to raise capital by mortgage and contribution of property, intellectual property and share rights. 

Article 40 The fine and deep ginseng processing industries are encouraged. The leading enterprises shall be given supports in aspects of financing, credit, tax, insurance and etc.

The people’s governments at or above the county level shall carry out measures to support the development of farmer's special co-operative economic organizations and ginseng industry associations, encourage and support these organizations and associations to provide technical guidance and market information service to their members.

Article 41 The people’s governments at the county level and upwards shall encourage and support popularizing and applying standardized production of ginseng and ginseng products, develop scientific and technological research on quality safety of ginseng and ginseng products, spread advanced production technique of quality safety, and implement scientific measures of management on quality safety.

Article 42 The people’s governments at the county level and upwards shall establish innovation and research system of ginseng industry, and give key supports to scientific research projects of ginseng. They shall support scientific research institutions, colleges, enterprises and individual to research, develop and promote new products, technologies and techniques. They are encouraged to research and develop high-quality seedling, soil, fertilizer, pesticides, films, non-forestry lands planting, fine and deep processing, and other new technologies.

The provincial people’s government shall give support of funds to popularization and application of scientific research results.

Article 43 The people’s governments at the county level and upwards shall strengthen the construction of ginseng markets, provide perfect storage, transportation, information management and other matching service considering local circumstance.


Article 44 The provincial people’s government shall cultivate the brand of “Changbai Mountain Ginseng” with advantages and characteristics of the region by high-grade positioning, high-quality production, high-standard management, wide publicity and other measures.

Article 45 Ginseng production, processing and trading enterprises, news media and all sectors of the community shall be encouraged and supported by people’s governments at all levels to give publicity to the culture of “Changbai Mountain Ginseng”, popularize the brand and improve the brand awareness of “Changbai Mountain Ginseng”. 

 

Chapter Legal Liabilities

 

Article 46 As for those in violation of Article 14 of these Regulations, any of the following acts shall be instructed by the administrative departments of agriculture of the people’s government at the county level and upwards to correct within the prescribed time limit; as for those failing to correct within the time limit, they shall be imposed a fine of RMB 500 to 2,000:

(1) Failing to set up the archives for ginseng planting;

(2) Failing to write the archives for ginseng planting with contents as stipulated; 

(3) Failing to keep the archives for ginseng planting for a stipulated period; or

(4) To counterfeit the archives for ginseng planting.

Article 47 As for those in violation of Article 18(2) of these Regulations, any act of leasing, selling or transferring the license for planting ginseng in cut-over areas shall be instructed by the administrative departments of forestry of the people’s government at the county level and upwards to correct within the prescribed time limit and imposed a fine of RMB 1,000 to 5,000; as for those failing to correct within the time limit, their license for planting ginseng in cut-over areas shall be revoked. 

Article 48 As for those in violation against Article 18(3) of these Regulations, any act of using cut-over areas for planting ginseng without license shall be instructed by administrative departments of forestry of the people’s government at the county level and upwards to restore within the prescribed time limit, and imposed a fine of RMBwith 10 to30 per square meter of the land used without license.

Article 49 As for those in violation against Article 19(1) of these Regulations, any failure of intercropping trees and ginseng when using cut-over areas for planting ginseng, shall be instructed by administrative departments of forestry of the people’s government at the county level and upwards to correct within prescribed time limit and imposed with the amount up to twice of expense necessary for the designated forestation task; where no rectification is done in due time, license for planting ginseng in cut-over areas shall be revoked.

Article 50 As for those in violation of Article 25 of these Regulations, for any of the following acts during ginseng processing and operation, the department of administration and supervision of food and drug and the department of administration for industry and commerce of the people’s government at the county level and upwards shall confiscate the illegal gains, illegally processed ginseng and ginseng products, as well as tools, equipment and materials for illegal processing and operation in accordance with their respective division of responsibilities; and imposed a fine of RMB 2,000 to 20,000 for the amount of illegally processed ginseng and ginseng products less than 5,000 RMB; or 20,000 up to 50,000 for the value of amount above 5,000 but up to 10,000; or 5 to10 times of the value for the value of amount above 10,000 RMB; where the case is serious, the involver shall be instructed to stop production and operation, until the license is revoked:

(1) To process and operate ginseng and ginseng products containing pesticide or other chemical substances forbidden by the State; 

(2) To process and operate ginseng and ginseng products containing pesticide residues, heavy metals, pollutant and other health-dangerous substances beyond relevant quality safety limit;

(3) To use toxic or harmful substances and means to process ginseng;

(4)To use antistaling agent, anticorrosive, ditives and other preparations non-conforming to relevant standards and technical specifications of the State;

(5)To operate the ginseng and ginseng products polluted by toxic or hazardous package, container or transportation;

(6) To operate the ginseng and ginseng products deteriorated or expired; and

(7) To process and operate other ginseng and ginseng products non-conforming to relevant quality safety standards.

Article 51 As for those in violation of Article 26 and Article 27 of these Regulations, any of the following acts shall be instructed by the department of administration and supervision of food and drug and the department of administration for industry and commerce of the people’s government at the county level and upwards to correct within prescribed time limit in accordance with their respective division of responsibilities; where no rectification is done in due time, a fine of RMB 1,000 to 3,000 shall be imposed:

(1) Failing to establish ginseng product quality archives or ledgers of ginseng and ginseng products;

(2) Failing to write the ginseng product quality archives or ledgers of ginseng and ginseng products with the contents as required;

(3) failing to keep the ginseng product quality archives or ledgers of ginseng and ginseng products for a period as required; or

(4) To counterfeit ginseng product quality archives or ledgers of ginseng and ginseng products.

Article 52 As for those in violation of Article 28 of these Regulations, any initiator or sponsor of ginseng and ginseng products centralized trade market failing to fulfill his obligation of checking, inspecting or reporting, shall be imposed a fine of RMB 2,000 to 50,000 by the department of administration and supervision of food and drug and the department of administration for industry and commerce of the  people’s government at the county level and upwards in accordance with their respective division of responsibilities; where a serious result is caused, the involver shall be ordered to stop operation, and his license shall be revoked by original issuing organ.

Article 53 As for those in violation of the Article 29 of these Regulations, processing and operating ginseng and ginseng products in bulk without stipulated identification; or processing and operating pre-packed ginseng and ginseng products without label, product certificate or with non-conforming label, shall be instructed to stop selling and call back by the department of administration and supervision of food and drug and the department of administration for industry and commerce of the  people’s government at the county level and upwards in accordance with their respective division of responsibilities; as for those refuse to correct, his business shall be closed down and imposed a fine of RMB 1,000 to 3,000.

Article 54 As for those in violation of Article 30(2) of these Regulations, for processing and operating the following counterfeit ginseng and ginseng products, the department of administration and supervision of food and drug and the department of administration for industry and commerce of the people’s government at the county level and upwards shall instruct to stop processing and operation, confiscate the illegal gains, illegally processed ginseng and ginseng products, as well as tools, equipment and materials for illegal processing and operation in accordance with their respective division of responsibilities; and imposed a fine of RMB 2,000 to 20,000 for the amount of illegally processed ginseng and ginseng products less than RMB 5,000; or 20,000 to 50,000 for the value of amount above 5,000 but up to 10,000; or 5~10 times of the value for the value of amount above RMB 10,000; where the circumstances are serious, the involver shall be instructed to stop production and operation, until the license is revoked:

(1) The ginseng imitated by other plants;

(2) The ginseng with type, species, and place of origin conflicting with the tag or identification;

(3) The attached or spliced by other ginseng.

Article 55 As for those in violation of Article 30(3) of these Regulations, for processing and operating the following shoddy ginseng and ginseng products, the department of administration and supervision of food and drug and the department of administration for industry and commerce of the people’s government at the county level and upwards shall confiscate the illegal gains, illegally processed ginseng and ginseng products, as well as tools, equipment and materials for illegal processing and operation in accordance with their respective division of responsibilities; and fined with RMB2,000 to 10,000 for the amount of illegally processed ginseng and ginseng products less than RMB 5,000; or 10,000 up to 20,000 for the value of amount above 5,000 but up to 10,000; or 2 to 5 times of the value for the value of amount above RMB 10,000; where the circumstances are serious, the involver shall be instructed to stop production and operation, until the license is revoked:

(1) The product quality lower than national and provincial quality standard;

(2) The quality lower than the quality standard tagged on the product;

(3) The mixing impurities and counterfeited products, or passing off as good quality.

Article 56 As for those in violation against Article 31(2) of these Regulations, selling ginseng and ginseng products without passing quality safety inspection shall be instructed to correct and warned by the department of administration and supervision of food and drug and the department of administration for industry and commerce of the people’s government at the county level and upwards in accordance with their respective division of responsibilities; those refusing to rectify shall be imposed by a fine of RMB 2,000 to 20,000; where the case is serious, the dealer shall be instructed to stop production and operation, until the license is revoked.

Article 57 As for those in violation of Article 33 of these Regulations, selling ginseng and ginseng products, of which the specification, physical and chemical indexes, health index and other production quality characteristics are identified without or with counterfeit inspection certificate issued by product quality inspection institution, shall be instructed to stop selling and call back by the department of administration and supervision of food and drug and the department of administration for industry and commerce of the people’s government at the county level and upwards in accordance with their respective division of responsibilities; those refusing to rectify shall be closed down and imposed a fine of RMB 1,000 to 3,000.

Article 58 As for those in violation of Article 34 of these Regulations, selling products labelled as wild ginseng and transplanted ginseng non-conforming to the requirements of national standards “Identification and Grade Quality Standards of Wild Ginseng” (GB/T18765) and “Identification and Grade Quality Standards of Transplanted Ginseng” (GB/T22352), shall be instructed to stop selling and call back by the department of administration and supervision of food and drug and the department of administration for industry and commerce of the people’s government at the county level and upwards in accordance with their respective division of responsibilities; those refusing to rectify shall be closed down and imposed a fine of RMB 1,000 to 3,000.

Article 59 As for those in violation of Article 36 of these Regulations, any institution engaged in ginseng inspection and appraisal without national stipulated qualification shall be dealt with by the department of quality and technology supervision and the department of administration and supervision of food and drug of the people’s government at the county level and upwards in accordance with law.  

Article 60 Any ginseng inspection and appraisal institution counterfeiting result of inspection and appraisal shall be instructed to correct, by the department of quality and technology supervision of the people’s government at the county level and upwards, with all illegal earnings confiscated and imposed with a fine of RMB 50,000 to 100,000; the management directly in-the-charge and other directly responsible person shall be imposed with a fine of RMB 10,000 up to 50,000; where the circumstances are serious, the qualification for inspection and appraisal shall be revoked in accordance with law; where the losses are caused, they shall be liable for compensation in accordance with law.   

Article 61 As for any staff of government agency who involves in dereliction of duty, breach of privilege, or corruption, shall be imposed with administrative punishment by relevant departments in accordance with law; where a crime is constituted, the criminal liability shall be investigated in accordance with law.

 

Chapter VIII Supplementary Provisions

 

Article 62 The words in these Regulations have the following meanings:

(1) Ginseng in forest refers to the ginseng grown naturally after being sowed or transplanted in the forest, its products include wild ginseng and transplanted ginseng. 

(2) Wild ginseng refers to the ginseng naturally growing in deep mountain woods.

(3) Transplanted wild ginseng refers to the ginseng transplanted in mountain wood that has certain features of wild ginseng.

(4) Fresh ginseng refers to the harvested ginseng without processing.

(5) Red ginseng refers to the ginseng product of fresh ginseng after cleaning, steaming and drying processes.

(6) Sun-cured ginseng refers to the ginseng product of fresh ginseng after cleaning and sun-curing or drying processes.

(7) Dali ginseng refers to the ginseng product of fresh ginseng after cleaning, removing fibrous root, heating, cooling by cold water, and drying processes.

(8) Preserved ginseng refers to the ginseng product of cleaned fresh ginseng, kept by preparations conforming to food safety standards.  

Article 63 The format for ginseng planting archives, ginseng product quality archives, and ledgers of ginseng and ginseng products shall be formulated by the administrative departments of agriculture, the department of administration and supervision of food and drug and the department of administration for industry and commerce of the provincial people’s government, respectively.

The administrative departments of agriculture, the department of administration and supervision of food and drug and the department of administration for industry and commerce of the people’s government at the county level and upwards shall be responsible for inspection and guidance on their established archives.

Article 64 These Regulations shall become into effective as of the date of April 1, 2015.
