吉林省农村公路条例

 

 

(2015916日吉林省第十二届人民代表大常务委员会第二十次会议通过)

 

 

第一章 总 则 

  第一条  为了加强农村公路的建设、养护和管理,保障农村公路的安全畅通,根据《中华人民共和国公路法》、《公路安全保护条例》等法律、法规,结合本省实际,制定本条例。 

  第二条  本省行政区域内农村公路的规划、建设、使用、养护、管理和监督以及其他与农村公路有关的活动,适用本条例。 

  本条例所称农村公路,是指包括县道、乡道和纳入农村公路范围规划的村道及其附属设施。 

  第三条  县级以上人民政府应当将农村公路的发展纳入国民经济和社会发展规划,保证农村公路的正常建设、养护和管理,并将农村公路工作纳入对下级政府的绩效考核范围。 

  县级人民政府是本行政区域内农村公路建设、养护和管理的责任主体,县级人民政府应当加强对农村公路工作的组织领导和监督管理,建立健全农村公路建设、养护和管理的县、乡、村三级组织管理体系,并将农村公路工作纳入本级人民政府年度工作目标考核范围,建立并落实责任追究制度。 

  乡(镇)人民政府在本条例规定和县级人民政府确定的职责范围内,负责农村公路的建设、养护和管理工作,指导和帮助村民委员会建立村道管护群众组织。 

  第四条  各级人民政府交通运输主管部门在各自职责范围内做好农村公路的建设、养护和管理工作。 

  省人民政府交通运输主管部门会同同级财政部门编制全省农村公路建设、养护工程项目省级补助资金计划,安排使用和监督管理农村公路养护省级补助资金。 

  设区的市级人民政府交通运输主管部门负责本行政区域内农村公路建设、养护计划执行情况的监督,县道新改建、大中修工程和农村公路中型以上桥梁建设改造工程及路网结构改造工程的竣工验收,安排使用和监督管理农村公路养护市级补助资金。 

  县级人民政府交通运输主管部门负责提出本行政区域内农村公路建设、养护计划建议,农村公路养护资金的安排使用,农村公路建设市场、工程质量与安全生产监管,乡道、村道新改建、大中修工程和小桥涵建设改造加固工程的竣工验收。 

  第五条 农村公路受法律保护,任何单位和个人不得破坏、损坏或者非法占用农村公路、公路用地及公路附属设施。 

  任何单位和个人都有保护农村公路、公路用地及公路附属设施的义务,有权依法制止、检举和控告破坏、损坏或者侵占农村公路、公路用地、公路附属设施以及其他影响公路安全的违法行为。 

 

第二章 规划和建设 

  第六条  农村公路规划应当依据国民经济和社会发展规划,符合土地利用总体规划,按照有利于群众生产生活和保护农村生态环境的要求,结合社会主义新农村建设和城镇化建设的需要进行编制,并与城乡规划、国道和省道规划以及其他方式的交通运输发展规划相协调。 

  农村公路建设应当按照国家和省的有关规定,对贫困、边远以及少数民族地区增加投资比例。 

  第七条  县道规划由县级人民政府交通运输主管部门会同有关部门编制,经本级人民政府审定后,报上一级人民政府批准,并报省人民政府交通运输主管部门备案。 

  乡道、村道规划由县级人民政府交通运输主管部门协助乡(镇)人民政府编制,报县级人民政府批准,并报上一级人民政府交通运输主管部门备案。 

  经批准的县道、乡道、村道规划应当公布,不得擅自变更。确需变更的,应当按照原程序批准和备案。 

  第八条 农村公路建设应当充分利用现有道路进行改建和扩建。县道按照不低于三级公路技术标准建设,乡道按照不低于四级公路技术标准建设。村道建设标准应当根据当地实际需要和经济条件确定,一般不低于四级公路技术标准。 

  对不符合规定标准的农村公路,县级人民政府应当采取措施逐步改造。 

  第九条  技术标准为四级以上的农村公路和桥梁、隧道工程的设计,应当由具有相应资质的设计单位承担。其他农村公路工程的设计,可以由县级交通运输主管部门或者乡镇人民政府组织具有相关工程设计经验的公路工程技术人员承担。 

  第十条 二级以上公路或中型以上桥梁、隧道工程项目应当依法办理施工许可;其他列入年度建设计划的农村公路建设项目,完成相应准备工作并经县级以上人民政府交通运输主管部门同意的,即视同批准可开工建设。 

  沥青(水泥)混凝土路面、桥梁、隧道等建设项目,应当选择具有相应资质的专业队伍施工。 

  第十一条  县道或者二级以上乡道、村道及中型以上桥梁、隧道建设项目,应当通过招标选择具有相应资质的工程监理单位。其他农村公路建设项目,可以由县级农村公路管理机构组织监理。 

  第十二条 县级人民政府交通运输主管部门、乡(镇)人民政府应当聘请专业技术人员和群众代表参与农村公路建设质量与安全生产监督工作。 

  农村公路建设施工现场应当设立质量责任公告牌,公告有关责任单位、责任人、主要质量控制指标和质量举报电话。 

  第十三条  农村公路建设项目实行安全生产责任制和质量责任追究制。 

  农村公路建设项目的建设、设计、施工和监理单位应当明确安全和质量管理责任,落实安全和质量保证措施。 

  农村公路建设项目实行质量缺陷责任期和质量保证金制度。质量缺陷责任期不得少于交工验收后一二年,质量保证金制度按照国家有关规定执行。 

  第十四条  农村公路建设项目中的县道、大桥、特大桥、隧道工程完工后,由设区的市级人民政府交通主管运输部门组织验收;其他农村公路建设项目由县级人民政府交通运输主管部门组织验收。 

  省级人民政府交通运输主管部门应当对农村公路工程验收工作进行抽查。 

  第十五条 农村公路建设应当按照档案管理有关规定,收集、整理、保存工程资料,建立工程档案。

 

  第三章 养护和管理 

  第十六条  县级农村公路管理机构具体负责县道的养护工作,并对乡道、村道的养护进行技术指导。 

  乡(镇)人民政府具体负责乡道、村道的养护工作,并协助县级农村公路管理机构做好本行政区域内县道的养护工作。 

  村民委员会应当教育、引导村民自觉爱路、护路,维护农村公路的路容、路貌。 

  第十七条  农村公路日常养护方式逐步由群众性养护和季节性养护向专业性和经常性养护转变。季节性养护的路线由县、乡级人民政府在春、秋季集中组织进行,专业性养护的路线应当按照国家有关规定进行招标,但抢险抢修工程除外。 

  第十八条  农村公路养护作业时,作业单位应当设置必要的交通安全设施与安全警示标志。确需中断交通的,应当遵守相关法律、法规规定。 

  第十九条 县级农村公路管理机构、乡(镇)人民政府应当按照规定的频次进行农村公路养护巡查,并制作巡查记录。发现公路损坏和危险情况时,应当及时组织修复和排除。难以及时修复和排除的,应当在危险路段按照规定设置警示或者限行限载标志,必要时应当采取措施中断公路使用。 

  第二十条 因严重自然灾害致使农村公路中断或者严重损坏时,县级人民政府、乡(镇)人民政府和村民委员会应当及时组织修复。必要时可以动员和组织沿线机关、团体、企业事业单位、当地群众进行抢修,尽快恢复交通。 

  第二十一条 县级人民政府、乡(镇)人民政府和村民委员会应当按照绿化规划和谁种植、谁管理、谁受益的原则,组织和动员农村公路沿线的单位和个人实施公路绿化。 

  需要更新采伐农村公路护路林的,应当依照有关法律法规规定办理。 

  第二十二条  任何单位和个人不得在农村公路上及公路用地范围内非法挖砂、采石、取土、放牧、堆放物料、设置障碍、挖沟引水或者从事种植农作物、打场晒粮、倾倒垃圾、排放污物等损坏、污染公路、占道经营以及其他影响公路安全畅通的行为,不得损毁、擅自移动、涂改农村公路标志或者擅自设置其他标志。 

  除公路防护、养护需要外,禁止在农村公路建筑控制区内新建、扩建永久性建筑物和地面构筑物。 

  第二十三条 超限车辆不得在农村公路上行驶。 

  运载不可解体物品的超限车辆确需行驶的,应当按照《公路安全保护条例》的有关规定办理许可手续,并采取有效的防护措施,所需费用由运输单位或者个人承担。 

  因工程建设、生产经营确需重载车辆反复通过特定农村公路路段的,建设单位、生产经营单位应当与养护责任主体签订公路修复协议,缴纳相应数额的公路修复保证金,按照不低于原有公路技术标准及时修复、改建或者给予相应的经济补偿。 

  第二十四条 县级农村公路管理机构或者乡(镇)人民政府根据保护农村公路的需要,可以在农村公路的出入口设置必要的限高、限宽设施,但不得影响消防、工程抢险和卫生急救等应急通行需要,不得向通行车辆收费。限高、限宽设施必须有明显标志和夜间反光标志。 

  第二十五条 县级农村公路管理机构在监督检查中通过现场检测、受理举报等方式发现车辆有超限行为的,应当就地处理;不能就地处理的,应当就近处理。 

  任何单位和个人不得阻挠、干扰县级农村公路管理机构依法对农村公路超限运输违法行为的查处。 

  第二十六条  农村公路改建、大中修工程项目的规划和建设管理参照本条例第二章相应条款执行。

 

第四章 资金筹集和使用 

  第二十七条 各级人民政府应当建立政府投资为主、农村集体经济组织投资为辅、社会力量参与的农村公路建设、养护和管理资金筹集机制。其资金来源包括: 

  (一)国家补助的专项资金和中央财政转移支付资金; 

  (二)各级人民政府安排的财政性资金; 

  (三)村民委员会依照国家有关规定采取“一事一议”和政府奖补相结合方式筹集的用于村道建设、养护的资金; 

  (四)单位、个人等社会捐助或者利用农村公路冠名权、绿化经营权等方式筹集的资金; 

  (五)通过其他合法方式筹集的资金。 

  第二十八条 各级县级以上人民政府应当根据当年农村公路建设任务及养护和管理需要,将农村公路建设、养护和管理资金纳入本级财政预算。 

  第二十九条 农村公路省级补助资金的标准及拨付比例,由省人民政府财政、交通运输部门制定。  

  第三十条  鼓励单位、个人和农村公路沿线受益单位采取自愿捐资等方式建设和养护农村公路。 

  第三十一条 农村公路建设、养护、管理资金实行统一管理、专款专用,任何单位和个人不得挤占、挪用和截留。 

  县级以上人民政府交通运输主管部门和农村公路管理机构应当加强农村公路建设、养护、管理资金的管理,提高资金的使用效益。 

  财政、审计等部门应当依法对农村公路建设、养护、管理资金的使用情况进行监督和检查。 

 

第五章 法律责任 

  第三十二条 各级人民政府和有关部门以及公路管理机构及其工作人员不履行本条例规定的农村公路工作职责,有下列情形之一的,由本单位、上级机关或者有关主管部门责令改正,对单位负责人和直接责任人员依法给予处分;造成损失的,依法向责任人追偿;构成犯罪的,依法追究刑事责任: 

  (一)不及时制定并公布农村公路规划的; 

  (二)不按照本条例规定组织部署农村公路养护工作的; 

  (三)不依法履行农村公路建设、养护市场和工程质量与安全生产监管职责的; 

  (四)不依法履行农村公路养护职责的; 

  (五)违法发包农村公路建设、养护工程的; 

  (六)不建立或者不执行治理非法超限工作机制和责任追究机制,或者阻挠、干扰县级农村公路管理机构依法治理农村公路超限运输违法工作或者其他执法工作的; 

  (七)挤占、挪用或者截留农村公路建设、养护和管理资金的; 

  (八)违法行使农村公路建设、养护和管理审批权的; 

  (九)其他滥用职权、玩忽职守、徇私舞弊的。 

  县级以上交通运输主管部门、公路管理机构或者乡(镇)人民政府及其工作人员违反本条例规定,有下列行为之一的,由上级交通运输主管部门、本级或者上级人民政府对责任单位予以通报批评,责令限期改正;情节严重的,由其主管部门或者监察机关对直接负责的主管人员或者其他直接责任人员依法给予行政处分;构成犯罪的,依法追究刑事责任: 

  (一)未依法履行农村公路养护和管理职责的; 

  (二)农村公路建设项目应当依法招标而未招标的; 

  (三)在农村公路建设中监管失职,造成重大质量问题的; 

  (四)农村公路未经验收或者验收不合格交付使用的; 

  (五)截留、侵占和挪用农村公路建设、养护和管理资金的; 

  (六)在农村公路建设和养护中,采用强制手段向单位、个人集资的; 

  (七)其他玩忽职守、徇私舞弊、滥用职权的行为。 

  第三十三条 违反本条例规定,未经批准擅自施工的,由设区的市县级以上人民政府交通运输主管部门责令停止施工,并可以处五万元以下罚款。 

  第三十四条 违反本条例规定,擅自采伐农村公路护路林的,由县级农村公路管理机构责令补种,没收违法所得,并处采伐树木价值三倍以五倍以下的罚款。 

  第三十五条  违反本条例规定,造成农村公路路面损坏、污染公路或者影响农村公路安全畅通的,由县级农村公路管理机构责令停止违法行为,可以处三千元五千元以下罚款。 

  第三十六条 违反本条例规定,损毁、擅自移动、涂改农村公路标志或者擅自设置其他标志的,以及超限车辆擅自在农村公路上行驶的,由县级农村公路管理机构责令停止违法行为,可以处一万五千元以下的罚款。 

  第三十七条 违反本条例规定,超限车辆擅自在农村公路上行驶的,由县级公路管理机构责令停止违法行为,并处三万元以下的罚款。 

  第三十八条 对农村公路及其附属设施造成破坏、损坏损害的,应当按照不低于农村公路原有的技术标准予以修复、改建或者按照破坏、损坏损害程度给予相应的赔偿或者补偿;构成犯罪的,依法追究刑事责任。 

    

第六章 附  

  第三十九条  本条例自 2016 1 1日起施行。 

 

 

 

 

 

Regulations of Jilin Province on Rural Roads

 

(Adopted at the 20th Meeting of Standing Committee of the 12th People’s Congress of Jilin Province on September 16, 2015)

 

 

Chapter I General Provisions

    Article 1 These Regulations are formulated for the purposes of strengthening the construction, maintenance and administration of rural roads, guaranteeing the quality, mobility and accessibility of rural roads, in accordance with the Highway Law of the People's Republic of China, Regulation on Protecting Highway Safety, other relevant laws and regulations, and in the light of the actual circumstances of this Province.

Article 2 These Regulations shall apply to the planning, construction, use, maintenance, administration, supervision, and other activities in relation to rural roads within the administrative region of this Province.  

The term "rural roads" used in these Regulations refers to the county roads, township roads and village roads incorporated in the scope of rural roads planning.

Article 3 The people's governments at the count level and upwards shall incorporate the development of rural roads into the national economic and social development plans, guarantee the normal construction, maintenance and management of rural roads, and incorporate the works of countryside highway into the performance appraisal to the government at the lower levels.

The people's governments at the county level are responsible for the construction, maintenance, and administration of rural roads. The people's governments at the county level shall strengthen the organization of leadership, supervision and administration of work of rural roads, build three-level administration systems of county, township and village for countryside highway construction, maintenance and administration, and shall incorporate the work of countryside highway into the annual work targets of the people's governments at corresponding level to be assessed, establish and implement responsibility tracing system.

The people's governments at the town (township) level are responsible for the construction, maintenance and administration of rural roads within their duties as determined by the Regulations and the people’s government at county level, and guide and assist villager committees to establish mass organizations for protecting village roads.

Article 4 The competent department of transportation of the people’s governments at all levels shall do a good job of construction, maintenance and administration of rural roads within the scope of their respective duties.

The competent department of transportation of the provincial people’s governments shall, together with the finance department at the same level, work out the provincial grant funds plan for construction and maintenance projects of rural roads in the whole province, arrange the use of provincial grant funds, and implement supervision and administration for maintenance of rural roads.

The competent department of transportation of the municipal people’s governments with districts shall be responsible for supervision on implementation of rural roads construction and maintenance plans in their administrative regions, completion acceptance of county roads construction, overhaul projects as well as bridges construction and modification, road network structure modification projects of middle scale and above on rural roads, and also for arranging the use, supervising and administrating the municipal grant funds for maintenance of rural roads.

The competent department of transportation of the people’s governments at county level shall be responsible for proposing the rural roads construction and maintenance plan, arranging the use of the municipal grant funds for maintenance of rural roads, supervising and administrating the market, quality and safe production of rural roads construction, and also for completion of acceptance in construction, modification, overhaul projects of county roads and village roads, as well as construction, modification and reinforcement of small bridges and culvers thereon  in their administrative regions.

Article 5 The rural roads shall be subject to the protection by laws. No entity or individual may break, damage, or illegally occupy rural roads and attached lands and accessory facilities.

    Any unit or individual has the obligation of protecting rural roads and attached lands and accessory facilities, and has the right to stop, report and charge acts that break, damage or occupy rural roads and attached lands and accessory facilities, and other acts endangering the security of rural roads.

 

Chapter II Planning and Construction

    Article 6 The rural roads planning shall be formulated in accordance with national economic and social development planning, conforming to the overall land use planning, in the light of the requirements of favoring mass production and living and protecting ecological environment in villages, in combination with the needs of new socialist countryside construction and township construction, and shall be coordinated with planning such as urban and rural planning, general planning for national and provincial highways, and development planning of other transportation means.

    According to the relevant provisions of the State and Province, investment shall be increased on the construction of rural roads in poverty, remote and ethnic minority areas. 

Article 7 County roads planning shall be formulated by the competent department of transportation together with relevant departments of the people’s governments at county level, and reported to the people’s government at the next higher level for approval and to the competent department of transportation of the provincial people’s governments for record.

Township and village roads planning shall be formulated by the township (town) people’s government with the assistance of the competent department of transportation of the people’s governments at county level, reported to the people’s government of county for approval and to the competent department of transportation under the people’s governments at the next higher level for record.

 The approved planning of county, township and village roads shall be publicized, and shall not be changed without approval. If the change is necessary, it shall be approved and recorded by the original procedures.

Article 8 The construction of rural roads shall make full use of existing roads by modification and expansion. The construction criteria of county roads shall not be lower than Class III highways, and of township roads shall not be lower than Class IV highways. The construction criteria of village roads shall be determined in the light of actual needs and economic conditions locally, which shall not be lower than Class IV highways generally.

As for the rural roads not conforming to construction criteria, the people’s government at county level shall take measures for modification gradually.

Article 9  The design of rural roads as well as bridges and tunnels thereon at Class IV and above levels shall be undertaken by qualified designing entity, and of other countryside highway projects may be undertaken by highway engineering technicians with relevant designing experience under the organization of the competent department of transportation at county level or township people’s government.

Article 10 Construction license shall be obtained legally for highways at Class II and above levels or bridge and tunnel projects of middle size and above; countryside highway construction projects listed into annual construction plan, shall be considered as being approved for commencement upon the readiness of all preparations and approval of the competent department of transportation of the people’s governments at the county level and upwards.

 The professional teams with corresponding qualification shall be selected for construction of bitumen (cement) concrete pavement, bridge and tunnel projects.

Article 11 A qualified engineering supervision entity shall be selected by bid invitation for the construction projects of county roads or township and village roads at Class II and above levels as well as bridges and tunnel of middle size and above. The supervision on other countryside highway construction projects may be organized by the rural roads administrations at county level.

Article 12 The competent department of transportation of the people’s governments at the county level, township (town) people’s government shall retain professional technicians and mass representatives to participate in the supervision on construction quality and safety. 

A quality responsibility bulletin shall be set up on the construction sites of rural roads to announce the responsible entity, responsible person, main quality control targets and quality reporting telephone number.

Article 13 The safe production responsibility system and quality responsibility tracing system shall be implemented for countryside highway construction projects. 

The entities engaged in building, design, construction and supervision of countryside highway projects shall define the responsibilities for safety and quality management, and establish safety and quality guarantee measures.

The quality defects liability period and quality bond system shall be implemented for countryside highway construction projects. The quality defects liability period shall be at least 12 years after the completion acceptance. The quality bond system shall make reference to relevant provisions of the State.

Article 14 The completion acceptance for county roads, big bridges, super-big bridges and tunnel projects in rural roads construction shall be organized by the competent department of transportation of the people’s government at the city level with districts; and of other countryside highway construction projects shall be organized by the competent department of transportation of the people’s governments at the county level.

The competent department of transportation of the provincial people’s governments shall make a random inspection on completion acceptance of rural roads construction projects.

Article 15 The engineering materials of rural roads construction shall be collected, sorted up and kept in accordance with relevant provisions on archives. The archives of projects shall be established.

 

Chapter III Maintenance and Management

Article 16 The rural roads administration at the county level shall be responsible for the maintenance of county roads, and provide technical guidance to the maintenance of township roads and village roads.

Township (town) people’s government shall be responsible for specific works in relation to the maintenance of township roads and village roads, and shall assist the rural roads administration at the county level for the maintenance of county roads in their administrative regions.

The villager committees shall educate and guide villagers to consciously cherish and protect roads, and maintain road condition and road appearance of rural roads.

Article 17 The routine maintenance modes of rural roads shall be converted to professional and frequent maintenance from mass and seasonal maintenance gradually. The seasonal maintenance shall be conducted of the organization of people’s governments at county and township levels in spring and autumn, and professional maintenance shall be subject to bid invitation in accordance with relevant provisions of the State, except for emergency repairs.

    Article 18 During the maintenance of rural roads, working entities shall set up necessary traffic signs and warning signs. If a section of a highway must be closed for maintenance purpose, relevant laws and regulations shall be observed. 

Article 19 The rural roads administration at county level and township (town) people’s government shall conduct patrol inspection of highways by specified frequency, and make patrol inspection records. Any damage or danger found on the highway shall be repaired and eliminated under the organization. If it is difficult to repair and eliminate timely, a warning sign or limited line/load signs on dangerous sections as stipulated, and measures shall be taken as necessary to close the section of highway.

Article 20 When the rural roads are interrupted or seriously damaged due to serious natural disasters, people’s government at county level, township (town) people’s government and villagers committees shall organize the repair timely, and, if necessary, organize local government institutions, groups, enterprises, public institutions and local people along the line for rush repairs to restore the operation of the roads as soon as possible. 

 Article 21 According to the greening planning and in the principle that the one who plants will manage it and thus benefit therefrom, people’s government at county level, township (town) people’s government and villagers committees shall organize and mobilize entities and individuals along rural roads to implement highway greening.

Where regenerative felling of protective trees is required, relevant laws and regulations shall be observed.

Article 22 Any unit or individual shall be prohibited to dig sand, stone or earth, stack materials, set up obstacles, dig irrigation ditches or engage in crop planting, threshing grain drying, dumping garbage, pollutant emissions, damaging and polluting public road, occupying roads for operation, and other behaviors affecting the running and safety of highways; shall not damage, move or alter signs, or set up other signs on rural roads without approval.

 Except for the needs of highways protection and maintenance, it is prohibited to construct or expand permanent buildings and ground structures in the building controlled area of rural roads.

Article 23 Over-limit vehicles are prohibited to drive on rural roads.

 If it is necessary to drive over-limit vehicles for transporting non-decomposable goods, relevant permit shall be obtained in accordance with relevant provisions of the Regulation on Protecting Highway Safety, and effective protection measures shall be carried out. All necessary expenses shall be borne by the transportation unit or individual.

Where heavy-load vehicles drive on specific sections of rural roads frequently due to the needs of projects construction, production or operation, the entity engaged in construction, production or operation shall enter a highway repair agreement with the responsible body for maintenance, pay a certain amount of bond for highway repair, and repair, modify the highway in a technical criteria no lower than original level, or give corresponding economic compensations.

Article 24 In the light of needs of protecting rural roads, the rural roads administration at the county level or township (town) people’s government shall set up necessary height or width limiting facilities at the entry/exit without affecting the emergency passage of firefighting, engineering rescue, health and first-aid vehicles, but shall not charge fees from the passing vehicles. Height or width limiting facilities must be provided with eye-catching signs and night reflecting signs.

Article 25 The rural roads administration at county level shall deal with the over-limit activities of vehicles that are found by field inspection, accepting reports and other manners in supervision on the spot; if on-the-spot is not possible, it shall be dealt with nearby.

Any unit or individual shall not hinder or interfere with the legal inspection and punishment of the rural roads administration at the county level on over-limiting transportation on rural roads.

Article 26 The administration on planning and construction of modification and overhaul projects shall make the reference to relevant provisions of Chapter II of these Regulations.

 

Chapter IV Raising and Using of Maintenance Funds

 

Article 27 The people’s governments at all levels shall establish a funds raising system for highways construction, maintenance and management mainly relying on government investment, supported by investment of rural collective economic organizations, and involving social forces. The sources of funds mainly include:

(1) The special funds subsidized by the State and Central financial transfer payment funds;

(2) The financial funds arranged by the people’s governments at all levels;

(3)The funds for the use of village road construction and maintenance raised by villager committees through the method of "one meeting for one case" and government subsidies;

(4) The social donation from enterprises and individuals or funds raised through rights of entitling and greening rural roads;

(5) The funds raised through other legal channels.

Article 28 The people’s governments at the county levels and upwards shall, in the light of needs of rural roads construction, maintenance and management tasks in that year, incorporate the funds for rural roads construction, maintenance and management into the government financial budget at the corresponding level.

Article 29 The criteria and percentages of allocating provincial funds for rural roads shall be formulated by the competent departments of finance and transportation of the provincial people’s government.

Article 30 Units, individuals and beneficiary units along the rural roads are encouraged to construct and maintain rural roads by voluntary donation.

Article 31 The funds for rural roads construction, maintenance and management shall be managed uniformly, and used exclusively for designated purposes. No entity or individual is allowed to withhold, misappropriate or divert funds.

The competent department of transportation of the people’s governments at the county level and upwards and the rural roads administrations shall strengthen the funds management for rural roads construction, maintenance and management to improve efficiency of the utilization of funds.

 The departments of finance and auditing shall supervise and inspect the use of funds for countryside highway construction, maintenance and management according to law.

 

 

Chapter V Legal Liabilities

 

Article 32 The people’s governments at all levels, relevant departments and highways administrations, and their functionaries who fail to fulfill their duties for rural roads as described in these Regulations, and involve any of the following acts, shall be instructed by the corresponding entity, superior organ or relevant administrations to make corrections, the directly responsible person in charge and other directly liable persons shall be given disciplinary actions according to law; the losses caused shall be reimbursed by the responsible person in accordance with law; where a crime is constituted, they shall be investigated for the criminal responsibilities in accordance with law:

(1) Failing to formulate and publicize rural roads planning;

(2) Failing to organized and deploy rural roads maintenance as stipulated by these Regulations;

(3) Failing to fulfill the duties for quality and safety supervision and administration of rural roads construction and maintenance markets and projects in accordance with law;

(4) Failing to fulfill the duties for rural roads maintenance in accordance with law;

(5) To contract the rural roads construction and maintenance projects illegally;

(6) Failing to establish or implement the working system of dealing with the illegal over-limiting and responsibility tracing system, or hindering or interfering with the legal inspection and punishment of the rural roads administration at the county level on over-limiting transportation on rural roads and other law enforcement activities;

(7) To withhold, misappropriate or divert the funds for rural roads construction , maintenance and management;

(8) To excise the right of examining and approving rural roads construction, maintenance and management illegally; or

(9) To abuse one's powers, neglect one's duties, practice favoritism and other irregularities.

 If the competent department of transportation, highways administrations at the county level and upwards, or township (town) people’s government and their functionaries who fail to fulfill their duties for rural roads as described in these Regulations, and involve any of the following acts, the competent department of transportation at the next higher level, the people’s government at the corresponding or the next higher level shall circulate a notice of criticism to the responsible entity, and instruct the concerned to make corrections within specified time limit; where the circumstances are serious, the competent department or supervision organ shall impose an administrative sanction on the directly responsible person in charge and other directly liable persons in accordance with law; where a crime is constituted, the criminal liability shall be duly prosecuted in accordance with law:

(1) Failing to fulfill duties for rural roads maintenance and management in accordance with law;

 (2)Failing to invite for bid for the rural roads construction projects which shall be subject to bid invitation;

(3) To neglect one’s duties of supervision and administration in the rural roads construction, and causing serious quality problems;

(4) To put the rural roads into service which are not subject to acceptance or fail in the acceptance;

(5) To withhold, misappropriate or divert funds for rural roads construction, maintenance and management;

(6) To raise funds for rural roads construction and maintenance from entities and individuals by coercive means;

(7) To abuse one's powers, neglect one's duties, practice favoritism and other irregularities.

Article 33 In violation of these Regulations, construction without approval shall be instructed to stop by the competent department of transportation of the people’s governments at the city level and upwards with districts, and imposed a fine of RMB50,000.

Article 34 In violation of these Regulations, anyone felling of protective trees on rural roads without approval shall be instructed by the rural roads administration at the county level to replant, with all illegal earnings confiscated, and imposed a fine of 3 up to 5 times trees’ value.

Article 35 In violation of these Regulations, for causing the damage of rural roads pavement, highways pollution or affecting the safety and accessibility of rural roads, the rural roads administration at county level shall instruct to stop the illegal activities, and impose a fine of RMB3,000 to 5,000.

Article 36 In violation of these Regulations, for damaging, moving or altering rural roads signs without approval, or setting up other signs on the rural roads, and over-limit vehicles driving on rural roads without approval, the rural roads administration at the county level shall instruct to stop the illegal activities, and impose a fine of RMB15,000.

Article 37 In violation of these Regulations, for over-limit vehicles driving on rural roads without approval, the highway administrations at county level shall instruct to stop the illegal activities, and impose a fine of RMB30,000.

Article 38 As for those breaking or damaging rural roads and accessory facilities thereon, the offenders shall make repair or modification by technical criteria no lower than the original level, or give corresponding compensations or reimbursements based upon the degree of breaking and damaging; where a crime is constituted, the criminal liability shall be investigated in accordance with law.

    

Chapter VI Supplementary Provision

Article 39 These Regulations shall become into effective as of the date of January 1, 2016.
